Physical condition of the roll

The roll consists of seventeen membranes. There are entries on all of the face sides, but on none of the dorses. The roll is generally in good condition.

C 61/132, 21 & 22 Henry VI (1442-1444)

Introduction.

This roll is mainly concerned by the consequences of the 'Journée de Tartas', the successful military expedition led by Charles VII of France in Gascony from June 1442. The majority of the lords of the Landes and many places submitted to the king of France. In October 1442, the king gave power to the archbishop of Bordeaux, the seneschal of Aquitaine, the mayor of Bayonne and the lord of Gramont to pardon persons of the duchy who had adhered to the king of France when he came there. 1

The lord of Saint-Pée Johan d'Amézqueta and his son Augerot de Saint-Pée who had participated to the English recovery of Dax and Hastingues which had been taken by Charles VII in July 1442 were granted for their lifetimes the prévôté of Dax and the baylie, toll and pasture of Hastingues. 2 The leading light in the recovery of Dax, Per-Arnaut de Saint-Cricq, already appointed captain of this city, was now appointed prévôt of Dax. 3 In 1444, he obtained a house situated near Dax which had been seized by the king from a Gascon who had rallied to the king of France, a house which had previously been granted in 1443 to Pey d’Anglade, ordinary clerk of the city of Bayonne. 4 Another Gascon (Johan de Maucamp the younger) who had been involved in the defence of Dax against the French received the office of clerk of the writing office of the royal prévôté of the city of Dax. 5 Pey de Montferrand, Soudic de la Trau, tried with success in July 1443 to get back the portion of the lordship of Breuil (in Médoc) allocated to his sister Margarida who had married the lord of Gramont, as this major lord had rallied to the king of France in April of the same year. 6

Others received the seized goods of Gascons who submitted to Charles VII. Some possessions situated in Ousse (Northern Landes) which had been granted to the Englishman James Harsage, who had committed an act of betrayal in favour of the king of France, were given to the Gascon Antoni Villate. The lord Francès de Montferrand received a house in the same place and some goods in the Pays de Born. 7 Johan de Foix, son of the captal de Buch Gaston de Foix, was given in 1443 all the possessions of Bérart de Lamothe, lord of Roquetaillade and co-lord of Langon, which had been previously given to another important Gascon lord of the English party Galhart III de Durfort, lord of Duras and Blanquefort. 8 George Swillington, the former captain of the castle of La Réole who had defended it in vain against Charles VII in 1442, received the goods of a kinsman of Bérart situated in the same region. 9 Similarly, he was granted several possessions of the lord of Gramont. 10 The office of captain of Blaignac, occupied by the lord of Gramont, was entrusted to Grimon de Bordeaux. 11 The problem was now to take actual possession of them. It is likely that a good part of these grants were never implemented. At least one grant was actualised: the impressive castle of Biron (Southern Périgord) had been conquered by the mayor of Bordeaux Gadifer Shorthose from its two lords who had submitted to the French, and its possession was confirmed to him in June 1444. 12

The fidelity of Arnaut de Bordeaux and his son Grimon, burgesses of Bordeaux, was rewarded and reinforced by their being raised to the rank of noble in 1444. 13

In 1443, the community of Bordeaux received for 24 years the wine right of issac and the right of market of Bordeaux in order to repair the city wall against the French. 14 It also obtained in perpetuity the ownership of the town of Saint-Macaire and Sainte-Croix-du-Mont (1444), two places the men of the community already occupied, to defend them against the French at the request of the king’s council at Bordeaux. 15 But the grant of Saint-Croix-du-Mont was in contradiction to a previous grant to two esquires of the earl of Huntingdon’s retinue which had been confirmed the same year. 16 .

Some ecclesiastic matters are also copied in this roll. The appointment of an English monk to the head of the abbey of Saint-Croix of Bordeaux was cancelled as the pope had acknowledged that the bishop of Bazas held its administration by right of commendation. 17 A monk of Saint-Sever was appointed by the king as prior of Saint-Martin du Mont Judaïque (Bordeaux). 18 Apparently, he was the second successor of the ecclesiastic appointed there by the king in 1439. 19

Judicial matters are also to be found on this roll. Henry VI ordered justice to be done in the trial concerning Guilhotin Andron, lord of Lansac, and the king’s procurator fiscal (the king’s proctor) in the duchy of Aquitaine, about the inheritance of Amaniu Béguey which Andron claimed to be his as Beguey’s closest kinsman. 20 The suit concerning Gaston de Falces and Guilhem de Boisset concluded to the benefit of the former as Falces obtained a confirmation of the grant made to his father in 1434. 21 The influential lawyer Estèbe de Brosses was appointed again as king’s procurator fiscal in the duchy of Aquitaine in 1443. 22 The Italian canon of Bordeaux Giovanni Cerretani was appointed as one of the judges of the superior court of Aquitaine. 23 Particularly of interest is the pardon granted to several burgesses and inhabitants of Bayonne after one of the many fights with the Basque nobles of Labourd led by the Lehet family. On this occasion one man had been killed. 24 The roll also includes the appointment in December 1442 of Sir William Bonneville as seneschal, who mustered to cross in January 1443, and who remained in office until 1450. 25

Grant in perpetuity to d'en Perarnaud Guilhem-Ramon d'en Perarnaud, clerk , public notary , and burgess of Bordeaux , and his heirs issued from him, to have a house with all its appurtenances, situated in the parish of Saint-Pierre of Bordeaux at the Umbreria Ombrière , between the house of Delansaco Johan de Lansac on one hand, and the house of Vidau Bertholomiu Bidau on the other, and this house extends between a public street at its front, to the bridge of Saint-Jean at its back, 1 which house came into the king's hands by the rebellion of Corneli Johan Corneille who died as a rebel, 2 with all the movable and immovable goods which were owned by the late Pey de Reynaud , reserving the right of this fief's lord or those who have rights about them. Huntingdon orders all the king's subjects to deliver this house to Guilhem-Ramon and permit to enjoy it without impediment, and Huntingdon imposes perpetual silence about it on all the king's officers and the procurator fiscal. As by his letters patent Huntingdon had granted Corneille's house in perpetuity to Huyssard Thomas Hussard, esquire , who retruned these letters in Huntingdon's chancery for cancellation in order that this house be granted to Guilhem-Ramon

Letters of protection granted, at his supplication, to Monferant Johan [de] Montferrand, esquire , originating from the duchy of Aquitaine, and his servants John du Boys and William Flory , their men, lands, revenues, all their possessions, and their movable and immovable goods. The king does not want that any prosecution because of any debts, and any arrest or damage, or detention in prison, or arrest of their goods and chattels be done against them during the period of this protection. The king orders to all his officers to let them be free of any prosecutions or impediments during the period of this protection. Two years and half ago Johan de Montferrand went in England at the service of Humphrey [of Lancaster], duke of Gloucester , 1 and he remained at this latter's service at his great expenses, and as he wanted to remain in this service and maintain his estate as well as that of his servants, he became indebted each year to various merchants of the city of London and is not able to repay them at present because Montferrand cannot enjoy his revenues, lands, tenements and possessions because of the war the king's adversary of France 2 does and because he has lost a large number of these revenues.

Order to Ville Bidau de Bielle, esquire , originating from the city of Bayonne , not to interfere in the lordships of Maremne , Gosse and Seignanx , under pretext of the previous grant by letters patent. The king had granted him at his pleasure by his letters patent on 1 May 1444, 2 at his request, because of his good service to Henry V and the current king in the wars in the kingdom of France and the duchy of Aquitaine, particularly during the coming of the king's adversary of France in Gascony, 3 where he suffered many damages and losses without any reward, of the lordships of Maremne, Gosse and Seignanx with their revenues and rights, any letters patent of grant to John Tiptoft notwithstanding. With the proviso that these lordships have not been granted before to some others, as the king's predecessors have granted various lordships in the duchy of Aquitaine to Gourney Matthew Gournay and then to the late John Tiptoft for the defence of these regions and their fortification. Gournay has well governed these places, but at the end of Tiptoft's life, several lordships went in French hands by lack of good keepership and government, and the others staying in the king's obedience were devastated and became impoverished, so that the king has feared they would be lost to the king's enemies by lack of keepership. 4

Because of the theft on Ispann' Per-Johan d'Espagne of 42 gold crowns on a royal road situated at one mile of Bayonne , in the 17th regnal year [of Henry VI] 4 made by Haitse Augerot de Haitze 5 and his accomplices, which money was never returned, many dissents and insults happened between Lesbay, Bérastéguy, Sabarots, l'Escacho, Guinarthe, Ainhoa, Bilbao and Urthaburu on one hand, and Augerot de Haitze and his accomplices on the other, so that Augerot de Haitze and his brother Pey de Haitze often came to Bayonne in order to kill Jacmes de Lesbay , and finally on 1 January 1440, Martin [de Haitze] , brother of Augerot de Haitze, secretly went in Bayonne around noon with a company of eleven men and besieged Jacmes de Lesbay's house, but this latter was away, and later on this day, Lesbay came back with his company made of Bérastéguy, Sabarots, l'Escacho, Guinarthe, Ainhoa, Bilbao and Urthaburu, and one Haitse Johan de Haitze , a member of Martin de Haitze's company, made an insolent gesture against Jacmes de Lesbay who pursued him carrying a sword up to the house of a goldsmith, and when Lesbay returned to his house he learned that some people of his company had killed Martin de Haitze. Because of this death, each one of Lesbay, Bérastéguy, Sabarots, l'Escacho, Guinarthe, Ainhoa, Bilbao and Urthaburu were quit with a fine of 36 crowns according to the laws and statute of the city of Bayonne, but as Martin de Haitze is from com' de Bort Labourd , they do not dare to travel in the king's lordships if they do not obtain the king's pardon.

Inspeximus and confirmation of the letters patent of John [Holland], earl of Huntingdon , king's lieutenant in Guyenne , admiral of England, Ireland and Guyenne:

Grant in perpetuity to Wyschard Thomas Wichard and Vill' John Bill , esquires of Huntingdon's household, and their heirs, of the castle, house and inheritance of Sainte Croiz du Mont Sainte-Croix-du-Mont with the Taste house of Tastes 3 situated in the jurisdiction of Sainte Makaire Saint-Macaire with its appurtenances, which was held by the late Delebret Johan d'Albret , allowing them to levy and to receive without impediment all the rights, duties, rents and revenues coming from them. Huntingdon orders the seneschal of Guyenne, the constable of Bordeaux, the judge of Gascony , and all the other king's officers of the duchy of Guyenne to deliver without delay Sainte-Croix-du-Mont and this house to Wichard and Bill and their proctors, and to permit them to enjoy them, any other grant made before and after notwithstanding.
