C 61/64 26 Edward III (1352-53)

Introduction.

Ralph, Lord Stafford (having served as seneschal between 1345 and 1347) was elevated to an earldom and appointed royal lieutenant on 6 March 1352, although his crossing with troops was delayed until late June because of a lack of shipping. The roll contains protections for men crossing in his company. His late arrival prompted the French to try to take the initiative with an advance down the Garonne valley, to attack English garrisons in the southern Agenais. Stafford arrived in Bordeaux on 21 July and immediately moved, with his expeditionary troops and Gascon soldiers gathered in Bordeaux, towards Agen. A conflict outside the walls led to the capture of Jean de Boucicaut who was taken to England. But during Stafford's retreat towards Bordeaux, the French launched a counter-attack in the Dordogne. However, the earl gained great advantage by capturing Blaye, which the French had taken in 1339. Stafford returned to England before the end of the year. 1

As in many other rolls, there are several entries on the roll whereby the king allows people, English and Gascon alike, to purchase and transport wheat to resupply the English-held parts of the duchy of Aquitaine which were more or less cut off from their hinterland which was controlled by the French. 2

Entries show us that some Gascon lords had been in England (Amaniu de Pommiers and Arnaut III de Durfort), both for their own business with the king and to take back strategic decisions for the pursual of war in Aquitaine. Significantly, they were allowed to use English ships to return home. 3 Johan de Pommiers, a kinsman of Amaniu de Pommiers, prior of Sele in Sussex, probably returned to Gascony with Pommiers. 4 In addition, Master Guiraut Dupuch, a significant loyal official in the Anglo-Gascon administration, was granted the expectation of an ecclesiastical benefice in England. 5

Edward III’s policy in the duchy tended towards pardoning influential people for their rallying to the French Valois party, and/or rewarding members of the same family who wanted to remain or return to his obedience. Hence, the possessions of the lord of Castillon Pons IV the elder situated in the Médoc sub-province had been seized into the king’s hands because he had joined the French party, but after his death the king returned them to his widow and his son Pons V the younger who were supposed to have remained on the English side. 6 It was clearly essential for Edward III’s government to obtain the support of such an influential family whose possessions were so close to Bordeaux. Similarly the king pardoned Pey d’Escoutet and his son, the former having been a leading supporter of the French party in the city of Bazas until it submitted to the English in 1347. 7 The king returned the important vicomté of Fronsac with its strategically placed castle commanding the rivers Dordogne and l’Isle, just near the town of Libourne, to the loyal Guilhem-Sans III de Pommiers and his wife Johana de Fronsac, daughter of the vicomte Ramon VI, who had rallied to the French for the second time and had stubbornly refused to return to the English party. 8

Gilibert de Pellegrue the younger was rewarded by the king by receipt, in perpetuity, of the place of Eymet (South Périgord) he previously conquered from the French, a place he had already obtained for life from the duke of Lancaster Henry of Grosmont when he was king’s lieutenant in the duchy. 9 Pellegrue's descendants would remain lords of Eymet until at least the early 16th century. Guilhem de Corberde , was rewarded for allowing his boats at the port of Meilhan on the river Garonne to be used to transport ‘English’ men-at-arms over a ten year period by obtaining the right to load 50 tuns of wine at Bordeaux without paying any customs. 10

The town of Miramont-de-Guyenne (Agenais) was allowed to levy taxes for a longer period in order to repair and build its urban enclosure, which was always an expensive cost for a town. 11 This kind of enclosure was often 'privatised' under local men for their own use during periods of peace. We learn that a burgess of La Réole had made a breach in the town’s wall, but he obtained the king’s pardon for this infringement. 12

An entry gives us the interesting story of a ship loaded by the lord of Albret which was attacked by a Flemish fleet near the Isle of Wight. A Bayonnais master of another ship followed up his personal interests there with little regard for the interests of the mighty Gascon lord. 13

Worthy of note are the letters of protection granted to Fernán García de Areilza, former treasurer of the late king of Castile, Alfonso XI, who was in exile with his family at Bayonne in order to escape the crackdown led by the new king Pedro I against some of his father’s close councillors. 14

12 March 1352 . Westminster . For the lord of Albret .

Order to the Baiona mayor, jurats and hundred peers of the city of Bayonne that having heard the complaint of the lord of Albret, or his attorney, about the recovery of the ships [mentioned below] by his men, or at least their value, and the damage caused by their arson and theft; they have to make swift full justice according to the local fors and customs, and the maritime law. Bernat-Etz [V d'Albret], Lebreto, de lord of Albret , has complained to the king that he had formerly loaded at Bordeaux some wine and goods on a ship called la Seynte Marie of Bayonne whose master was Mees Guilhem-Pey de Mées , in order to bring them to Sandewicum Sandwich , and Durtebury Arnaut d'Horteberri 1 and some of Albret's men, esquires and merchants alike, kept these wine and goods on this ship; and then some malefactors from Flandria Flanders and elsewhere with 32 ships barred the way at sea at Calcheford Calshot to this ship and to another one called la Saint Jake of Bayonne , whose master was Galesius, Hurta, de Gales Duhart , and on which were wines of some merchants; and these malefactors caused by armed force these men and merchants of these Bayonnais ships to flee to the Insula Vecta isle of Wight , and then they consequently stole the wine and other goods in these two ships and later burned these same ships; but the men of the lord of Albret took back these ships from these malefactors near the isle of Wight and delivered their keeping to Gales Duhart until otherwise ordered. But Gales Duhart mischievously burned one of these ships and secretly took the other one and departed from the isle of Wight with it without the licence or will of the lord of Albret or his men, thereby stealing this ship to the great damage of the lord of Albret, so this latter requests the king to bring him remedy on this matter.

10 March . Westminster . For the lord of Albret .

Order to Ralph, Stafford' earl of Stafford , captain and lieutenant of the king in the duchy of Aquitaine or his lieutenant that making speedy information with the seneschal of Gascony and the constable of Bordeaux, if he notices by this information that Bernat-Etz [V], lord of Albret Lebreto, de did not receive the 645 l. 6 l.st. and the 5 s.bord. allocated to him on the lands and issues of the duchy acquired or to be acquired by war and also high and low justice with both complete and shared jurisdiction wherever it is able to be done to be taken each year until Albret will have recovered his lands, rents and places that he has lost, or he has received suitable compensation elsewhere from the king, receiving from Albret or his proctor or attorney his letters of acquittance, any other king's orders to the contrary notwithstanding. Albret supplicated that the king will wish to give him a pension for his losses, according to the indenture made between him and the king where the latter committed to keep undamaged Albret and those who will come to the king's obedience and fidelity. 1 And Albret, because of his adherence to the king's party against the king's enemies in the present war of Gascony, lost his lands, revenues and places of by no means modest value, that is the place of Gensaco, de Gensac that the lord of Albret transmitted and delivered to the Moichidano, de lord of Mussidan in compensation for what this lord lost at the occasion of this war in the king's service, a place of a value of 800 gold rials of annual and perpetual rent accounting one rial for 4 s.st. , and the rent that he had in Vasates' Bazadais and which he used to take from various people to the value of 125½ gold rials; and also of the annual rents that he had and took in Sora Sore and Lebreto, de Labrit to the value of 950 gold rials; and of the annual rent which he had and took from the lands of Mixa Mixe and Hosca Barisio Ostabaret with their appurtenances in the Navarra kingdom of Navarre to the value of 500 gold rials; and of the annual rent that he took in the land of Ruthena Rodez 2 by reason of the dower of his wife 3 to the value of 851 gold rials and 5 s.bord. , these rials corresponding to a sum of 645 l. 6 l.st. , as more fully appears in an information made by the then seneschal of Gascony at the king's order and returned to the king's chancery. The king ordered to the then seneschal of Gascony and the constable of Bordeaux to allocate to and have received by Albret or his proctor or attorney for his advantage and use the 645 l. 6 l.st. or their value in other money and also the 5 s.bord. , on the lands, revenues or goods or issues appertaining to the king in the duchy and also high and low justice with both complete and shared jurisdiction wherever it is able to be done, to be taken each year until Albret will have recovered his lands, rents and places that he has lost, or he has received suitable compensation elsewhere from the king, as more fully appears in the king's letters patent, any other king's letters to the contrary notwithstanding. And thereafter Albret let the king know that he did not have these allocations of annual issues from the seneschals of Gascony and the constables of Bordeaux, and supplicated the king to make the annual allocation of these 45 l. 6 l.st. and also the 5 s.bord. . 4

For Thomas de Colle.
66

17 July 1352 . Westminster .

Order to the constable of Bordeaux or his lieutenant that the subsitutes of Thomas de Colle, king's valet be in the Burdeg' castle of Bordeaux each time there will be business and at the summon of the substitutes when they come there, and in the places where the customs of the wines are paid for the king's convenience, at the fief of gauge ( gaugetti ) on all the burgesses [of Bordeaux] , Anglici English , Gallici French , as well as on any other merchants bringing wine outside the duchy, these customs are levied, he should permit them to receive these customs according to the king's grant, wherever these customs have been received, and he should assist these subsitutes in the reception of these customs in customing these burgesses, English or French and all the other merchants to pay the fief of gauge ( feoda gaugetti ) before leaving this castle. So that no prejudice or destitution happens to the king by the removing ( subtractio ) of this fief at the constable's own making. Formerly, the king granted to Colle, because of his good service, the office of gauger of the wines in the city of Burdeg' Bordeaux and in all the duchy of Aquitaine to have for life with everything pertaining to this office, perceiving for each tun of wine one st. and for each two pipes of wine, corresponding to one tun, one st. in good money called bordelais for all the wine which the merchants, local and foreign, will load and bring outside the duchy, apart from the wine of the banlieue ( balega ) growing only within the boundaries of the city of Bordeaux. And because Colle constantly stays with the king, he cannot personally exercise this office, the king has granted him to have substitutes in this office, who will respond under his responsibility, who will receive this fief for Colle and will respond to him. The king also granted to Colle that these substitutes have whatever custom is owed to the king for the wines going into the castle of Bordeaux and in the places situated within this castle where the customs on the wine should be paid on the ships loading them to take them outside, without impediment of the king, his heirs, his ministers or officials, notwithstanding that they used to receive this feodum gaugetti within this castle in the past. The king is not willing that this grant be considered as a precedent after the death of Colle, as more fully appears in the king's letters patent.

Order to the seneschal of Gascony and the constable of Bordeaux and their lieutenants, as well as to the other king's officials and ministers in the duchy of Aquitaine to permit Brokas Menaut de Brocas to have and exercise in Thomas de Colle's name the office of the executions of the seals and counter-seals that are for the contracts in Burdeg' Bordeaux , Vasat' Bazas and Vasadesio Bazadais as well as anywhere else in all the duchy, according to the tenor of the king's letters, any grant of the office of executions of Bazas and Bazadais by the king's lieutenant, by the seneschals of Gascony or by any other royal ministers to Possinhac Fortaner de Poussignac 1 or anyone else, or any appeal to the king's court ( audiencia ) made by Poussignac or others on this matter, or any similar grant made by the king notwithstanding. The king is not granting any letters on debts arising out of loans and where they are obligated, or any other letters against any fors and customs of these parts; and if such letters have been unjustly granted by the seneschal or his predecessors, or any other ministers, they should be revoked without delay. Formerly, the king granted to Thomas de Colle, king's valet , for his good service, the office of the executions of the seal and counter-seal that is used in Bordeaux for the contracts with all its appurtenances, to have and exercise for life by him or a suitable attorney under the same form that the late Monte Gomeri, de John de Montgomery formerly held it by the king's grant. 2 So that this office with its parts would return to the king or his heirs after the death of Colle. And thereafter the king granted to Colle to have the office of the executions of the seals and counter-seals that are for the contracts in all cities, burgs and towns of all the duchy of Aquitaine to have and exercise himself or by a sufficient and suitable attorneys as more fully appear in the king's letters patent. And Colle delegated Menaut de Brocas before the king to represent him in this office in Bordeaux and Bazas as well as in all the cities, burgs and towns of all the duchy, to have and exercise this office at Colle's pleasure. 3

Order to Ralph, earl of Stafford , king's captain and lieutenant in the duchy of Aquitaine or his lieutenant that if a castle or a fortified town in the duchy is acquired or happens to be put into the king's hands, reserving the king's lordship on them, he should make payment of the remainder of the emoluments owed to Bernat-Etz [V] lord of Albret from the emoluments pertaining to the castle, town and lordship until he recovers his lost places, lands, tenements and revenues or compensation of the 645 l. 6 s.st. and 5 s.bord. . Formerly, the lord of Albret requested that the king will wish to make a suitable allowance to him, as Albret, because of his adherence to the king's party against the king's enemies in the present war of Gascony, lost several of his places, lands, tenements and revenues reaching the sum of 645 l. 6 s.st. and 5 s.bord. , as it is shown in an information made by a former seneschal of Gascony at the king's order and returned into the king's chancery. 4 September 1352 . Westminster. For Johana de Cazeneuve and her son Pons.

Inspeximus of letters patent sealed under the seal of the court of Gascony:

20 April . Burdeg' Bordeaux .

Bruni Johan Brun, kt , lieutenant of John de Chiverston, kt , seneschal of the duchy of Aquitaine grants by these presents to Casanova Johana de Cazeneuve, wife of Castellione Pons [IV] de Castillon the older , kt that the half of the land granted to her by the court will be returned fully and forever to her son Castellione Pons [V] de Castillon the younger, kt , and his heirs after her death, without any impediment. Cazeneuve and Pons [V] de Castillon the younger, or their proctors or attorneys have to hold it, any grant or allowance made against this grant notwithstanding. Saving above all and retaining on and over the liege homage and superior resort to the king, ordering by these presents to the constable of Bordeaux or his lieutenant, or the person exercising the office of constable or governing it instead of the constable, to put Cazeneuve and Pons V de Castillon the younger in actual possession of the places of Castellione, de Castillon , Marchia Lamarque and Sanctus Mambertus Saint-Mambert and all the other places and fortalices that Pons de Castillon the older possessed and held before his rebellion against the king and the king's seizure in Medulco, de Médoc and other places situated in the king's obedience with the jurisdiction of high and low justice with both complete and shared jurisdiction, and these jurisdictions have to be held as they were held and possessed by Castillon the older, together with all the lands, hereditary possessions, estates ( maynilibus ), homages, men, questaux ( questalibus ), 1 and perhendatariis , questes ( questis ), tallages ( talliis ), revenues, issues, profits, emoluments, rights and money pertaining to the lord of the place of Castillon or having to appertain to him, and all the movable and immovable goods situated in the king's obedience that were owned by Castillon the older and that were seized by the king because of his rebellion, that are one half in joint ownership for Cazeneuve for life, and the other half in joint ownership for her son Pons de Castillon the younger, for him and his heirs and successors for ever, by the king's grant; and they have to be maintained with force and permit to enjoy these lands. It has been written three copies of these letters: one is possessed by Cazeneuve, the second by Pons V de Castillon the younger and the third for guarantee is given to the constable of Bordeaux or his lieutenant, or the person exercising the office of constable or governing it instead of the constable, and the court makes an allowance in the constable's account for some auditores from the king's part. Brun has learned by reliable witnesses that Pons IV de Castillon the older, natural liege man of the lord king of England and France, 2 committed rebellion and injustice, has been attracted again in the obedience of the French, but his wife Johana de Cazeneuve and their son Pons V de Castillon the younger did not want to follow him in his rebellion, the places that were formerly owned by Castillon the older are still in their hands, and they are also natural king's lieges and they want to remain faithful and subjects to the king. Because of the danger that could arise in the future and the good will and affection that Cazeneuve and Castillon the younger have towards the king, and had until now, as they went at Burdeg' Bordeaux by Brun's order and took oath to him in the king's name to be faithful and obedient. According to the nature of this business, mature advice and deliberation with various barons, nobles, liege men and king's subjects and the king's councillors of these parts, helping him in this case, at the day, hours, he does not want to disinherit Cazeneuve and Pons V de Castillon the younger because of the misdemeanour of Pons IV de Castillon the older, and because of what Cazeneuve has as a result of the dowry of her marriage in and on the land of the lord of Castillon, and also in part compensation of the lands, goods and revenues that she lost because of her fidelity, being disobedient to the French, and because of the laudable service Pons V de Castillon the younger did to the king in his wars, and that he will do in the future, Brun granted them the places of Castillon, Lamarque and Saint-Mambert with all the other places and fortalices that Pons de Castillon the older owned, according to the conditions explained above. The seal of the court of Gascony is appended to these letters.

Same as above

The king wishes that Johana de Cazeneuve hold and have for life the said place 3 of Sancto Mamberto, de Saint-Mambert and Moton Mouton , by her or by the men she will choose to hold and possess it in her name, to keep this place for her accommodation and residence. The king confirms and approves this grant and all the others contained in these letters made to Cazeneuve and Pons V de Castillon the younger, in consideration of their faithful behaviour towards the king. 4
