Physical condition of the roll

The roll consists of twelve membranes. There are entries on all of the face sides, but on none of the dorses. The roll is generally in good condition.

C 61/111, 7 and 8 Henry IV (1405-1407)

Introduction.

In contrast with the previous roll, this roll, stretching from 30 September 1405 to 29 September 1407, is much less concerned with licences to transport wheat and other goods from England to Gascony, or wine in the other direction, perhaps indicating that food supplies were less problematic. 1

The roll includes several court cases involving Gascons. The king gave remission to the young Johan de Lansac, then aged less than seven years old, for a sum owed by his father for infringing a royal safeguard. 2 Four entries concern succession. Guilhem-Ays de Fronsac claimed to be the heir general of a deceased burgess of Bordeaux (Pey Lambert). He had complained to the king that Johan Colom, an important burgess of Bordeaux later executed for treason (c.1376), had seized many goods from Lambert’s house. Fronsac also complained that the goods of Colom granted to him had been seized by the constable of Bordeaux and by the local lords of sub-provinces of the Médoc and Buch. 3 The Saintongeais noble, Pierre Gombaud, claimed the inheritance of a Médocais lordship: this was challenged by two brothers of the local noble family of the Potensac. Gombaud had requested the seneschal of Aquitaine in vain to have a judicial duel with one of the Potensac brothers in order to prove his claims. 4 The lord of Lesparre Guilhem-Amaniu de Madaillan requested the king persistently to have the lordship of Vertheuil (in Médoc), which had been occupied for a very long time by the captal de Buch, Archambaud de Grailly. He probably thought the relatively recent rallying of the latter as count of Foix (1401) to the king of France, Charles VI, would help his claim on this matter. 5 But, at the same moment, Menaut de Canteloup complained that Madaillan had occupied the noble seat of la Motte Verte in which he claimed to have rights. 6 Per-Arnaut de Béarn (from the family of the counts of Foix and vicomtes of Béarn), lord of Estang (Landes) through his wife, wanted to recover a source of revenue situated in the Médoc which had been owned by a former lord of Estang who had been a rebel against the king. 7 It is also interesting to learn about a conflict of jurisdiction between the king-duke and a local community. The prévôt of Saint-Émilion had informed the king that the mayor and burgesses of this town had tried to attract to their jurisdiction men of the king living in the banlieue of Saint-Émilion. 8 Despite the efforts of the two previous kings of England to limit significantly the number of Gascon cases presented to them, Henry IV had arbitrated in England in a case between Bertran de La Trau and Johan Estében, and had imposed an agreement on them. He subsequently ordered the judges of the king’s council of Bordeaux to do full justice to them, according to this agreement, within one month of their return to Aquitaine. 9 Henry IV had ordered his castellan of Mauléon Carlos de Beaumont to protect the Navarrese lady of Aguerre against another Navarrese, the important lord of Luxe, concerning her possession of the noble house of Alos situated in the Soule province, despite a previous judicial decision of John of Gaunt in favour of her predecessor. 10 The state of war existing with the king of France and his ally, the count of Foix-vicomte of Béarn, explains why the king granted letters of marque to some Gascons, even though he was normally reluctant to grant them, for obvious reasons. Arnaut de Poyanne, burgess of Bordeaux, had complained that some adversaries of the king had seized his goods up to the value of 250 m.st. , despite the truces and the king’s safe-conduct. He succeeded in obtaining a letter of marque. 11 Mariota, wife of Johan Dupin, burgess of Bordeaux, complained to the king about the debt of 80 écus and 10 fr. owed to her by Ramon-Gassie de Luts, notary of Orthez (then capital of Béarn), and asked for a letter of marque from Henry IV. 12 A special commission d’oyer was entrusted to Henry Bowet, bishop of Bath and Wells (who had been constable of Bordeaux 1399-1401), and Lord Grey, to hear the merchant of Bordeaux Ricart Macanan, proctor of Bernat de Lesparre, lord of Labarde, and the men of the Bordeaux fleet who had successfully fought against a French fleet on the Gironde estuary in December 1406. He asserted on behalf of all the men of the fleet that some men wanted the spoils of this fight even though they had not been present at the event. 13 The esquire Galhart Polet was pardoned by the king for having taken the law into his own hands in forcing, without the help of the royal serjeant-at-arms, some of his villeins to return to live in his lordship. 14 Jakob Bödeker, a German merchant of Stettin, had complained to the king about some Bayonnais ‘pirates’ who had stolen at sea 300 l. of his goods c.1402-3. Following Bödeker’s appeal to the delegates of the Hanseatic League gathered at Lübeck in December 1403, the king finally ordered the mayor and community of Bayonne to compensate him. 15 There is also an entry about the judicial duel which took place in England between Johan Boulomer and Bertran Ozanne, two citizens of Bordeaux, the former having accused the latter of speaking against the crown of England and the union of Bordeaux with England. 16

Other entries concern some Poitevins who had maintained their fidelity after the end of the Black Prince’s principality of Aquitaine (1372). Hugues Brouard, a Poitevin who was apparently a member of the ‘English’ garrison of Chalais (in Saintonge), was given in compensation, after the fall of this castle to the French (1405), the patis and ransom of the region situated around Aubeterre-sur-Dronne (also in Saintonge) as well as other grants. 17 Another Poitevin was Radegonde Béchet, former lady of Morthemer in Poitou and widow of the Welsh knight Gregory Says. She had lost Morthemer in 1375 and was confirmed the possession of the issac custom of Bordeaux (a wine custom) which had initially been granted to her by Richard II. 18

Several entries deal with grants given to Gascons in order to compensate them for losses they suffered because of the war with the French. Hence Johan Baudrin, an inhabitant of Puydauphin (in Agenais) and vassal of the lord of Lesparre, obtained, at the latter’s request, the office of king’s serjeant-at-arms. 19 The lord of Montlau (Bordelais), who had his castle destroyed by the French, obtained the patis and ransoms of some ‘French’ castellanies of the Bazadais region and of the ‘French’ castellany of Saint-Macaire. 20 Gassie-Arnaut Duhart obtained the office of clerk and writer of the constabulary of Bordeaux because he had lost everything he possessed the previous year and had thenceforward been reduced to poverty. The esquire Bernat de Beaucourt and Gombaut-Arnaut de Tizac were in the same situation and received some goods in compensation. 21 An English squire, Richard Grosvenor, had lost goods in Aquitaine, but mainly his goods, houses and hereditary goods in Wales because of Owain Glyndŵr’s rebellion. He was consequently granted the office of constable of the castle of Fronsac, a castle with an exclusively English garrison. 22 The citizens of Libourne were so impoverished by the war with the French that the king agreed to annex to their town the lordship of Puynormand. 23

The series of French offensives led against Anglo-Gascon Aquitaine every year since 1404 prompted the king to take measures to support the military resistance of his subjects. 24 Hence, at the start of 1406 he granted to the town of Bourg the right to levy 8 d. on each tun of wine coming from the town and its castellany in order to repair its walls and to pay the wages of the men-at-arms of its garrison. Similarly, he allowed this town to force those living within its castellany to contribute to its defence. 25 The lord of Montlau was given a part of the issac custom of Bordeaux (a wine custom) and some measures on grains from the town of Saint-Émilion up to the yearly value of 140 gold ecus, provided that he entered Saint-Émilion to defend it every time it was besieged or threatened by the ‘French’. 26 Finally, Henry IV ordered all of the inhabitants of the castellany of Mauléon (in Soule) to perform the customary watch at the castle of Mauléon, a task which was often reluctantly done. 27

Henry IV tried to reinforce the principal military support he had in the duchy. He gave to Matthew Gournay (a former companion of the routier leader Hugh Calveley and seneschal of the Landes on several occasions after 1370) several revenues of the city of Dax. 28 Aymeric de Durfort, married to a relative of Matthew Gournay, had received a rent from John of Gaunt who had dubbed him knight: Henry IV showed himself willing to confirm his father’s grant. 29 The king also accepted the purchase of the baylie of Labourd by the important lord of the kingdom of Navarre, Carlos de Beaumont, granting him also the land of Noaillan (in Bazadais) and various revenues in and around Bordeaux. 30

Other entries also provide interesting information. Because of the weakness of ‘English’ rule in Aquitaine, Henry IV was forced to acknowledge a de facto situation that would previously have been considered as an act of treason. He legitimised the fact that the lord of Lesparre had given patis , safeties and safe-conducts to some enemies of the king. 31 Henry IV had tried in vain to reconcile the faction occupying the Bayonnais government and the faction led by Pey de Contis. Consequently, he granted to Contis the office of the gauge of the wine of Bordeaux in order to provide for his maintenance. 32 The king permitted Henry Bowet, bishop of Bath and Wells since 1401, to sell the lordship of Ornon (near Bordeaux) which he had owned since 1400, putting an end to Bowet’s personal involvement in the life of the duchy. 33 Finally, we learn about the stay in England of Pons VII, lord of Castillon, one of the principal lords of the English party in Gascony. 34

He had been captain of the routiers of Lourdes in the early 1370s, was general lieutenant of Gaston III Fébus in Marsan c.1380-1382. He led the routier troops who attacked the region of Casteljaloux, a possession of the lord of Albret, between 1383 and 1385, and he became general lieutenant in the county of Foix in 1398. Johan de Béarn, captain of the routiers of Lourdes from the 1370s to 1407, was his brother.

Supplication to the king of Guillam Ais Guilhem-Ays de Fronsac, esquire , 1 heir general of Pey Lambert of Saint Andreu Saint-André , kt , 2 as, after the death of the latter, Johan Colom, kt , when he was alive, 3 took from Lambert's house several goods to the value of 1368 gold fr 4 and kept them without any compensation; which Colom confessed when near death and ordered to be repaid on his goods, and by virtue of this confession, John, Lord Neville , then Enguiene king's lieutenant in Guyenne , 5 ordered Molton John Moulton, then mayor of Bordeaux , 6 to give Fronsac this sum from Colom's goods. Moulton had given to Fronsac eight men 'questaux' 7 owned by Colom at Brachs Brach to the value of 30 l. of the Bordeaux money a year, eight men 'questaux' in Le Porge in Buch Pourge en Buche to the value of 25 l. a year, of the men 'questaux' of Saint-Corbian and 100 s. of rent at Cartugueire Tartuguière 8 in the lordship of Lesparre ; Fronsac had to hold all that until he was repaid of the said sum. Then, Stretton John de Stratton, lord of Landiras , new constable of Bordeaux took violently without good reason a part of these grants, and the supplicant did not dare to contest it because he was a royal officer, and all the barons of the region, following the constable's example, took the other goods granted to Fronsac in their own lordships. So Fronsac supplicates the king that he should order letters patent to his seneschal [of Aquitaine] to return these goods to him or his first son Johan de Fronsac , bearer of this petition, until he recovers the said sum. 9

Guilhem-Ays de Fronsac obviously issued from a cadet branch of the vicomtes of Fronsac as at least a namesake was vicomte of Fronsac c. 1209-12 and another namesake was a son of vicomte Ramon IV (d. 1280).

Issuing from one of the great burgesses families of Bordeaux prominent in the 13th century, this Lambert was nicknamed 'of Saint-André' probably to distinguish him from a namesake, because he had his residence at Bordeaux on Sent Pau Street (now known as 'rue de Ruat') situated near Saint-André street ('rue Saint-André', now known as 'rue des Trois Conils') and the cathedral of this name. Lambert's house was inherited by Guilhem-Ays de Fronsac, see Drouyn, L., Bordeaux vers 1450 (Bordeaux, 1874), p. 449.

Thereafter Bödeker appealed to the delegates of the Hanseatic League gathered at Lübeck in December 1403. They had been assured that Bödeker was a burgess of Stettin and originated from the duchy of Pomerania. As Gombaut, Puch Vigey Pierre Gombaud de Puyvigier , is the right heir of Marquesa de la Mote Sabete , his grand-mother, through his father Gombaut Guillaume Gombaud, Puch Vigey lord of Puyvigier , 1 son of Marquesa, and as he is also the right heir of the mother of Marquesa by right succession of lineage, and as Marquesa was the right heiress, trough her mother, of half of the house of Cantenac and of the motte of Ludon[-Médoc] with their appurtenances, Pierre Gombaud should own these places by right of succession. And Podensac Pons de Potensac, kt, Beleyron lord of Baleyron and his brother Florimont de Potensac 2 unjustly occupy some parts of these lands, particularly the place of Cantenac , and they have levied half of the goods and fruits of this place and still continue to do this to Pierre Gombaud's prejudice. Pierre Gombaud appealed several times about it before the seneschal of Aquitaine and offered to prove it by battle against either Pons or Florimont de Potensac, as is the use in such a case for any noble man, but Pons de Potensac is always in default for non-appearance, whilst Florimont is arguing he is a clerk, notwithstanding he is wearing arms every day. Pierre Gombaud cannot obtain justice from Pons and Florimont de Potensac nor get back these hereditary goods without the king's help. 3

Grant for 20 years, with the king's council assent, to Carlos de Beaumont, alférez of Navarre , of the land of Noaillan with all the lands, tenements, revenues pertaining to it and with all the lands and revenues which were owned for life by Johan Cantiran in the city of Bordeaux and in the towns and parishes of Marinach' Mérignac , Becla Bègles , Villa de Navus Villenave[-d'Ornon] and Cadaynach' Cadaujac and others in the duchy, in the same way that Johan de Cantiran held them during his lifetime. The king furthermore grants to Beaumont for his lifetime the custom on the wine called issac of Bordeaux after the death of Radegonde Béchet, Mortemer lady of Morthemer who holds this custom for life according to a grant of Richard II . The king also grants to Beaumont the licence to bring and carry, him or his attorneys, 120 tuns of wine coming from the rebel places of the duchy 2 without paying any tithe or custom at the castle of Bordeaux or elsewhere and without bringing any wheat with this wine, and with priority before any others who had such licence, in the same way as Tolleo Guilhem de Thouil , former clerk of the city of Bordeaux , had for life by the king's grant. Beaumont will render each year for 20 years 100 fr. at Easter and Michaelmas by equal portions. 3

On this annuity, 182 l. , 18 s. , 9 d. and one penny are in arrears by warrant of the exchequer of the receipt and were not paid to Carlos before his return towards the regions situated overseas. 2

Commission to Guilhem Amaniu [de Madaillan], lord of Lesparre and Rosan Rauzan , to Bernat de Lesparre, lord of Labarde , Swyneburne Thomas Swinburn, mayor of Bordeaux , knights, and masters Dasta Bertran d’Aste, judge of Gascony and Rybere Pey de Ribere, official of Bordeaux , four, three or two of them, to inquire about the complaint of Radegonde Béchet, Mortymer lady of Morthemer and to make her full justice, as she had been granted par letters patent of late king Richard [II] , confirmed by the current king on 16 November 1399 for his lifetime:

  1. the custom on wine perceived in Bordeaux called issac , with the proviso that she should duly satisfy other grantees.
  2. one quarter of the issues of the market of Bordeaux , the remaining three quarters at the end of the term which by Richard II granted them to the good men ( probi homines ) of Bordeaux . As she was in peaceful possession of these grants, Farryndon William de Farringdon, kt , constable of Bordeaux and his lieutenant had taken a part of these issues, and Master Prioret Pey Prieret, king’s procurator fiscal in Bordeaux , fraudulenty took 200 l. of the black coin of Bordeaux after the death or Johan Cantiran , a sum Radegonde had to pay on the issac to the late Cantiran.

Order to all the admirals etc. in the kingdom of England and in the duchy of Aquitaine not to permit any injuries, damages, violence impediment to be done against them and, if such have been the case, they have to correct them.
