C 61/72 33 Edward III (1359-60)

Introduction.

This was a period of ongoing Anglo-French negotiations and subsequently of preparations for a major campaign in the north led by the king, who landed at Calais on 28 October 1359. But this roll reflects rather local matters within the duchy which was officially in a state of truce. A number of entries on the roll concern the long-running judicial conflict between the men of the Comtau and the lord of Ornon, 1 indicating that the king was trying to terminate this case. 2 In this context, we find the story of the gruesome murder of one of the king’s serjeants-at-arms in the ‘lordship of Ornon’ by men of the lord of Ornon. 3 Consequently, the latter was ordered under pain of forfeiture to stop committing damage and violence against the king’s serjeants-at-arms. 4

The other major local conflict was between the city of Bordeaux and the town of La Réole which was essentially about wine trade and taxes levied upon it. There is a long description of the exactions and damaging measures made by the men of Bordeaux against those of La Réole. The king ordered the mayor and jurats of Bordeaux to revoke these measures. 5 John de Chiverston, seneschal of Gascony, and Master John de Streatley, constable of Bordeaux, had to pacify the tense relationships between Bordeaux and La Réole. 6 The king ordered these officials to implement the king’s will in this dispute. 7 Furthermore, the seneschal and constable were given full power by the king to receive all persons into the king’s obedience in the duchy of Aquitaine. 8

The king ordered the constable of Bordeaux to make enquiry and to return into his hands the baylies and offices which had been granted in the duchy without the king’s licence. 9 The seneschal of Gascony and the constable of Bordeaux had from now on to make enquiries together, otherwise such enquiries would be invalid. 10 The controller of Bordeaux was ordered to be present in person at Westminster when John de Streatley, constable of Bordeaux, rendered his account. 11 The king ordered that no one could exercise the office of notary in the duchy unless he originated from there. Those notaries who had been created by the pope generally came from French-held areas and their fidelity towards the king of England was dubious. 12 Such measures show that Edward III intended to reassert his control over the duchy and its administration.

Another item worth mentioning is the appeal of members of the Breillan family and others against the canons of the chapter Saint-André of Bordeaux in order to bring to an end their servile status. 13 Letters of protection were granted to them. 14

We also find an agreement with the cardinal Talleyrand de Périgord which let him have Lavardac, Feugarolles and Cauderoue inherited from his aunt Johana de Périgord, through Bertran I de Montferrand, until peace was signed with the king of France. 15

Sums of money were still due to the vicomte of Orthe for the ransom of the count of Joigny whom he had made prisoner at the battle of Poitiers (19 September 1356). 16 A former vicomte of Orthe had pledged the land of Cauneille in order to buy horses to serve the king, but this land has been seized by the king. The current vicomte of Orthe owed part of this money to the king, so he had requested the king to relinquish this sum. 17

Some entries concern the journey back to Gascony from England of Bérart II d’Albret. 18 He obtained from the king a delay for the payment of homage for his castles and lands, 19 probably until the result of the appeal of the Caupenne family against him on the Tiran succession. 20

Aymar d’Ussel, a noble from Gourdon in Quercy who was officially in the English party, had captured Arnal de Pélegri, his family, members of his household and his house. The king ordered to arrest Ussel, and Pélegri had to be defended against him. Pélegri had two brothers who were clerks and who held important positions in England. 21

There is an entry on illegal wine trading which contravened the king’s ordinance issued in 1353. 22 The canon of Saint-André of Bordeaux attempted to restrain levy of the issac right on wine for the king by exploiting letters of the official of Bordeaux. 23

We find a curious confirmation of a grant by Alfonso VIII, king of Castile (early 13th century), who then claimed to be ‘lord of Gascony’, granting a house to the abbey of Divielle (in the Landes). 24

There is confirmation of a grant made to a Bernat du Trouilh by the captal de Buch and the lord of Montferrand, then captain of Montréal (in the diocese of Condom), to have the monopoly over the ovens of the town where the town's bread was baked. 25

Arnaut de Mente complained that he held by hereditary right the office of town crier of the city of Bayonne, and that he had been unjustly removed from it. 26

William de Wakefield, citizen of Bordeaux, had been made prisoner several times by the French during the time of truce and had not received any compensation, so he requested the king to have letters of marque against the subjects of the king of France. 27

22 February 1359 . Westm' Westminster . For Walter de Frampton .

Order to the seneschal of Gascony and the constable of Bordeaux, and their lieutenants, that if Frompton' Walter de Frampton, Bristoll' collector of customs in the port of Bristol , finds sufficient security to stand to right in the king's court of Gascony , and to receive justice there, then they are to release his cloth and merchandise, and deliver it to him to sell. On behalf of Frampton it was shown that he owes a great sum to the king from the issues of the customs, and he had sent cloth and other merchandise to Gascony to sell, and to buy wine with the proceeds to bring back to England , and by this means to satisfy the king for the debt. The cloth and merchandise were arrested at Burdeg' Bordeaux , and he does not have anything to satisfy the king for his debt, and the cloth is deteriorating. Frampton requests a remedy, and the king does not want the debt to remain unpaid by the arrest. 1

The king orders the seneschal of Gascony to deliver this castle and places according to this. The cardinal Talleyrand [de Périgord] has supplicated the king, as his late paternal aunt Petragor' Johana de Périgord 2 decided in her will that her places and people of Laverdaco, de Lavardac , Feugaroliis, de Feugarolles and Caudaroue Cauderoue had to remain in the king's obedience as long as the war lasts between the king and his adversary of France, and she named in the same will Talleyrand as her universal heir and heir of these places, as appears in her will shown to the king's chancery, to deliver to him these castle and places. 3

A fourth part of the place of Civrac came to Hélias de Pommiers by inheritance after the death of the lord of Pommiers , his father, 1 which part, Tetbaut, and a certain portion which Pey had were committed to them for safe keeping by the lord of Pommiers for the king's use, and for the security of the king's country there, and which they then rendered to the king's adversary. The place was subsequently reconquered by loyal subjects of the king, but was totally devastated. Hélias has now begun to repair the same by virtue of a grant of the same to him by Chyverston' John de Chiverston , seneschal of Gascony, and he has requested that the king will indemnify him for the costs that he will be put to in this should he be removed from the place by the peace treaty, and the king wishes to agree to this. 2

The king has granted to Pomeriis, de Hélias de Pommiers, Arbenatio, de lord of Arbanats kt , as the king has granted him for life by his letters patent in reward of his good service to the king 100 m. of silver by year to be received in suitable places which are not allocated. So the duke allocates to Hélias de Pommiers 100 m. of silver by the tenor of these presents on the revenues of the common tax ( commune et captenh ) which has been customary levied and received in the king's name in the seneschalcies of Périgord , Quercy and Limousin , to be received by Pommiers or his proctor, 1 without prejudicing the grant of this common tax to Pelagrua Ramon de Pellegrue, kt , in the place of Sancto Asterio, de Saint-Astier . The duke orders to the seneschal of Gascony, the constable of Bordeaux and the Brageriacus judge of the town of Bergerac to deliver this common tax to Hélias de Pommiers or his proctor, maintain and defend him in its possession and permit him to enjoy its profits and emoluments. Furthermore, the king orders by these presents the seneschal of Gascony and the constable of Bordeaux not to interfere with the allocation granted to Ramon de Pellegrue on this common tax, and allocate to Pommiers the value of this allocation elsewhere in a suitable place.

It was a customary public tax paid per head in the seneschalcy of Périgord since probably the 12th century. For this tax, see the accounts of Hélias Robert, treasurer of Périgord (1303-05) in TNA, E 101/159/12 and Archives Départementales de la Gironde, 1 J 6 (1 to 3).

And it is ordered to the seneschal of Gascony and the constable of Bordeaux to permit Hélias de Pommiers to receive this common tax according to the king's letters.

24 March 1359 . Westm' Westminster . Concerning the ending of an appeal for the inhabitants of the Comtau .

Order to the constable of Bordeaux or his lieutenant, Pomeriis, de Hélias de Pommiers and Brother Arnaut[-Guiraut] de Rions, prior of the hospital Saint-Jacques of Bordeaux , 1 that if anything was done after and against the last appeal [mentioned below], they have to return it to its previous status. They have to swiftly examine, hear and decide in such way that the inhabitants of the Comtau in the district of Camparian will be protected from the injuries and violence which would be made by the lord of Ornon during this appeal, and they have to protect and maintain their customary liberties and customs, and compel persons involved in this trial to pay the due expenses. The king has ordered to all his officers in the duchy of Aquitaine to obey and attend them on this matter. Formerly, Furti Ramon Fort , Guilhem Ayam , Saubiazo, de Guilhem-Arnaut de Saubias , Cantilupo, de Amaniu de Canteloup and Cantilupo, de Arnaut de Canteloup for them and as proctors of some other inhabitants of the Comtau ( Comptali ) in the Campariano, de district of Camparian in the diocese of Bordeaux have appeared before Elia Hélias, Sancti Salvatoris, Blavia abbot of Saint-Sauveur of Blaye and Master Petrus Peire de la Colre, professor in laws, official of Bordeaux , 2 and Master Podio, de Guiraut Dupuch, then juge-mage of the court of Gascony , because of the appeal made to the king as king of France by Guilhem-Bernat [d'Ornon], Dornon lord of Ornon against the inhabitants of the Comtau and their proctors; this abbot, la Colre and Dupuch having been appointed by the king to hear and terminate this case. 3 But these latter judges have been suspected for legitimate reasons and has been challenged ( recusatis ) by these inhabitants and their proctors who appealed to the king as king of France, as more fully appears in a public instrument, so these inhabitants and their proctors supplicate the king to terminate this appeal.

Arnaut-Guiraut de Rions, was mentioned in some documents of the Archives Départementales de la Gironde (série H, Jésuites) as prior of the hospital Saint-Jacques of Bordeaux from 12 February 1359 to 6 March 1369.

The La Colre family was a burgess family of Périgueux mentioned in the accounts of the town of Périgueux. There was even a 'house of La Colre' ( ostal de La Colre ) which was the main seat of this family at Périgueux. Peire de la Colre was the official (judge) of the court of the archbishop of Bordeaux since c.1355 and canon of the church of Bordeaux. He was briefly before his death bishop of Dax in 1359. 25 March 1359 . Westm' Westminster . For Johan de Garens .

The king orders the lord of Ornon to stop under pain of forfeiture making any threats against Johan de Garens, king's general serjeant in Gascony, and his companions, but to protect and defend them against their enemies. And if anything wrong happens to them, he has to give justice himself or through a proctor without any stratagem ( dissimulacio ) and punish them, his punishment having to put fear to others wanting to do the same against the king. Gazenz Johan de Garens, king's general serjeant in Gascony , has complained to the king that, as Vassoun Arnaut-Amaniu de Bazon , Moryn Ramon Morin and Arnautoun, le Vacher Arnauton Baquey , felons and servants of the Dornoun lord of Ornon have killed Petrus, Curvyn Peter de Turvin, king's serjeant , at Caneran Canéjan which is situated in the lordship of Ornon , extracted his tongue from his jaws, cooked it and fed their greyhounds with it, to the king's great prejudice and contempt, the king's judge of criminal cases in the duchy of Aquitaine brought them to the castle of Bordeaux to judge them about this murder and kept them there, but Ramon Morin escaped from the prison of this castle, and the lord of Ornon, as well as the felons' kinsmen and friends threatened to kill Johan de Garens and the other serjeants who were present at the arrest of these felons, so Garens has requested the king to give them security.

23 March 1359 . Westm' Westminster . For Johan de Garens and others .

Garenz Johan de Garens , Gombaud, la Vat Gombaut de Labat , Furt Ramon Fort , Galhart Bernard , Guilhem Lamberd and Foilladitz Guilhem Filhadis , and some other king's general serjeants [in the duchy of Aquitaine] have complained to the king that Guilhem-Bernat [d'Ornon], Dornon lord of Ornon , and his men and officers have verbally threatened the king's serjeants who made their office and have impeded and disrupted by force the making of the king's business, to the king's contempt, the great damage of these serjeants and against their safeguard, as well as the obvious postponement of the king's business, so these serjeants request the king to bring them a remedy about it.

The Ostabaret (in Gascon Ostabares ) was a small province of the Ultra Puertos , the region of the kingdom of Navarre situated north of the Pyrenées known from 1577 as 'Basse-Navarre'. This small lordship was called as Sault (in Gascon Saut and in Basque Zaldu ) of Ostabaret in order to distinguish it from the lordhip of Sault being situated at Hasparren and the lordship of Sault situated south of the Landes (now Sault-de-Navailles).

1 May 1359 . Westm' Westminster . Ordinance for the freightage of ships . 1

Order to the constable of Bordeaux to check all the ships coming to the duchy of Aquitaine and seize for forfeiture in the king's hands all the ships that load freight there in another way of what is permitted, and keep them to the king's use. Several persons have informed the king that many damages and prejudices were made and will be made to the king, his people and the merchants of the kingdom of England, because some ships come to the duchy of Aquitaine to buy wines for England and elsewhere before the [official date], if the king does not provide a swift remedy about it; so the king has ordered with the assent of his council that no English ship could come to the duchy of Aquitaine at the port 2 to buy wines in advance, dropping anchor in that port, and loading this ship during the time of a tide, in which port merchants sell wines for the ships there in order to load them on these ships by way of forestall 3 and any other bad invention; and in case a ship is coming to buy wines in the duchy in an unallowed way, then it has to be forfeited to the king with its freight. The king had ordered to all his officers of the kingdom of England to publicly proclaim this ordinance in the places they will find suitable and have it applied. 4

This date is written on the roll as 28 June 1252 (Spanish era) which gives 28 June 1214 (our era). Obviously, this date is an error of a scribe, as well as the date of 28 June 1213 suggested by Nicholas Vincent, as the king of Castile Alfonso VIII claimed to be lord of Gascony only between 1204 and 1206, and as he has invaded Gascony in 1205-6. The counts of Poitou were dukes of Aquitaine and dominated Gascony since 1062.
4.
It is very surprising to note that a charter issued by Alfonso VIII of Castile as 'lord of Gascony' has been confirmed by Edward III, as the former was never accepted as the legitimate lord of Gascony by his ancestors, its legitimate lord being then King John (1199-1216).

10 July 1359 . Westm' Westminster . For the men of La Réole.

Order to the mayor and jurats of the city of Bordeaux to revoke without delay the ordinances and banishments they have made against some men of La Réole, to stop requesting them the 2 s.t. by tun and the 6 d. by pound on wines and other of their goods, to permit them to enjoy without any new impediment their liberties and franchises, any ordinance, banishment made by them at Bordeaux being revoked and nullified by these presents, and if they have levied these 2 s.t. by tun and the 6 d. by pound from 29 September 1358, they have to return them without delay, so that La Réole does not risk to be lost because of them. The Reula jurats and citizens of the town of La Réole have complained to the king that they have the right from time immemorial to bring their wines and goods to the city of Bordeaux without paying any toll or custom on them, but the mayor, jurats and the community of the city of Bordeaux , under the pretext of some letters granted by the king, have demanded and extorted from the former 2 s.t. for each tun of wine or 6 d. by pound ( per libra ) on all the goods they bring to Bordeaux from 29 September 1358. The king had granted to the jurats and citizens of La Réole to be forever exempted for these payments from 29 September 1358, 1 and permit them to enjoy the liberties and franchises they enjoyed before, and the king ordered them to observe his decision, but the king has learned they did not permit the jurats and citizens of La Réole to enjoy their liberties and franchises at Bordeaux, but they have publicly proclaimed at Bordeaux without consulting the king that no inhabitant of Bordeaux receive or accommodate any men or women of La Réole, nor sell to them bread, wine or other victual, under pain of banishment outside the city of Bordeaux for one year; and that none of their wines can be brought in Bordelais cellars or be received in Bordelais houses under pain of destruction of these houses and cellars; that no boatman can bring on their boats the wines of these jurats and citizens of La Réole up to Bordeaux under pain to have a hand cut off; and that all the men of La Réole who come to Bordeaux had to be killed, and their children and families of the same town of La Réole as well as the money changers and merchants of La Réole had to be expelled from Bordeaux; to the king's contempt and the great damage of the jurats and citizens of La Réole who have requested the king to bring a remedy about it, as La Réole is in great danger to be lost. 2 because of their policy. 3

16 July 1359 . Westm' Westminster . For the men of Libourne.

Order to the mayor, jurats and community of the city of Bordeaux to stop demanding the tax of 2 s.t. on each tun of wine brought by the burgesses and inhabitants of the town of Libourne and others which have their wines growing on their vineyards situated below Saint-Macaire, 1 against the tenor of the king's grant done to them, and not permit them to be molested or damaged. And if anything has been unjustly taken to them, then they have to return it to them without delay, so that no complaint reaches the king again about it. Formerly, the king granted to the mayor, jurats and community of the city of Bordeaux to have the right to levy on all persons, good or wine coming from the town of Sanctus Macharius Saint-Macaire to their city of Bordeaux to be sold, 2 s.t.parv. for each tun ( dolium ) and on other goods according to this rate, in order to help them for the repair of their city's walls and turrets, as appears in the king's letters patent made about it, and yet the Libornia burgesses and inhabitants of the town of Libourne have complained that despite the fact that Libourne is situated below Saint-Macaire towards Bordeaux by ten miles or more, they compel them to pay this tax to their great damage and against theirs liberties, franchises and customs. 2

16 July 1359 . Westm' Westminster . Concerning the grant of [letters of] marque.

Order to the seneschal of Gascony and the constable of Bordeaux, that having checked the various public instruments and other evidences owned by William de Wakefield, if they notice that this latter has been made prisoner and ransomed during the truces, and that the [French] keepers of the truces refused to do him justice about that, then they have to give Wakefield [letters of] marque ( marca ) on the goods of all the subjects of the king's adversary of France 1 which happen to be in the duchy of Aquitaine by time of peace or truce, according to the local fors and customs. Wakefeld William de Wakefield, king's valet , Burdeg' citizen of the city of Bordeaux , has complained to the king, as he has been made prisoner several times at sea by the people of the king's adversary of France at the time of the truces made between the king and this adversary, he has been closely confined in prison, and he has paid several ransoms before being released, and he has been stripped of his wines and other goods up to the value of 5,000 l. , on which Wakefield has not obtained satisfaction; and although the king's keepers of the truces in the duchy of Brittany have requested several times compensation by their various letters to their counterparts of the king's adversary of France, as well as the latter's keepers of the truces in France, these keepers did not do anything about it, as more fully appears in some public instruments and other evidences owned by Wakefield, so the latter supplicates the king to provide him with a suitable remedy.

18 July 1359 . Westm' Westminster . For the goldsmiths of Bordeaux.

Order to the seneschal of Gascony and the constable of Bordeaux that if the two men elected by the goldsmiths of Bordeaux are not performing well their work of inspection of the quality of the work of the goldsmiths, then two other sufficient and suitable men have to be elected by them to do this work. And if any fault has been done, it has to be corrected and the transgressors have to be punished. Formerly, at the prosecution of the goldsmiths of the city of Bordeaux the king granted to them, among other things, that they could elect two worthy men ( probi homines ) of their profession to correct the faults found in this profession, and order the necessary measures, and order punishment to the opponents to these measures with the help of the mayor and jurats of Bordeaux when necessary. 1 But it has been underlined before the king that if the two men elected turned a blind eye to the faults of the transgressors of their profession, the latter will remain unpunished to the great prejudice and damage of this profession and the people.

4 August 1359 . Westm' Westminster . Concerning the release of arrested ships.

Order to Brian Guy de Bryan, admiral of the Western Fleet , or his lieutenant in the Sandwico, de port of Sandwich , and the mayor and baillifs of the town of Sandwich , to free without delay the two ships [mentioned below], if they have been arrested, as well as their masters, mariners and all the equipment of these ships, and permit them to go without impediment to the port of Plumuth Plymouth where the king's magnates and faithful men are waiting for them, any arrest made on them notwithstanding. The king had learned that two ships of Bayonne , one ship called the Sanctus Petrus also known as la Faryner 1 and another ship called the Sanctus Johannes of Bayonne, which have been formerly allocated by the king to la Bret, de Bérart [II] d'Albret and certain other king's magnates and faithful men of Gascony who are sent there in the king's service for their voyage there, have been arrested recently at the port of Sandwich, for which reason their journey towards Gascony has been greatly delayed.

Order to the seneschal of Gascony and the constable of Bordeaux, that having seen the letters of Robert de Herle or his lieutenant in the duchy of Brittany proving that the lordships and lands of his inheritance has been delivered to Olivier [V] de Clisson, and if it happens by legitimate information that this latter's mother Jeanne de Belleville and her predecessors [in the lordship of Clisson] 1 had the brefs ( brevia ) and custom on the ships at Bordeaux by hereditary right and that Olivier, as son and heir of Jeanne de Belleville, should have it, then they should permit him to receive them without any impediment. Formerly the king has granted to Bella Villa et de Clizon, de Jeanne de Belleville and Clisson , because of her good service towards him, to have her brefs and the custom on ships at Bordeaux that her and her predecessors [in the lordship of Clisson] used to have before, and the king has ordered the then seneschal of Gascony and the then constable of Bordeaux to permit her and her officers to levy her brefs and custom at Bordeaux, as more fully appear in the king's letters patent. 2 And her son and heir Olivier [V de Clisson], Clizon lord of Clisson , 3 has supplicated the king, as his mother died, to permit him to have these brefs and customs.
