Introduction.

This roll is full of the ordinary business of administration: justice, appointments to offices, grants and confirmations, and letters of protection and attorney for those staying and going to Aquitaine.

The entries relating to justice were mainly in response to petitions. One entry related to the community of Bordeaux, and concerned the claim of the mayor jurats and community over the banlieue of the city. 1 Two further entries related to people accused of causing death. The first concerned an inspeximus of a pardon and related documents concerning Arnaut de Saumont, a damoiseau active in the king's service in the southern part of the duchy. He had been pardoned for the death of Ramonet de Ros, and although this allowed him to escape royal punishment, it still left open the possibility of civil action by the friends and family of his alleged victim. They, it would seem, had sought to have a case brought against Saumont in Dax, but although Saumont was attached, he pleaded that because of his pardon such process could only be held before the king or his council in Bordeaux, a plea that the king was prepared to uphold. 2 The second pardon is perhaps more interesting for it was granted to Per-Arnaut d'Artigosse for the death of Mabilia, his wife, one of the few examples where pardons were granted in the rolls for a marital death. 3 Another example, resulting in a commission, concerned one of the perrenial problems facing the king-dukes, the granting of privileges that were prejudicial to royal or ducal rights, and to those that had already been granted to others. This particular example pitted the abbot and convent of Saint-Sever, against jurats and community of the same place. The abbot and convent alleged that unspecified liberties that the king had granted to the jurats and community contradicted an agreement ( pariage ) made between the king and the abbot and convent. The king wished to know the truth of the matter. 4

Appointments to and grants of office concern a variety of offices. The most important office was the appointment of John Harpsden (or Harpedene), kt, as seneschal of Aquitaine. In addition to his appointment, a number of letters of protection and attorney were granted to Harpsden and his retinue and servants. 5 Most of the other offices that were granted were of a more minor nature, being writing offices and prévôté, 6 though two were for Estèbe Hourtic, appointing him to senior judicial positions in Bordeaux. 7

Royal grants are perhaps the most significant business on this roll. Indeed two important supporters of the Anglo-Gascon cause were very richly rewarded on this roll both directly and indirectly. The first of these, the Soudan de la Trau, claimed to have lost much of his inheritance, and that of his wife, because of his loyal service. Although this was a common claim of those hoping to elicit royal favour, the Soudan's family were staunch supporters who fortunes had been impacted by the French advance. On this roll, the Soudan was initially rewarded with lands and tenements forfeited by Johan and Amaniu Colom for their treachery, though a proviso was made for creditors of the Coloms. The Soudan received further favour with a grant of a market, and also of a licence to build and crenelate a castle in his lordship of Arbanats, to allow him to secure a possession that seems to have been ravaged during the war. Finally, the constable of Bordeaux was ordered to pay an annuity of 200 old écu and the the arrears of the same. As generous as the king was with the Soudan, this paled into insignificance when compared with the favour shown to Master Ramon-Guilhem de Puy, clerk, judge of the king's court of sovereignty in Aquitaine. Firstly the constable of Bordeaux was ordered to pay the arrears of the fees and wages due to him from the time that William Loring was constable. 8 Although such orders did not always result in payment, Puy was also rewarded with a royal protection to preserve him from attacks from those he had alienated as a judge. 9 In addition, Puy received a ratification and confirmation, the first of an assignment made by the constable on the lands of the late rebel Bérart III d'Albret (d.1379), and the other of land forfeited in the Landes. 10 Perhaps the most important grant, the one that recognised Puy's importance to the king-duke, was that of an annuity of 100 gold francs, a supplement to the 300 gold francs that he already received for his office of judge and as councillor in Aquitaine, because it marked Puy's retainder by the king as councillor on both sides of the sea. 11 The importance of Puy can also be seen in the influence he was able to extend for his followers and servants. Two further grants made at Puy's request, obtained small annuities - 10 marks for Bernat Audouin, esquire, Puy's servant, and 6 m.st. to Johan de Pene, Puy's clerk. 12 The king also made use of ecclesiastical offices. Not being aware of the offices open to him he ordered the seneschal of Aquitaine, the mayor of Bordeaux, and the constable of Bordeaux to identify any that were available, especially those in the cathedral of Saint-André, and those that they found were to be bestowed on four English clerks. 13 In addition to this provision, William Tipet, a royal servant who appeared to have grown old and feeble in that service was provided with a corrody in the abbey of Saint-Sever. 14

Trade was of less significance on the roll, with the irregular enrolment of licences to trade in the duchy producing only five such instances in 1384-5. All but one of these were to English merchants, and mainly concerned the usual trading commodity exported from England to Aquitaine - wheat. 15 Two further entries are of more immediate interest. The first of these concerns the English crown's periodic attempts to enforce the payment of customs on export cloth. John Bunt of Bristol was assigned to arrest various kinds of dyed and undyed cloth exported to Bayonne without a cocket seal or paying the customs. Such orders appear on the Gascon Rolls throughout their course. 16 The other entry related to the very difficult conditions that faced English and Gascon merchants in sailing between the kingdom and the duchy. With continued and intensified attempts by the French to disrupt the trade which saw victuals taken from England, and the wine vintage brought back, the development of the convoy system proved the most effective way of protecting the shipping. The seneschal of Aquitaine and the constable of Bordeaux were ordered to ensure that all of the ships leaving Bordeaux did so in convoy, there being rumours that the French were preparing a large fleet. 17

Grant by the king's special grace, and with the advice of his council, to Nicholas de Arches , for his good service in the lordship of Aquitaine, of the Kibsak castle of Cubzac and the Kibsades lordship of Cubzadais with its appurtenances in Aquitaine; and holding the same to the value of 20 l.st. per annum without rendering anything to the king. It is provided that if the castle and lordship exceed the value of 20 l.st. per annum, then Arches is to answer to the king for the surplus at the Burdeg' castle of Bordeaux at the usual terms by the hands of the constable of Bordeaux.

3 July 1384 . Westm' Westminster . For the mayor, jurats and community of Bordeaux.

Order to the seneschal and the king's council in Aquitaine, to summon the king's proctor and others whom they think ought to be summoned on the king's behalf, and also the other parties, hear their arguments concerning the mayor, jurats and community of Bordeaux 's claims over the banlieue, and view the letters patent of the king's grandfather concerning it. If it is as alleged, then they are to do justice without delay according to the laws and customs there. They are also ordered to meet with the mayor, jurats and community and consider the issue of their request that they are able to have the profits of the common lands of the city ( paduancia ), if any, for the public good, and of which they have the use and service, neither the they, the king or his progenitors having any profit from the same, because the king's council does not understand what this is, whether it is to the king's grave damage and prejudice, nor whether the use of the same ought to pertain to the king. They are to ordain what they think is right to satisfy the mayor, jurats and good men of the city, without disinheriting or doing great damage to the king.

The king has received a petition on behalf of the mayor, jurats and community, that although they ought to have the banlieue towards the Médoc and the Inter duo Maria Entre-deux-Mers , with high and low lordship of the same both on land and at sea, by right of inheritance of the city, and pertaining to the supplicants, however, the king's officers have occupied one part of this, and still occupy it, disseising the supplicants, and certain other individuals have occupied the other part and hold it, notwithstanding that the banlieue was wholly restored to the supplicants by E[dward III], late king of England , the king's grandfather, just as appears by the letters patent of that king, as they assert, having shown a copy to the king in a public instrument, and they have requested that the banlieue be restored to them.

6 July 1384 . Westm' Westminster . For Per-Arnaut [de Béarn], kt.

Confirmation, at the request of the king's uncle, John [of Gaunt], king of Castile and León , duke of Lancaster , to Per-Arnaut de Béarn, kt , for his good service to the king's father and the king in their wars against their French adversary, of his purchase of the barony of Astan Estang , Poio Pujo , Montagut and of Jeloos Geloux with the appurtenances, he being in actual possession by the seneschal of the Landes , and the prévôt of Saint-Sever by order from the king's court of sovereignty of Aquitaine, as the king has been given to understand, saving only the king's right, and that of any other party. In addition the king grants to Béarn his part of Montagut with its appurtenances which does not exceeding the value of 20 l.guien. per annum, holding the same from the king and his heirs by the customary service during pleasure, without rendering anything to the king. The king further confirms to Béarn the annuity of 200 l. of money then current in Aquitaine which the king's uncle granted to him when he was lieutenant of the late king, the king's grandfather, in Aquitaine, taking the same for his life from the places of Leas Lias and Montguillem Monguilhem , these places then being in the hands of the king's enemies, if the same come back into the king's obedience by Béarn's action or purchase, and if by that action and purchase they do not do not come into the king's obedience, then Bearn is not to have that money unless the king's decides that he does.

Grant by letters patent to the Traue Soudan de la Trau , for life, the king considering the estate of the Soudan, and the loss which he has sustained in the hereditary land of his wife, and otherwise, in the king's service there on occasion of the wars between the king and his adversary, of certain lands and tenements which were Johan Colom and Amaniu his brother's, just as is more fully expressed in those letters. The king has ordained, with the assent of his council, that the seneschal of Aquitaine, and the constable and mayor of Bordeaux , or two of them at least, are to put the Soudan in possession of the land and tenements, to have and to hold them for his life, with whatever pertaining to them. It is provided that the Soudan give sufficient guarantee to the seneschal and council of Aquitaine that he will pay to the creditors of the Colom brothers, what the seneschal and council will order, according to the assessment of the land and tenement which is owed to them, without any recourse to law. And also the seneschal and council will compel all those who have received the profits and revenues of the lands and tenements of the Colom brothers on the days that they died, to whomsoever's hands they came after Johan's death, and to put all the profits and revenues into the hands of some good man to pay the creditors of the Colom brothers, and to achieve this they are to compel those who hold the lands and tenements by seizure and arrest of their bodies, distraining and selling their goods and property, moveable and immoveable, notwithstanding any gifts, acts, legal objections, warranties, evasions or quibbles. And if the profits and revenues are not sufficient to satisfy the creditors, then all those who hold the inheritance, lands and revenues of the Colom brothers on the day that Johan died by reason of gift or other title, they are to be obliged to pay what they ought to pay, or what the previous holders of them paid. And if any parcel of the lands and tenements granted to the Soudan have been sold or alienated to any person, then the steward and council are to revoke it and put it back in its original state without delay.

Confirmation by the king's special grace, and by the advice of his council, to the mayor, jurats and community of Burdeg' Bordeaux , for their good conduct and great loyalty, and in consideration of the circumstances of the collapse of a tower and a great quantity of the wall of the city, of the grant to them by the seneschal of Aquitaine, of an imposition of 12 d. in the pound of money current there on all rebels and enemies, and 6 d. in the pound of the same money on those obedient to the king, taking one moiety from the sellers, and the other moiety from the buyers, on merchandise sold, bought, exchanged or transferred, or in other ways transfered from hand to hand from the last Easter, for one year. Further, by the same grace and advice, the king grants the imposition for a further year in the manner that it is currently levied, under the following conditions, namely: that the money raised by the imposition is used only in the repair of the wall, and the making of the tower for the fortification of the city; and that a certain good man, whom the seneschal and council will ordain, which man will be both keeper of works, 1 and from time to time to look over and write down the money brought in by the imposition. If the walls and towers are reasonably well built within the term of two years, or if they find a better way of getting it done by the imposition, or from other profits of the city within the two years, then the imposition is to cease. The king grants this, having received a request on behalf of the mayor, jurats and community, for the confirmation and extension.

Inspeximus of letters patent of vidimus of William Privet, Umbrarie prévôt of the prévôté of the Ombrière of Bordeaux, under the seal of his court, in these words:

18 April 1384 . Burdeg' Bordeaux .

Vidimus of William Privet, prévôt of the prévôté of the Ombrière of Bordeaux , stating that he has seen, held, handled and diligently inspected, and caused the same to be read and published by his clerk, certain letters patent, sealed with the seal of red wax of the court of the court of sovereignty of Aquitaine of the king of England and France, and shown to him by Arnauton de Saumont, damoiseau , the letters not being erased, cancelled or in any way suspect, but appearing to him completely without defect and suspicion, in the following form:

27 January 1384 . 1 Burdeaux Bordeaux .

Order of Richard [II], king of England and France, and lord of Ireland, to the seneschal of the Landes, or his lieutenant, to prohibit, under the pain of the forfeiture of all that he can forfeit in body and goods, all the process against Saumont and his pledges, and cancel, revoke and annul all obligations made by Arnauton concerning the death of Ramonet de Ros . He is also to release all those who gave pledges for Arnaut from their obligations. If the friends of Ramonet wish to proceed in a civil case against Saumont, they are to be assigned a suitable day to appear before the king or his council of Aquitaine in the Bourdeaux castle of Bordeaux , when justice will be done to them by the king or the people of his council. The seneschal is to certify to the king what he has done on this, by his letters, or otherwise by charters and public instruments.

Before this time, by the advice of the king's council of Aquitaine at Burdeaux Bordeaux he has pardoned Saumont, for all civil and criminal penalty which he has incurred in body or goods because of the death of Ramonet saving the right of the party to take civil proceedings in the castle of Bordeaux, as appears by the king's letters, the tenor of which follow:

29 July 1383 . The Bourdeaux court of Bordeaux . By the lords of the council A[rnaut de] Madéran [and] A. Campies .

Pardon granted by Richard [II], king of England and France, and lord of Ireland, by his special grace, and by the advice of his council at Bordeaux, to Arnauton de Saumont, damoiseau, at the request of certain of his friends, and for his good and agreeable service to the king and his progenitors, forever of all trespass, felony and excess, and all civil and criminal penalties that he has incurred in body and goods for the death of Ramonet de Ros, in whatever manner he is culpable. He is restored to his good name, and peace, and his goods and property. The king revokes and annulls all processes and bills of arrest, and all things done against Arnaut and his goods, by his grant because of the death, at the prosecution of the party. The right of the party to pursue the matter civilly before the king or his council of Aquitaine in the castle of Bordeaux is reserved. It is ordered to all seneschals, mayors, prévôts, officers, justices and others, that from henceforth they are not to disturb, arrest or damage Arnaut for the death in body or goods, but suffer him to use and enjoy the pardon peacefully.

Saumont, went to Soule in the company of the seneschal of Aquitaine, at the prosecution of the friends and parents of Ramonet was arrested in the town of Mauléon for this death, and because he alleged that he had been pardoned by us, he has not been able to escape or be at large until he gave his pledge to come to do right before the seneschal in the town of Saint-Sever at a certain day to answer there to what the friends and parents of the said Ramonet would wish to challenge and demand against him because of the death. Saumont has sworn on the Gospels to the king that he dare not go to the place because of the great fear that he has of the the friends and parents, and has requested a remedy from the king, and the king attends to his pardon, and also that he not be obliged to go to Saint-Sever, or be delivered into the hands of his enemies, even supposing that he had letters of conduct, and notwithstanding that Saumont gave good and sufficient pledges to stand to right to the party before the king or his council of Aquitaine in the castle of Bordeaux whenever required.

Privet publishes the letters that his clerk has read and inspected, strengthening the same as much as he is able by his seal of office.

The king approves, ratifies and confirms the remise, pardon, return, restitution, revocation, cancellation, annulment, defence and release.

Order to the seneschal of Aquitaine, and the constable and mayor of Bordeaux , or their lieutenants, to put Cifrewas William Sifrewast, esquire , in corporal possession of the Sanctus Emilio prévôté of Saint-Émilion with all profits and revenues, he holding the same according to the tenor of the king's letters, and they removing any illicit detainers of the same. The king, by his special grace, for the good service that Sifrewast has done to the king's father , and to the king in their wars in their lordship of Aquitaine, and at the request of the king's mother , has granted the prévôté to him for his life with all profits and revenues up to the value of 10 l. a year, provided that if the profits and revenues exceed that 10 l. a year, he should render the surplus each year at the castle of Bordeaux to the constable of Bordeaux, at the feasts of Michaelmas and Easter by equal portions, just as is more fully contained in the king's letters patent. 1

To the archbishops, bishops, abbots, priors, dukes, counts, barons, justices, vicomtes, prévôts, ministers and all the king's bailiffs and faithful subjects.

Grant to the Soudan de la Trau , 1 that he and his heirs may have forever a market each week where they wish within their lordship and land of Darbenatz Arbanats ; and four fairs each year for four days, namely one on the feast of Saint Vincent, 2 another on the feast of Saint Luke, 3 the third on the purification of the Blessed Mary, 4 and the fourth on the feast of Holy Trinity, with all liberties and free customs that pertain to the market and fair; unless the market or fair are to the damage of neighbouring markets and fairs of the king's subjects.

Grant by the king's special grace, to Barte, la Pey de Labarthe of Sanctus Genius Saint-Gein , for his good service in the king's wars in Aquitaine, of a moiety of the site ( unius platea ) of a water mill with appurtenances in the territory of Sanctus Genius Saint-Gein within the seneschalcy of the Landes. Having the same for his life from the king and his heirs, by the customary service, provided that he should make half of a water mill on the site so that milling can take place as it did anciently. The king desires that the lord of Castandet , to whom the other moiety of the site pertains, will cause the other half of the mill to be built, and that the seneschal of the Landes and the constable of Bordeaux will ensure that this is done. After the death of Labarthe the moiety is to revert to the king, the same being valued at 60 s. per annum as a whole once the mill is contracted.

Grant, by the king's special grace, for the good service that Cifrewas William Sifrewast, esquire , has done to the king's father , and to the king in their wars in their lordship of Aquitaine, and at the request of the king's mother , of the Sanctus Emilio prévôté of Saint-Émilion , having the same for his life with all profits and revenues up to the value of 10 l. a year, provided that if the profits and revenues exceed that 10 l. a year, he should render the surplus each year at the castle of Bordeaux to the constable of Bordeaux, at the feasts of Michaelmas and Easter by equal portions. 2

Order to the constable of Bordeaux that when he has receive from the Traue, la Soudan de la Trau , the letters patent of the king's father, and has cancelled those letters, he is to pay to the Soudan the arrears of the 200 old écu ( scutum ) annually granted to him from the profits and revenues of the Umbrarie, Burdegal' prévôté of the Ombrière of Bordeaux from the 20 May, and the same sum each year for the life of the Soudan from those profits and revenues, according to the tenor of the king's letters of that date, any gift or grant made by the king's lieutenant or seneschal of Aquitaine, or any other minister there to anyone else before 20 May on the prévôté notwithstanding. Receiving from the Soudan his letters of acquittance attesting to each payment, by which the constable will have due allowance in his account. It is provided that the Soudan should not receive double payment of the sum because of the king's earlier letters to the assessors or receivers.

Lately the king ordered by his executory letters patent of the 20 May 1381 to the assessors or other receivers of the profits and other revenues of the prévôté, that they pay to the Soudan, or his attorney the arrears of an annuity of 200 old écu , the king granting that the annuity be paid from that source for the Soudan's life. It is provided that the Soudan, before he receives any payment [should surrender] the letters of the prince, the king's father , by which he granted to the Soudan 200 old écu to be taken from the money struck in the city of Bordeaux, because the Soudan was not able to have any payment of the same to be received from the profits and revenues of the prévôté, because John de Stratton, Landirans lord of Landiras , constable of Bordeaux , received whatever issues of the prévôté for his time. 1

Grant with the assent of the king's council, at the request of Ramon-Bernat, Castrum Novum de Tursan lord Castelnau-Tursan , he having given the king to understand that he has not been able to have any of the 500 l. annuity previously granted to him, that he should have and take for the 500 l. , 160 l. each year from the issues and revenues of Genoe Geaune , Miramont , and Pimbo , which are in the hands of rebels or destroyed, for his life, if those places come into the king's obedience by the action or acquisition of Ramon-Bernat. If they come into the king's obedience for other reasons, and not by the action of Ramon-Bernat, he should take the 500 l. during pleasure from the issues and revenues of those places, and other places in the king's obedience, and others not given, the places of Montguilliam Monguilhem and Montagut excepted.

On the 8 August 1379, because Ramon-Bernat had given the king to understand that on account of the war he had lost his hereditary lands, and had nothing to maintain himself on, the king had, by his letters patent, and with the assent of his council, granted him an annuity of 500 l. of money current there, to be taken each year during pleasure to help maintain him, from the issues of the seneschalcy of the Landes from the receiver there, at Michaelmas and Easter by equal portions. 1

To the seneschal of Aquitaine and the constable of Bordeaux, and their lieutenants, and also others of the king's council there.

Order that by the advice of the king's council, and one or two of them to view the letters of the king's father to Ramon-Bernat, Castrum Novum de Tursan lord Castelnau-Tursan , and the king's letters of confirmation of them, and call before them the heirs of Guiraut de Tartas, late lord of Tartas , and if those heirs cannot show any reason why Ramon-Bernat ought not be put in possession of the 200 l. a year granted to him by the king's father, then they, or any two of them, are to cause Ramon-Bernat to have possession of the same, and cause full justice to be done to the parties summarily, and only allowing proper delays, notwithstanding that the fishery from which the money was to be paid is in the seneschalcy of Landes , the Daxe prévôté of Dax or the Bourc, la baylie of Labourd by which the heirs can avoid justice from the seneschal and others or two of them.

On 8 August 1369, the prince , the king's father, for the good service of Ramon-Bernat, by his letters patent, which the king has confirmed, granted to Ramon-Bernat 200 l. of the prince's money in Aquitaine, to be had from the issues and profits of the Guysson fishery ( nasse ) of Guiche from those who held it, until the king's father provided Ramon-Bernat with lands and rent to the same value of 200 l. elsewhere. Afterwards on 1 January 1372, the king's father, by others of his letters patent, for the good service of Guiraut de Tartas, then Puyane lord of Poyanne , to the king's father, gave to him and his legitimate heirs of his body, the fishery of Guiche, with the profits and emoluments belonging to it, doing liege homage to the king's father, and rendering to the king's father and his heirs, one falcon each year at the castle of the king's father of Bordeaux, at the feast of All Saints. Ramon-Bernat by his prosecution asserts that he has injured by the heirs of Guiraut. 1

Grant to Radegonde Béchet, lady of Mortymer Morthemer , of the fourth part of the Burdegal' market of Bordeaux , which is in the king's hands, for her life, with the profits, emoluments, customs and revenues pertaining to that fourth part. The king also grants to her the three parts of the same market, with their appurtenances, which are in the hands of the good men of Bordeaux for a certain term of years due to end at Michaelmas next, holding the same for her life after the end of the term, with the profits, emoluments, customs and revenues pertaining to the three parts. It is provided that after the death of Béchet the parts of the market with their appurtenances should wholly revert to the king and his heirs. 2

On behalf of Daretz Gassie-Arnaut d'Aretz, brother of Daretz Bertran d'Aretz and Castro Pey de Castet , executors of the testament of the same Daretz Bertran d'Aretz it has been made known to the king that lately a legal case was begun before the mayor, jurats and court of the city of Bayonne , between Villa, de Bernat de Bielle and Malcayd Ramon de Malcaide , citizens of Bayonne, plaintiffs, and Bertran d'Aretz, their fellow citizen, defendent, now deceased, on a petition concerning 53 pipes of wine valued at 1,200 fr. , just as is more fully contained in the process put and heard before the mayor, jurats and court. Finally the definitive sentence found for Aretz just as appears in the process and judgment, and Bielle and Malcaide appealed to the judge appellate of the court of Bordeaux , and the parties or their proctors appeared before him, and the process of the principal cause before the mayor, jurats and court was viewed, and by a second sentence the judgment was confirmed by him against Bielle and Malcaide with a condemnation of expenses. Following this Bielle and Malcaide appealed this judgment to the judges of the king's court of sovereignty in Aquitaine and in Bordeaux , who gave a definitive sentence in favour of Bielle and Malcaide wrongly and unjustly, and Aretz, because of this injustice lawfully appealed to the king and his council in England, in writing and within the legal time, and the king wishing justice to be seen to be done, committed its hearing to the bishop, and to Furno, de Pey Dufour and Domus Nova Johan Maisonnave , burgesses of Dax, by his letters patent, with a clause that they proceed in the same and determine it, any exceptions or appeals to the contrary notwithstanding. Dufour and Maisonnave received the letters, the bishop being absent by the king's order, and they summoned the parties before them, and viewing and investigating all the preceding process, found the third sentence of the judges of the court of sovereignty of Aquitaine wrong and in error, and upheld the sentences of the mayor, jurats and court of Bayonne in the principal cause, and the judge appellate of Gascony in favour of Aretz, condemning Bielle and Malcaide in the expenses, just as more fully appears in the instrument of the same sentence and process had before them. Since three sentences have been given in favour of Aretz, and no further appeal should be permitted, the executors have requested that those three sentences be confirmed by the king's authority, and they be executed, to which the king wishes to agree. 2

Order to the seneschal of Aquitaine and the constable of Bordeaux, and their lieutenants, to permit Radegonde Béchet, Morymer lady of Morthemer , to take all of the custom of issac with all the profits and emoluments pertaining to to it, together with the issues and profits since the 12 January, until the king orders otherwise, the king having granted this because William Houghton of London , draper , John Luton of London , goldsmith , John Waltham of London , skinner , and Richard Waltham of London , skinner , have personally mainprised before the king in chancery for her that she would answer to the king's servants, Rauf Walter Ralph and John Rose , for the annuity of 200 l. annuity from the 12 January onwards, if the same is adjudged to them in a case pending between them. Lately the king by his letters patent granted to Béchet the custom on wine called issac ( le ysshac ) in Bordeaux for her life, with all profits and emoluments pertaining to it, provided that she is to satisfy all those who have received a grant of the custom, or any part of it, by the king's letters patent. Afterwards, on 12 January following, by other letters patent of the king, he granted to Ralph and Rose, 200 l.bord.nig. , which Landirans Pey de Landiras, kt , deceased, had for the term of his life by the grant of the prince, the king's father on the custom of issac, from the wine sold in taverns in the city; holding and taking the same from the custom from the collector for the term of their lives. Béchet has now requested that, since a plea is pending before the king in chancery between her, Ralph and Rose concerning the 200 l. and that she is wholly impeded on account of the grant to them, that the king will wish to grant to her that she can have the whole custom until the pleas is discussed. 1

Grant with the advice of the king's council, to the Traue, la Soudan de la Trau , of a licence to build and crenelate a castle in a place of his choosing in the lordship and land of Darbenatz Arbanats , 1 within half a league of the place of Arbanats , and once built, hold the same for ever without impediment of the king or his heirs and their ministers. The Soudan has shown the king that he had of his own inheritance and that of his wife a moiety of a castle one day's journey from the city of Bordeaux, which castle was anciently called Arbenatz Arbanats , with high and low lordship, and four parishes in the same lordship, which ought to be valued at 300 m. per annum, and how when the daniou duke of Anjou when he took Riole, la La Réole and Seint Macaire Saint-Macaire and the surrounding country, and the Loguiran lord of Langoiran , 2 deceased, went over to the French, the men of the duke took the castle and burnt and utterly destroyed it, 3 the castle being built in timber because it was built in a place where water ran through so that it was not possible to build it in stone. 4 Also all the parishes there were destroyed so that no man dared to live there because of the enemies, and because the Soudan does not have a fortalice where they were able to withdraw. And the same Soudan with the aid of the law-worthy men of those parts proposed to rebuild the castle in another place half a league from the place of Arbanats where the castle was previously built, which as the Soudan says was not suitable. The Soudan requests that he is granted a licence to build the castle where he considers most advantageous, so that the Soudan does not lose his land, and the law-worthy men there have somewhere to withdraw there, so that they do not fear to live there because of the invasions of the enemies in the neighbourhood, and because the Soudan has had the castle and lordship by inheritance for the previous seven years, and did not have a place and fortalice where he, his wife or men could securely reside.

Assignment during pleasure to John Bunt of Bristol to search in the city of Baion' Bayonne , and its district for all manner of cloth which is being taken out of England with a cocket or paying customs, taking the same cloth into the king's hands as forfeit by the controller of the prévôté of the city, answering to the king for a moiety of the forfeited cloth by the constable of Bordeaux, and Bunt keeping the other moiety for his labour.

Lately the prelates, magnates and communities of the kingdom of England in the great council of the Lord E[dward III], late king of England , held at Westminster , at the request of the same for the remission of the forfeitures to the king of the aulnage of cloth within the kingdom, granted to the king a subsidy to be taken on each cloth offered for sale, both of one colour and of others, within the kingdom of England, in addition to the customs due from the seller, namely from each cloth of assize in which there is not grain 2 4 d. , and from each half cloth 2 d. ; from each scarlet cloth of assize 6 d. , and from each half cloth 3 d. ; and from each cloth of half grain of assize 5 d. , and from a half cloth 2½ d. ; and from every cloth exceeding the half cloth of assize by three ells and more, not being an entire cloth of assize, paying according to the rate of the subsidy for an entire cloth of the sort, to the king's use. It is provided that no subsidy is to be demanded from any cloth bought by anyone for his clothing, or his family's, or of cloth sealed with the seal of the collector of the subsidy on which the subsidy has been paid by the seller regardles of whosoever hand it has come. All cloth exposed for sale before it has been sealed is forfeit to the king and is to be taken into the king's hands by the collector, aulnager or the deputy of either of them, or the bailiffs of the towns where the cloth was offered for sale and is found unsealed. The king has been given to understand that various merchants, coveting their own profit, and wishing to defraud the king of the subsidy have often taken various clothes out of the kingdom to Bayonne without a cocket, or paying the subsidy to the grave prejudice and manifest damage of the king, which the king wishes to bring to an end. 3

Order to the seneschal of Aquitaine and the constable of Bordeaux that they strictly enjoin all the king's lieges on the king's behalf, that when they come to Bordeaux and leave again to return to England, they do so in the strongest manner, taking account of the damage or loss that they could sustain. The king has heard that his enemies are preparing a great fleet to go to sea and harass the king's lieges going to Burdegal' Bordeaux for the present wine vintage. Wishing to provide protection for his lieges and the English fleet, the king has ordered to various mayors and bailiffs of various towns in England to enjoin all his lieges leaving the ports of those towns to go to Bordeaux for the vintage, that they prepare in the strongest manner that they can, and come together as a fleet for their own protection, minimising the threat from the enemy, and so that they can go without damage as far as Bordeaux safely and securely.

Puy has requested this payment from this source, he having letters from Loring attesting to him being owed a certain sum for his fee and wages for his office of judge, and the king wishes to agree to this for Puy's good service.

Agreement to the request of Master Ramon-Guilhem de Puy, clerk , judge of the king's court of sovereignty in Aquitaine , for his good service to E[dward III], late king of England , the king's grandfather, and to the king, that the king by his letters grant that he and his heirs, executors or goods, not be disturbed, banished, impeded or troubled by virtue of his office, or by parties, the rights and customs there being observed; and order to the seneschal, constable, judge, mayors of Bordeaux and Bayonne, and other justices, officers and ministers of the king in Aquitaine, that they permit nothing to be done to Ramon-Guilhem. Puy has requested this because by reason of his service and office he has several times had to punish the king's subjects in the lordship of Aquitaine, and has, therefore, incurred the hatred of some people, and suffered their malicious plots, who should not be indulged in their efforts to damage him, for which he seeks a special order since these are more feared.

Letters of protection granted to the Traue, la Soudan de la Trau , the king having received him, his lands, and other lands and tenements, vineyards, possessions, rents, property and goods whatsoever both in his own rights, and in right of his wife, under the king's subjection in Aquitaine, into his special protection and defense. The king grants, by his special grace, to the Soudan in relief of his status, respite of both the debts of Johan Colom and Amaniu his brother, and of the Soudan's own debts, to whomsoever they are owed, and for whatever reason they are owed, for the term of five years. The Soudan, his lands, tenements, vineyards, possessions, rents, property and goods, or his pledges or mainpernors are not to be troubled during that term by those to whom the debts are owed.

The Soudan has requested that the king would grant him his protection from the claims relating to the debts from the lands granted him for his maintenance. The land that he has of his inheritance and that of his wife are totally destroyed by the king's French enemy, and are occupied, so that he has little to maintain his estate, unless he is able to have the profits from the 1,500 l.guien which the king granted him from the lands confiscated from the Colom brothers, which he has not been able to have on account of claims made on them by the king's officers in the lordship of Aquitaine, and which lands were charged with large debts by the Coloms. The Soudan has requested that the king grant him his letters of protection to the end that he is protected from those debts for the term of five years.

Annulment of the defamatory schedule of Podio Alto Tetbaut de Poyloaut , and the imposition of perpetual silence on Poyloaut and all other people on the contents of that schedule, and whatsoever accusations and defamations made by Poyloaut against Podio, de Ramon-Guilhem de Puy, judge of the king's court of sovereignty in Aquitaine , Johan Colom of rue Saint-James Rua Sancti Jacobi , former burgess of Bordeaux , and Plassano, de Johan de Plassan, clerk of Bordeaux , by word or writing. The king restores Puy, Colom and Plassan to their former good name and gives them leave to bring actions against Poyloaut. Poyloaut is a prisoner in the Tower of London , and is accused of betraying Burdeg' Bordeaux , because he had arranged the will of the late Bérart [III d'Albret], Lagoyrano, de lord of Langoiran in which he had set up as heir the Lebreto lord of Albret , the king's enemy and rebel, and had granted him possession of places once of the lord of Lagoiran as the executor of the will, and is involved in other capital crimes and the crime of lèse-majesté as is alleged in his letters and according to the information from the king's official and council in Aquitaine sent to the king's council in England and provided a schedule ( cedulam sive libellum ) which defamed Puy, Colom and Plassan, asserting that there had been discussions in Puy’s house concerning allying Bordeaux, not to the king, but to the king of Navarre , and the rebels the Armaniaci count of Armagnac and the lord of Albret. The lord of Langoiran had told them that the king's uncle, the king of León and Castile , duke of Lancaster , 1 had formed a plan to arrest the lord of Langoiran and bring him to England to their denigration and loss of status, when he had heard nothing else unfavourable against them. Poyloaut had not proceeded with the schedule, but gained an adjournment against Puy and Colum even though it was five years and more since the treason, and in the middle of the time Puy was in England, in London and Sar' Salisbury and could have had a copy here. Puy on the king's orders came to England on the king's business and that of his subjects, and Poyloaut was summoned before the king's council, and a suit was brought against him concerning the schedule showing both by Poyloaut's confessions, his sealed letters, the contents of his defamatory schedule, and the evidence given by law-worthy and faithful men, that Poyloaut had provided the schedule to delay the business, giving an example of wickedness and lies.

Commission to three or two of them of full authority and power to call before them both the abbot and convent of Sanctus Severus Saint-Sever , and the jurats and community of Sanctus Severus Saint-Sever , or their proctors, and also the king's procurator in Bordeaux , and others whom they consider ought to be called, and view the king's letters of confirmation granted to the jurats and community, and hear and understand the arguments of the king's procurator, and of the parties. If they find that the letters were surreptitious, and prejudicial to the king, or the abbot and convent, together with all else that follows in those letters should cease, be revoked and fully annulled, and what has been done in prejudice of the king, or the abbot and convent, should be reformed, and restored to its pristine state, according to the fors, laws and customs of the lordship. The king orders them to diligently attend to the doing and examination of this. The king has ordered the jurats and community to appear before the commissioners, or two of them, and exhibit the letters of confirmation to be inspected without making any difficulty.

The king has been given to understand that the jurats and community of Saint-Sever have secretly obtained a confirmation of certain liberties, franchises and customs from the king, by his letters, and that was in prejudice of the king's jurisdiction, and that of the abbot and convent, and contrary to the pariage made between the king and his progenitors, and the abbot and convent, and their predecessors. The king wishes to prevent this damage if the confirmation was prejudicial and secret.

  1. To receive and admit to the king's peace whatever enemies and rebels wish to come back into his obedience, pardoning, acquitting and remitting to whatever persons of whatever nation, whether they be English , Welsh , Scottish , Irish , French , Gascons , and Guyennais ( Gyenensibis ), for the honour and profit of the king, all manner of criminal cases and lèse majesté, robberies, arson, pillage, murder, rape and other criminal cases whatsoever, committed before this time.
  2. To revoke all manner of grants of the king's revenues in the duchy without authentic authority and confirmation of the king's letters.
  3. To grant and permit wine to be brought from the Haut-Pays ( Alta Patria ), 2 as far as Bordeaux, paying an imposition to be set by the advice of the king's council there, in aid of the war; saving only the privileges of the country there if they have anything contrary to this.
  4. To supervise the profits and revenues of the king there, both past and future, and compelling the king's officers to account for these profits and revenues if necessary.
  5. To impose tallages and impositions, by the advice of the king's council there, and the community of the same, the same to be applied for the salvation and defence of the country.
  6. To remove, for reasonable causes, inadequate officers who do not have letters patent of the king appointing them for life, and to replace them with other adequate and suitable officers by the advice [of the council there], the appointment of the constable and mayor of Bordeaux only excepted.
  7. To demolish, by the advice of the king's castle, all manner of fortalices which cannot be defended, and especially those that have been recaptured from rebels, the fortalices that are part of the king's patrimony only excepted.
  8. The seneschal and his lieutenant, wherever they are in those parts, are to exercise justice, both high and low, and complete and shared jurisdiction of rebels in criminal cases and lèse majesté, and also over robbers, murderers, rapers of women, violators of Holy Church, breakers of truces and safe-conducts, and of other malefactors of whatever status and condition, according to the nature of the cases.
  9. If any town or castle is captured, and is put back in the obedience of the king, then the constable of Bordeaux is to be compelled to provide the necessary victuals for the garrisoning of those places, by the advice of the king's council in Bordeaux.

The king promises to ratify whatever the seneschal does by virtue of this grant of authority and power.

Revocation, by the advice of the king's justices and other wise men of his council, of the king's letters granting for life to Rauf Walter Ralph and John Rose the 200 l.bord.nig. which Landirans Pey de Landiras, kt , deceased, had been granted for his life by the prince, the king's father, to be taken from the custom of the issac ( lyssac ) in Bordeaux. The king wishes that Radegonde Béchet, lady of Mortymer Morthemer should wholly have that custom discharged of the 200 l. according to the power and effect of the king's letters patent of 7 June 1383. By these letters the king granted the custom to Béchet for life in part compensation for the great losses that she sustained by reason of the wars between the king's progenitors, the king himself, and their adversaries of France, and also in part to sustain her. It was provided that she should satisfy any person who had letters granting [a sum] on that custom. Afterwards Béchet complained that by other letters patent made after the 7 June, the king granted the 200 l. to Ralph and Rose contrary to the earlier letters to Béchet, and requested that the later letters be revoked. The king, wishing justice be done, by various writs, ordered Ralph and Rose to appear in person before the king in chancery on a certain day, now past, to show why the letters should not be revoked, and to receive justice from the king's court. At that day all the parties appeared, and it was decided by the king's justices and other wise men of the council that Béchet should have the custom discharged of the 200 l. sum, and that the erroneous letters should remain in the king's court. 1

11 May 1385 . Westm' Westminster . For Tetbaut de Poyloaut.

Release to Beamuond Carlos de Beaumont , Pons [VI], lord of Castelhon Castillon , Despremont Johan d'Aspremont, vicomte of Ort Orthe , and Salmys Gassie-Arnaut de Salies from the mainprise that they had made for Podeum Altum Tetbaut de Poyloaut . They had made the mainprise for Poyloaut who had been taken and detained in the king's prison of the Tower of London , mainprising that Poyloaut would not leave the kingdom of England without the king's special licence, and that he would be ready to answer at the king's order before the king and his council, or elsewhere before the king's justices, when and wherever the king wished. The king had released Beaumont and the others because Guy de Brian, the elder , kt , has come into chancery and personally mainprised that Poyloaut would well and faithfully behave as one of the king's lieges. The king has also granted a licence that Poyloaut could go wherever he wanted overseas, notwithstanding the terms of the mainprise of Beaumont and the others.

Grant, by the king's special grace, to Mill' Centz Ramonet ( Romynettus ) de Miossens, esquire , of Aquitaine, for his good service, of the Sanctus Severus prévôté of Saint-Sever , together with the baylies of Tholouset Toulouzette and Sanctus Mauricius Saint-Maurice , which are within the prévôté, and with the exercise of high and low justice, and complete and shared jurisdiction, and also with all manner of rights, dues, profits and emoluments pertaining to them. Holding the same for his life up to the value of 30 l.st. each year, provided that if the offices are worth more than that each year, then he is to pay the surplus to the constable of Bordeaux for the king's use. He is also to do homage to the king before he returns to Aquitaine, and should reside in the king's retainder for his life. He is to exercise the office in person, only leaving it when in the service of the king, or his heir, by special licence of the king's lieutenant or seneschal of Aquitaine, exercising the office by a sufficient person in his absence.

And it is ordered to the seneschals of Aquitaine and the Landes , and the Aquen' prévôt of Dax , or their lieutenants, to put Ramonet [de Miossens] in corporal possession of the prévôté [of Saint-Sever] , and the baylies [of Toulouzette and Saint-Maurice ] according to the tenor of the king's letters, and defend him in the same, removing any that detain those offices.

Order to the abbot and convent of Sanctus Severus Saint-Sever in Gascony to admit Typet William Tipet into their house, and provide him with money, corn and wine, and other property, amounting to what a monk would receive, and make letters under their seal for him for this. The king understands that he has the right to grant such a corrody in the abbey, and granted the same to Typet for his good service to the king's father, and to the king since his coronation, and because he is elderly, feeble and unable to work. 1
