Gascon Roll for the 7th year of the reign of Richard II

Physical condition of the roll

The roll consists of thirteen membranes. There are entries on all of the face sides, but on none of the dorses. The roll is generally in good condition.

C 61/97 7 Richard II (1383-4)

Introduction.

Like the immediately preceeding rolls this roll showed the routine of administration, with the effects of the war as a backdrop. The roll has a sizeable number of grants, a small number of entries relate to justice, and to the appointment to offices. There are also quite a number of letters of protection, many relating to contingents going out from England. That the war was ceasing to be of significance in the rolls probably links to the slow move of the English administrations slow shift towards the negotiation of peace with the French, especially with the failure of Bishop Despenser's crusade in September 1383 which allowed the effective takeover of Flanders by the French.

As with the previous rolls, the number of grants and confirmations are numerous, and mostly relate to the rewarding of Anglo-Gascon loyalists. One individual who did particularly well was Guilhem-Ramon de Madaillan, lord of Rauzan. Madaillan was clearly a trusted figure who had been entrusted to negotiate with rebels, presumably for their return to their loyalty to the duke, for he received a grant that the king would confirm all safe-conducts and patis (truces) that he had granted. 1 Orders were issued to the lieutenant and seneschal of Aquitaine, and the constable of Bordeaux, to put Madaillan in possession of two houses in Bordeaux which the king had previously granted him. 2 Further orders were issued to the seneschal and constable, and to the mayor of Bordeaux, to inquire into whether the mayor and jurats of Libourne had been levying tolls on Madaillan's wine being brought down the river Dordogne, and if they found this was being done without authority, then they were to compel them to desist. 3 On the same day Madaillan received a royal grant that he could bring wine from the rebel areas of the Haut Pays down river to Bordeaux and Libourne, and from there to England. 4 Finally Madaillan received a grant of the town of Sauveterre-de-Guyenne in compensation for other grants made to him by Edward of Woodstock, and by the king, from which he had been able to have nothing. 5 Another grant made to Archambaud de Grailly, the captal de Buch, is of particular interest. Grailly had inherited the title from his nephew, Johan III de Grailly (d. 1376), the most famous captal de Buch, and clearly felt that his possession of his inherited estates, and the basis for that inheritance needed to be confirmed by the king. On 30 September 1383, Archambaud received a confirmation of the contents of the testament of his nephew. 6 In addition, on the 17 December 1383, the captal received a full inspeximus of a public instrument of William Scrope, seneschal of Aquitaine, (dating to 6 October 1383) recording Archambaud's nephew's testament and will which reproduced verbatim the will with its clauses making Archambaud the heir. 7

It was not just loyal individuals like Madaillan and Grailly who received grants, the king also took an interest in the Franciscan house in Saint-Émilion through its secular guardians. This took the form of the grant of the right to bring wine down river from the Haut Pays , the revenues from this being used to build the church in the town, and maintain the friars. 8 In addition to this they were also granted exemption from all tolls within the lordship of Aquitaine, on all of their produce being carried through it, again in aid of the completion of their church. 9 Finally, the king granted Bidau Bigouroux, a burgess of Saint-Émilion, the lands in the Bordelais of the rebel Martin de Montesquieu of the diocese of Condom. These were to be held for twenty years, and the issues were again to be used for the building of the Franciscan church. 10

There are quite a number of letters of protection. One group, amounting to eleven in total, concern those going with William Scrope, kt, seneschal of Aquitaine, who had evidently returned to England part way through the tenure of that office. These seem to have been a mixed group with several knights and esquires, and several others from a wide geographical spread, including men from London, Devon, Montacute in Somerset, and York, one of whom was a tapestry maker, and another a baker. 11 A smaller number were for those who were serving with Richard Craddock, esquire, captain of Fronsac. 12 Other letters had a more varied purpose, especially when combined with letters of safe-conduct. In addition to the grant of protections to loyal English and Gascons, several protections were issued to prisoners and hostages, and those holding them. On 9 November 1383 Loys, vicomte of Rochechouart, a prisoner of John, lord Neville, received a protection for himself and four gentleman or others of his company, and their servants and their horses, permitting tem to cross to Calais and then into France to obtain his ransom. 13 On the same day two further protections were issued to Isabelle de Parthenay, vicomtesse of Rochechouart, and to Foucaud de Rochechouart, and Loys de Rochechouart, the sons of the vicomte to allow them passage through English territory concerning the payment of the same ransom to lord Neville. 14 The grant of a licence to John Shakell was to allow him to keep Pons VI, lord of Castillon-de-Médoc, and Johan d'Aspremont, vicomte of Orthe, under arrest and in prison wherever he liked in England, until he was satisfied for the sum of 23,500 gold Francs, owed to him by Florimont, lord of Lesparre. 15

Entries relating to the provision of justice are not so numerous on this roll, and two at least of these mark continuations of matters from earlier rolls. The complaint of Bernat de Bielle and Ramon de Malcaide, and following his death, his widow Gassia, against their fellow citizens of Bayonne stretched back over several rolls. This matter had already been through several stages in Bayonne and Bordeaux, and the complainants had now turned to the king through appeal. Three leading citizens of Bayonne, a lawyer, and one other, or any three of them, were ordered to deal with this matter so that the king did not hear of this matter again. 16 The case of the treacherous monk - Pey de Baquey - of the abbey of Sainte-Croix in Bordeaux, also makes a further appearance here. In previous rolls orders had been issued for the recapture of the monk who had been released without royal permission, with the archbishop of Bordeaux being suspected of acting in contempt of royal authority to procure the monks release. Having previously issued orders for the recapture of Baquey, the king's attention now shifted to the archbishop's actions, with the seneschal of Gascony, and the king's proctor in the duchy being ordered to obtain further information about the actions of the archbishop. 17 The abbey of Sainte-Croix appears in other entries. It would seem that the abbey and its abbot were under attack from the archbishop of Bordeaux and other enemies, and the king was forced to order his officials in Bordeaux to protect the abbot and the abbey, to annul any processes begun against the abbot, and to make public proclamations concerning the abbots involvement in the prosecution and death of Johan Colom, kt, a leading noble and burgess of Bordeaux executed for treason. 18 It was not just other members of the Church in Bordeaux who appear to have had it in for the abbot and abbey, for John de Stratton, lord of Landiras, and constable of Bordeaux, also had to be ordered to cease his attacks on them. Stratton was alleged to have broken into one of the abbey's cellars and taken ten tuns of wine, as well as compelling them to pay customs on their wine, even though they were exempt. 19

The impact of the war was more evident in other entries. Pey de Saint-Symphorien called 'of Landiras' and Guilhem-Ramon de Madaillan, the lord of Rauzan, who we have already encountered, had both compained to the king that through their service to the king, both being involved in resisting the French enemy, they had been forced to sell and mortgage their lands. Saint-Symphorien showed that he had been captured on many occasions, the last being in the company of Thomas de Felton, then seneschal of Aquitaine. Both requested that the king would permit them to buy back their lands for the money that they had been paid, which the king was willing to concede. 20 Johana Mayensan, widow of Bertran de Ségur, kt, received, on the face of it, a more generous response from the king. By a forfeiture by one of her relatives she had been bound to pay the king 1,000 old écu on land that she had inherited. She claimed that she had been greatly damaged by the war, and that her three sons were fighting in the war for the king, and she requested a pardon of the sum. The king was not willing to fully concede this, but discharged her of half the debt, and gave her five years to pay the other half. 21

Unlike the previous roll trade plays a very small part on this roll. Only one licence for trade appears on it, and this was for François Châteauneuf, Pierre Cépier, and Guillaume Audiger, all merchants of La Rochelle. This permitted them to come to England to trade, and perhaps indicated the continuing interest in the recovery of la Rochelle for the English cause which had been evidenced by several entries on the preceding two rolls. 22 The preservation of the relationship with the duchy of Brittany continued to be of importance. The dukes had had the right to make writs called 'brefs' for trade between the duchy and Bordeaux, and since the English had hopes of continued military co-operation from Jean IV, duke of Brittany, and also relied on a friendly Breton coastline for safe passage between England and Aquitaine, the order to permit Jean IV's enjoyment of this right is no surprise. 23 The king also concerned himself in a trade dispute between English merchants in Bayonne. Walter Bennett complained that John Bowode , a merchant of Bristol, had defrauded him of 100 l.st. , and requested remedy, and the king ordered the mayor and consuls of Bayonne, if the matter was as described, to cause Bennett to be satisfied, arresting any goods of Bowode 's there. 24

From one half of the wine they are to pay the tenth tun and other dues and customs to the king's use by the constable of Bordeaux; and on the other half of the wine they are to pay nothing, the same to be used for the building of the church of the order in Saint-Émilion and to maintain the friars there. Assignment of Kentwode John Kentwood and Ferers Martin Ferrers , to supervise the muster of men-at-arms and archers whatsoever who are going in the king's service to Gascony in the company of Lescrop' William Scrope, seneschal of Gascony , and certify the treasurer and barons of the exchequer of the number of men-at-arms and archers, and of any defects if they find any in the muster, under their seals. The king orders them to diligently attend to this, and has ordered all knights, esquires, men-at-arms and archers who are going in the king's service to obey and be intendant on Kentwood and Ferrers when they warn them to do so.

Order to Bertholomiu de Lesbay , Menta Saubat de Mente and Sancto Johanne Bidau de Saint-Jean , citizens of Bayonne, that at least one of them, with Baroniis, de Gassie Ibarron bachelor of canon law , and Perere Bernat de Peré , there being three of them at the least in total, do what is ordained in the previous commissions and attend to the complaint of Villa Bernat de Bielle, citizen of Bayonne , so that the king does not have to take further action.

Lately, Bernat de Bielle and Malcayde Ramon de Malcaide have complained bitterly to the king and his council concerning a case or cases of appeal between them on the one part, and Daretz Bertran d'Aretz , fellow citizen, on the other, firstly brought before the mayor of Bayonne in the court there, then before the judges of appeals of Gascony in Bordeaux, subsequently before the judges of the court of sovereignty of Aquitaine, and finally before Furno, de Pey Dufour, mayor , and Domo Nova, de Johan de Maisonnave , citizens of Aquens' Dax , judges and commissaries specially assigned for this business because of the several appeals. Bernat and Ramon have complained that in this process the commissaries have passed a judgment against the form of their commission, and against the fors, laws and customs of the city of Bayonne, for Bertran, and against Bernat and Ramon, not having heard them, and have passed an erroneous final sentence. Further they have passed an immoderate assessment of the expenses, and distrained and alienated their goods and property, and caused them to be arrested and detained, to their great prejudice and cost. The king assigned Lesbay and the others, along with Gassie Ibarron, Caverio, de Pey de Cabé , Orassio Pey de Carresse , Dartiguepan Johan d'Artiguepan , bachelors of canon law, and Bernat de Peré, to call the parties before them, and all those who they consider ought to be summoned, view the processes and sentences, and confirm or annul the principal business and by inspecting the rolls of chancery.

Afterwards, and after the death of Ramon, Bernat de Bielle alleged to the king that though he and Gracia Gassia , widow of Ramon Malcaide, executrix of his testament, and administrator of his goods, showed the king's letters to those whom the king had assigned and requested justice, they refused to act because of the death of Ramon de Malcaide and also of Pey de Cabé, one of those whom the king had assigned, and also of the absence of Johan d'Artiguepan and Pey de Carresse, who had gone to the Roman curia. At the request of Bernat and Gassia, the king, by other letters patent dated 20 December last, committed to the same Bertholomiu, Saubat and Bidau, together with Gassie Ibarron and Bernat de Peré, or three of them at the least, just as in the previous letters, to examine, hear and determine the business according to the fors, laws and customs there. Now Bernat and Gassia have complained again that though these last letters were read to them, they, for certain reasons, refused to act in manifest contempt of the king, and to the grave damage of Bernat and Gassia. 1

Grant to Mountendre Guillaume de Montendre 2 of the Aquen' prévôté of Dax , holding the same for the term of his life, with all profits, tolls, dues and emoluments, and other things that pertain to it, from the king and his heirs, by the customary service, in compensation for and to the value of 100 m. each year. The grant is made notwithstanding gifts or grants made by the king's lieutenants, seneschals or others of his ministers in Aquitaine, of the same office, or of the profits, tolls, dues or emoluments or of any part of the same; or the gift by the king to Cazelis Pey de Cazalis, esquire , of Aquitaine, of 80 l. of money current in Aquitaine annually, to be taken on the tolls of Aquen' Dax from the prévôt there, for his life, the king making provisions for the same Cazalis elsewhere. It is provided that if the prévôté is valued at more than 100 m. a year, then Montendre is to answer for the surplus of the same to the constable of Bordeaux at the Burdegal' castle of Bordeaux , at the terms when it is customary to answer for such money.

Florimont, lord of Lesparre , and the Soudan de la Trau 3 have personally mainprised before the king in chancery that Gourney Matthew de Gournay, kt , keeper of the castle of Dax , will deliver the castle to Montendre when given half a year's notice, and that Montendre, by giving that warning, will receive the castle, with its arms, victuals and other property of the king in the castle, from Gournay, by indentures to be made between them. Montendre is to keep the castle in person to the use of the king and his heirs, at his own expense. The king grants to Montendre that after he has had livery of the castle, he should have the same for his life, at his own cost, provided that if the castle has come into his hands, then after his death it should wholly revert to the king.

E[dward III], late king of England , the king's grandfather, on 30 May 1357, by his special grace, granted to Montendre, for his good service, 100 m. to be taken each year at the exchequer at Michaelmas and Easter, by equal portions, for his life, or until the king ordained otherwise for him, just as more fully appears in those letters. The king, on 11 March 1378, confirmed his grandfather's letters by his letters patent. 4

Order to the seneschal of Aquitaine and the constable and mayor of Bordeaux , that they diligently inquire whether the mayor and jurats of Lyburn' Libourne have been taking half a Franc from each tun of wine of Madillan Guilhem-Ramon de Madaillan, Rohazan lord of Rauzan , and his men, coming down the Dordoigne river Dordogne to Lyburn' Libourne , and if they find that they have been taking it, then for how long, and by what authority. If they find that the mayor and jurats have been doing it without sufficient authority, then they are to compel them to cease levying it from Madaillan's wine coming down the river, and permit him to bring his wine there paying only the ancient customs and tolls. Proviso only that wine from the alta patria Haut Pays should not come down river except by the special licence of the seneschal or constable.

Madaillan has complained that the mayor and jurats have been levying half a Franc without sufficient authority for the previous three years, and has requested that the king will order the mayor and jurats to permit him to bring his wine paying only the ancient tolls and customs. The king makes this order because of Madaillan's good service, and the great costs and losses that he has sustained in the king's wars in Aquitaine, and does not wish him to be unduly troubled.

Order to Lebret, de Bertrucat d'Albret , that notwithstanding the grant made to him for life by the king by his letters patent, on 23 September last, of the Inter duo Maria prévôté of Entre-deux-Mers , he should permit Matthew de Gournay to hold the office, taking the profits, emoluments and issues in person or by his proctors, freely and without impediment, until the king can make another grant to Gournay in compensation for the prévôté. If Albret has taken anything from the prévôté since 23 September, he is to restore it to Gournay or his proctors without making any difficulty. The king originally granted the office to Gournay by his letters patent on 7 June 1380, for his good service, but has not been able to assign anything to him in compensation for that office following the grant to Albret. 1

Grant to Sancto Sinphoriano, Landirans Pey de Saint-Symphorien, called de Landiras , for his good service, and because he was forced to sell his lands as a consequence of this service to the king and his progenitors, as the king has been informed, and because the lands that he sold were held of the king, and the king can have those lands for 5 s. less than any other according to the custom of Aquitaine, of all the king's rights in this matter. Order that Pey is to have again and enjoy those lands and rents for him and his heirs, by the authority of the king in as much as they are able according to the custom there, recovering them from whomever has them, both ecclesiastical and secular. The seneschal and constable are to use their diligence in doing this on the king's behalf so that Pey can have the lands and rents for himself and his heirs in aid of the maintenance of his status, paying the sum which he received for the same.

Saint-Symphorien has shown how he was taken prisoner on many occasions in the time of the king's progenitors, and of the present king, in their wars, on the last occasion in the king's service in the company of Thomas de Felton, then seneschal of Aquitaine , and he was put to a great ransom, to pay which he was forced to sell his lands and rents in the lordship of Aquitaine. He has requested that the king will ordain that he is able to buy back his lands and rents for him and his heirs, from those who bought it for the money that he received for the same.

Order to Lescrop' William Scrope, seneschal of Aquitaine , John de Stratton, constable , and Cradok' David Craddock, Burdegal' mayor of Bordeaux , to diligently attend to the request of the captal de Buch concerning the Lourde castle of Lourdes . The king has received a request on the behalf of the Bogio captal de Buch , that the king will grant to him the custody of the castle of Lourdes, 1 for sufficient security to be received from the captal that he will, at the order of the king or his heirs, by the king's letters or those of his heirs, do what the king or his heirs wish concerning the castle. The king wishes that Scrope and the others will speak with Berne Johan de Béarn, esquire , keeper of the same castle , to see if he would be prepared to agree to this, taking into account his long good service in keeping the castle for the king's use, and if he is agreeable, then they are to take security from the captal from sufficient pledges, these being eight at least, that the captal will render the castle to the king or his heirs when requested, provided that they are sufficient. 2

Letters or public instrument of William Scrope, seneschal of Aquitaine, recording that on that present day Denogueriis Master Johan de Nogueys, clerk , proctor of Degreylino, Debogio Archambaud de Grailly, captal de Buch, and vicomte of Benauges and Castellio Castillon , and Podio Paulini, de lord of Puy-Paulin and Castrum Novum in Medulco Castelnau-de-Médoc , exhibited before Scrope as he sat in the tribunal of the Umbrar castle of the Ombrière of Bordeaux , at the hour for the cognizance of legal cases, the last testament, and last will of Degreylino Johan [III] de Grailly , captal de Buch, vicomte of Benauges and Castillon, and lord of the aforesaid places, deceased, which was not erased, cancelled, altered or suspicious. Having set an inquisition, and received by Master Roeda Bertran de Rouède, notary by apostolic and imperial authority, and after his death, by Masters Johan de Nogueys, and Viridariis Gassie de Bergey , notaries by the same authority, the testament dating to 6 March 1379. 1 The seneschal, at the request of Master Johan de Nogueys, records the following articles from the testament, word for word:

  1. The testator makes as his universal heir, his uncle Archambaud de Grailly, and especially and expressly to the vicomtés of Benauges and Castillon, with all their appurtenances, part of the town and port of Delingoniocu' Langon , with all its appurtenances, and all the lands, castles, towns of Grilly in Bergondia Burgundy and of Rulla Rolle , and all the lands and places that the testator has, or ought to have in the Bergondia duchy of Burgundy , the counties of Bergondia Burgundy and Sabaudia Savoie .
  2. And also in all the baronies of Buch and Decerta Certes , with all their appurtenances, and in all the castle and Castrum Novum in Medulco castellany of Castelnau-de-Médoc , and in all the baronies of the same place and castle, and land of Castelnau with all its appurtenances; and in all lands, rents, questaux ( homines questales ), 2 rent payers ( censuales ), millers, and all goods, rents and which the testator holds in the Medulco, de Médoc and Desparra archpriestry of Lesparre , of the mills of Buch and Debornum Born .
  3. And in all houses and residences which the testator had in the parish of Puy-Paulin of Bordeaux, and in all goods, rents, customs and whatever property the testator had, received and was accustomed to receive in the town and castle, and the banlieue and palu ( paludem ) of Bordeaux; 3 and in all rents, profits and emoluments pertaining to the Depodio Paulini house of Puy-Paulin of Bordeaux, and in the barony of Insula in Arruano l'Isle-Saint-Georges , with all the parishes and appurtenances of the same barony; and in small holders ( bordile ) and those holding vineyards ( vineus ), and enfeoffed tenants ( affeuatus ) which the testator had at Cayria Queyries , and in all the land, men and rents which he had in the parish of Laureomons Lormont ; and in all other of the testator's goods, which Archambaud, as heir has.

And in case because of the custom or law, Archambaud is not able to be instituted as heir in the baronies and lands of Buch , of Certes , of Castelnau , of Puy-Paulin , of l'Isle-Saint-Georges , and in the land which he, the testator had in the the parish of Lormont , then the testator grants the enjoyment of both the use of and the profits from the lands of Buch, Certes, of Castelnau-de-Médoc, of Puy-Paulin of Bordeaux, of l'Isle-Saint-Georges, of Queyries with all the appurtenances of the same lands and baronies, for his life.
  5. In addition, the testator gives and leaves to Archambaud and his heirs, 50,000 l.nig.guien. of current money in Bordeaux, one gold guiennaises being accounted as 20 s.nig.guien.

The notaries have published this, attesting its trustworthyness.

Scrope attests the contents of the testament by his letters or public instrument.

Albericus Aubry de Crespy, clerk , notary public , has had this published, comparing it with the original, and found it the same. The king accepts, approves, ratifies and confirms the letters.

Order to the seneschal and judge of Gascony, and the king's procurator and council there, and also the mayor and jurats of Bordeaux , to maintain, protect and defend Salamonis Bernat Salamon, abbot of Sainte-Croix of Bordeaux , and his fellow monks of the monastery, and the members and possessions pertaining to the same monastery, together with their goods and property, from the malice, power and from all violence committed by their enemies and adversaries, and their supporters. The king imposes silence on the matter, and annuls the processes begun against the abbot, and public proclamations are to be made at the abbot's request concerning the prosecution and death of Columb Johan Colom, kt . The archbishop of Bordeaux , and the enemies and adversaries of the abbot are to cease and desist from their accusations, defamation and disparagement of the abbot, and any acts and processes attempted against the abbot are revoked without delay, and proceedings are to be begun without delay against rebels, the disobedient and contravenors in this matter, according to the laws, fors and customs there.

The abbot and his monks assert that through their loyalty to the king, they caused the death of Colom, who was condemned to death by his confession because of which the abbot took no notice of Colum's unlawful confession in court or the attendant legal process, and when different legal processes were brought whilst he was away in England before the archbishop of Bordeaux, unjustly favouring their opponents in that case, and are striving to accuse and disquiet the abbot in the Roman Curia. Since, the abbot says, he cannot escape the malicious power of his many enemies whom he cannot distinguish from his friends without the king's support, the abbot asks the king to help him in return for his loyalty.

Pardon, by the advice of the king's council, to Mayenssan Johana Mayensan, widow of Bertran de Ségur, kt , alias de Franks Francs , because of the great damage and destruction that she has sustained by the wars, as the king has been informed, and for the good service that her three sons are doing to the king in the war, of 500 old écu ( scuti ) of the 1,000 old écu bequeathed in the testament and last will of Sibilia d'Aillan. The king wishes that of the 500 old écu residue of the sum, it is to be paid over the following five years, beginning at the feast of All Saints next, being paid at the rate of 100 old écu each year at Michaelmas, at the castle of Bordeaux , to the constable of Bordeaux. The king discharges her of the other 500 old écus forever, provided that she pays the 100 old écu each year at the term promptly.

Mayensan has shown that Sibilla, Dalhan Sibilia d'Aillan, widow of Mannusson Ramon de Maumusson, kt , bequeathed in her testament, in her last will, the sum of 1,000 old écu to Daribayra Bernat d'Arribère , which sum was assigned to be paid on certain land to be held by him until he had been fully paid, which certain land Johana Mayensan holds at present in right of her inheritance. Now, because Bernat is an enemy and rebel of the king, for certain rebellions, the 1,000 old écu sum has been confiscated by the king. She requests that the king, by his special grace, will pardon her of the sum that pertains to the king by the rebellion, and discharge her land of it.

Grant to the brothers of the order of friars minor of Sanctus Emilianus Saint-Émilion 1 that they can carry their corn, wine, meat, fish, bread, iron, lead, stone, lime and other property bought or received as a gift within the cities, towns and other places, with all vessels for the carriage of the same by land or sea within the lordship of Aquitaine, without paying impositions, tolls, customs or any other dues; and that they can go and return, and reside in their house with their goods and property, and with those in their service, their workers and their other secular servants without the trouble and disturbance of the king's officers or his other subjects, and make their profit from their property, not sold without disturbance of their bodies or goods.

Vygerous Ramon Bigouroux, brother of the order of friars minor of Sanctus Emilianus Saint-Émilion , has show that he and the other brothers of the same order there, have requested that the king will provide security for them as principal founder for their necessary needs for the completion of the building of their church and house within the town of Sanctus Emilianus Saint-Émilion brought through Burdeg' Bordeaux , and the towns of Saint-Émilion and Leybourne Libourne , and through various other places within the lordship of Aquitaine, namely corn, wine, meat, fish, bread, iron, lead, stone, lime, and other property for the work, and other provisions for their victuals. The king wishes to agree to this. The king orders that Ramon and the other brothers be permitted to carry such goods and victuals without paying any imposition, toll, custom or any other due, and that they be able to come and go as above, without any disturbance or harm.

Order to Lescrop' William Scrope, seneschal of Gascony , and his lieutenant, and the king's procurator there, that they are to obtain information on the conduct and acts of the archbishop of Bordeaux and his commissaries and deputies concerning Vagueys Pey de Baquey, monk of the Sancta Crux abbey of Sainte-Croix of Bordeaux , by all ways and means that they consider expedient, and all that they find that they have done in this matter, contrary to the king and his orders, and the laws, fors and customs there, or attempted to be done, are to be duly corrected, punished and put right. Baquey, if he has escaped, is to be recaptured, and is to be punished or banished, just as ought to be done according to the laws, fors and customs there, notwithstanding any process ordained by the archbishop or his commissioners, or others by the archbishop's authority, for the delivery of the same Pey. They are to send a transcript of all that they do in this matter to the king in chancery under the seneschal's seal.

Lately the king has learned by faithful testimony that Pey de Baquey, was charged with the crime of lèse-majesté according to the fors of those parts, and arrested and imprisoned, but was released without purgation, and allowed to go free. The king ordered his proctor there, that if this was so, to recapture him and to commit him to the abbot and vicars of Sainte-Croix of Bordeaux , to be safely and securely held in their prison until the king ordained for his delivery, and silence on the matter was to be enforced. Further he has ordered the archbishop, who has supported Baquey, to do nothing to block his imprisonment and to revoke any action already taken on pain of the taking of his temporalities into the king's hands. The king has been given to understand that though he has received the king’s writ, the archbishop has paid no heed to it, but rather he and his commissaries have brought proceedings against all of those arresting Baquey, passing sentences of excommunication against them, and had him released without punishment or compurgation, even though he had no jurisdiction in the matter, and allowed to leave Aquitaine in contempt of the king and his order. The king does not wish to accept this contempt and wishes to punish it. 1

Order to John de Stratton, landiraux lord of Landiras , constable of Bordeaux , that he cease and desist from all manner of violence, disturbance and harm against the abbot and convent of Sainte-Croix of Bordeaux , or any of the monks there, in their persons, goods, property, possessions, saving their liberties and privileges, commanding his officers to do the same. He should permit the abbot and convent to peacefully and quietly use and enjoy their liberties, customs and privileges, and discharge them and their annual rent paying tenants from the payment of the custom on their wine, just as they and their predecessors enjoyed the same. And if anything has been taken from them or their rent payers for the custom, then restitution is to be made without delay, and anything done by Stratton or anyone on his behalf contrary to the liberties, customs or privileges is to be corrected without delay. They are to be maintained in their privileges.

On behalf of the abbot and convent it has been lamentably complained that Stratton has broken, violated and infringed the liberties and privileges granted to them by the king's progenitors formerly king's of England, from the time of the foundation of the abbey, and in the manner that the abbey of St Peter's, Westminster , used and enjoyed similar liberties and privileges. They state that Stratton broke a door and lock of a certain cellar ( chai ) within their sancturary, and carried away ten tuns of wine, refusing to admit the guarantees which the abbot and convent had offered to the constable. They further complain that Stratton maliciously troubled them contrary to their ancient customs, observances, privileges and liberties, both those granted and confirmed by the king's father, late the prince , and by the king's progenitors, and compelled them to pay the custom on their wine produced from their vineyards, and those annual rent payers to similarly pay the custom, though their liberties from the time of their foundation exempt them from such payment. The abbot and convent have requested a remedy.

Archambaud has requested the confirmation because Johan de Grailly instituted Archambaud, his uncle, in his testament as his nearest kinsman, and he has held a certain Puch Paulyn house called Puy-Paulin with appurtenances in Burdeg' Bordeaux , and all Johan's inheritance, from the death of Johan, and in the same manner that he and his ancestors had held it.

Letters of protection granted, by the king's special grace, to Landirans Pey de Landiras , at his request, he having being taken prisoner in the wars between the king and the French, and is bound to various people for certain sums of money, and also for the debts of his ancestors, which he is not able to pay, the king receiving him, his lands, tenements, vineyards, possessions, property and goods into his protection. The king grants by his further grace respite in the payment of his debts and those of his ancestors, for the term of five years, so that Landiras or his pledges, are not troubled in their persons, possessions, goods or property, by those to whom the debts are owed. The king prohibits his seneschals, judges, mayors, prévôts, échevins, bayles, executors, justices, officers and other ministers in Aquitaine, or their lieutenants, from compelling Landiras or his pledges, to pay the debts within the five year term, and he is to be permitted to enjoy his property, notwithstanding bonds, renunciations and promissories. It is not the king's intention that this applies to debts owed to the king.

Grant of a licence to Shakill John Shakell , that he is able to keep the king's lieges Pons [VI], lord of Castillion in Madonc Castillon-de-Médoc , and Cramont, de Johan d'Aspremont, vicomte of Dort Orthe , 1 of the lordship of Aquitaine, under arrest and in his prison in whatever place in England it pleases him, freely, until he is satisfied for the sum of 23,500 gold Francs in which Florimont, lord of Sparre, la Lesparre , and Pons and Johan are bound to him, Pons and Johan being hostages for Florimont for the payment of the same. The king, wishing to provide greater security for Pons and Johan, for as long as they are hostages in the custody of Shakell, in whatever place in England they reside, and also their servants, and their goods, property and equipment, has received them into his special protection and defence. It is ordered that no injury, harm, damage, violence, arrest, impediment or trouble is to be permitted to be done to them, or either of them as hostage in Shakell's custody, wheresoever they reside in England. If any forfeiture or injury has been inflicted on them, then it to be corrected without delay. 2

Grant, with the assent of the king's council, to Bearne Johan de Béarn, esquire , of Aquitaine, and in consideration of his good service, keeping for a great time the Lourde castle of Lourdes to the king's use, and also the great expenses and labour which he has done in the king's service, of the keeping and governance of both that castle, and the king's territory of Bigorre with the places there that he has newly conquered, and with all profits and emoluments which pertain to the king's progenitors or to the king, which do not at the present answer to the king. The king also grants to Béarn the office of the seneschalcy of Bigorre with the jurisdiction that pertains to the office. Béarn is to hold the same during the king's pleasure without rendering anything to the king, and without asking for anything from the king for it. The king wishes that should he ever wish to remove Béarn from the office, he is first to be given reasonable notice so that he can profit from the things that he has in the castle. 1

Order, by the advice of the king's council, to the seneschal of Aquitaine and the constable of Bordeaux, or their lieutenants, to deliver to Matthew de Gournay , whose homage the king has received, or to his proctor or attorney, the Inter Duo Maria prévôté of Entre-deux-Mers , and the baylie of Créon , with their profits, issues and emoluments, together with the profits since the 7 June 1381. Gournay is to hold the same according to the tenor of the king's letters, notwithstanding the grant of the 23 September, of the same offices to Lebret Bertrucat d'Albret, kt , now deceased.

On 7 June 1381 the king granted the offices to Gournay for his good service, with the profits, revenues and emoluments pertaining to them, holding the same for life, provided that Gournay did homage to the king for them, and that after his death the offices wholly reverted to the king and his heirs. 1

Saint-Symphorien has shown to the king that Edward [of Woodstock], prince of Aquitaine , the king's father, on 8 June 1371, at the request of Saint-Symphorien, granted to him, by his letters patent, that Saint-Symphorien and his heirs should be burgesses of Bordeaux, using and enjoying the privileges, franchises and liberties of it, though Saint-Symphorien was a gentleman. Saint-Symphorien had informed the prince that his ancestors on his mother's side had always been burgesses of Bordeaux, and used the privileges, franchises and liberties that that status brought, and that because his father was of gentle status, he was now unable to enjoy the privileges of being a burgess.

However, the constable and the mayor, jurats and good men, because of certain letters patent of E[dward III], late king of England , the king's grandfather, of 30 September 1375, which granted that no-one of the status of a gentleman, knight or other gentle status should have the status of burgess of Bordeaux, expelled Saint-Symphorien from his burgess status, for which Saint-Symphorien has requested a remedy. The king, having deliberated on the tenor of this from the enrolments of the chancery rolls of his grandfather, with his council, has concluded that the grant of the king's grandfather was not to apply retrospectively to those holding burgess status on 30 September, and wishes justice to be done to Saint-Symphorien.

Grant, with the assent of the king's council, to Maidaillon Guilhem-Ramon de Madaillan, lord of Rosan Rauzan , at his request, and because he has been disinherited of his lands by the king's enemies because of the war, and because of the following matters, of the town of Salva Terra in Basadoys Sauveterre[-de-Guyenne] , with all its profits, commodities, revenues and appurtenances, which are presently in the hands of the king's adversary of France. Madaillan is to hold the same for life from the king and his heirs, for the customary service; provided that the town should remain wholly to the king and his heirs after Madaillan's death, should Madaillan have conquered the same.

The king has been informed that the prince of Wales , late the king's father, for the good service of Madaillan to the late king, the king's grandfather , and to the king's father, gave to Madaillan, before the prince 2 captured the City of Lymoges Limoges , 3 300 l.guien. of rent each year from the profits and revenues of the castle of Bordeaux ; and also 200 l.guien. of rent each year from the Castellyons baylie of Castillonnès ; of which Madaillan has had no payment. Afterwards the king gave to Madaillan the land of Blaignadoys Blagnadois , and the place and land of Blasmont Blasimon , up to the value of 500 l.guien. , Blasimon being in the hands of the lord of Mussidan for the king's adversary of France. Madaillan has not received anything for the above because the constable of Bordeaux did not wish to pay him anything, and from the Blagnadais because Nevill' lord Neville, late the king's lieutenant in Aquitaine , committed the same to the lord of Mussidan when he came back to the king's allegiance, and from Blasimon because the lieutenant committed it to Lenyot Robert Lenyoch, an English esquire .

Grant to Lescrop' William Scrope, seneschal of Aquitaine , of the castle and castellany of Mauléon for life without rendering anything to the king for the same. The grant is made for his good service, and for making satisfaction to the lord of Caupenne for a rent of 600 l. a year, or for making payment of as much of the 12,000 fr. owed to him as they agree between them, receiving from the lord of Caupenne to the king's use, his letters of acquittance, and also certain letters patent for 17,300 old gold écu made for the surrender of the castle and castellany of Mauléon, and of certain letters patent of the king's grandfather. Scrope is to keep the castle safe and secure, and to maintain it in the condition he received it, receiving nothing from the king or his heirs beyond the profits and revenues of the castle and castellany, and making the payments agreed with the lord of Caupenne.

The king has been informed that the lord of Caupenne, who has the custody of the castle and castellany by the grant of E[dward III], late king of England , the king's grandfather, for his life, is willing to surrender the castle and castellany for a rent of 600 l. a year at Bordeaux, and for the payment of 12,000 fr. for 17,300 old gold écu owed to him by the king's grandfather and by his father .

Order to the mayor and consuls of Baion' Bayonne that if they find that John Bowode , merchant of Bristoll Bristol , owes the sum of 100 l.st. to Beneyt Walter Bennett , then they are to arrest him and his goods and merchandise in Baion' Bayonne without delay, and keep them safely under arrest until Bennett, or his attorney, have been fully satisfied for the money, with the reasonable damages and expenses which he has sustained.

Bennett has complained that lately he paid 600 Francs of gold of his to Bowode in Bayonne, by way of an exchange for 100 l.st. to be paid to him at London from Bowode 's money there. Though Bowode promised to pay the money to Bennett at London , and was firmly bound to do this without fraud at Bayonne, he, cunningly plotting to defraud Bennett by his letters of obstruction to a certain Robert Gonpey of London , who does not have any money of Bowode 's in his possession, and refused to pay the money to Bennett, to Bennett's great impoverishment, for which he has requested a remedy. The king wants what is just to be done concerning this deception.

Order to the constable of Bordeaux to permit Lumbard Thomas Lombard to hold the office of controller of the castle of Bordeaux in the manner that Master Bernat Brocas, clerk , had and exercised it, for the term of his life, without any impediment. He is to allow Lombard such wages and fees as Brocas had in his lifetime, and is to be intendant on and answer Lombard in all things that pertain to his office. The king will give the constable due allowance in his account for what he pays to Lombard.

On 19 April 1381, the king, by his letters patent, granted the office to Lombard for as long as he conducted himself well in that office; and by subsequent letters enhanced the grant by making it for life, for Lombard's good service, and wishing to provide him with greater security in the office. 1

Grant, by the king's special grace, to Lumbard Thomas Lombard, controller of the castle of Bordeaux , of the burdonage of pilgrims in Bordeaux . 2 He is to have the same with its profits and emoluments for as long as he holds the office of controller; rendering to the king by the constable of Bordeaux, as much rent as anyone else is willing to render for that office. The king wishes that from that rent, each year that he holds the office of controller, that he should take what he is paid for his wages in the office of controller as a deduction. In case that the rent is not sufficient to pay the wages, then the king wishes that he should take the residue of the wages in the manner that he did before he was granted the burdonage.

In the discussions it was agreed that the duke should have letters to the king's officers in Bordeaux, that they should permit the duke to have his 'brefs', just as the is more fully contained in the letters patent of the duke of the discussions. 2

The king has accepted, approved, ratified and confirmed the letters at the request of Guilhem, son and heir of Eyrin [Aubert] , making the same reservations. 5

Order to permit Florimont, Sparre, la lord of Lesparre , to bring after Christmas up to 10,000 tuns of wine over the period of ten years, from the alta patria Haut-Pays by river as far as Bordeaux, and then to England in ships or other vessels, to make his profit, without any trouble or disturbance, according to the tenor of the king's letters. Proviso that he is not to bring wine to Bordeaux before Christmas, and that he is to pay the tenth tun and other dues and customs on half of the wine, to the constable of Bordeaux, for the king's use; and also saving the franchises and liberties of the city of Bordeaux, and other cities and good towns of Aquitaine, and the citizens and burgesses of them.

The king granted, by his letters patent, to Florimont that he could bring the wine over that period with the ullage ( oillagium ) pertaining to them, from the Haut-Pays , which is in the hands of the king's enemies, by the rivers Gerone Garonne and Durdoigne Dordogne , to Burdegal' Bordeaux or Leybourne Libourne , and from there to England, in ships or other vessels, for his profit, but only after Christmas in each year. From one half of the wine he was to pay the tenth tun and other dues and customs to the constable of Bordeaux for the king's use; and on the other half of the wine he was to pay only the ancient customs. Saving only the liberties and privileges as above, and also provided that Florimont only brings his own wine, or that which he has bought with his own money, and not other wine under cover of the grant. 1
