Physical condition of the roll

The roll consists of twenty membranes. There are entries on all of the face sides, but on none of the dorses. The roll is generally in good condition, but the last membrane is partly erased.

C 61/113 11, 12, 13 and 14 Henry IV (1409-1413) .

Introduction.

The last roll of the reign of Henry IV covers a period of three years and four months. As in previous rolls, the king granted rents to be paid on the wine coming from the Haut-Pays (the regions outside the diocese of Bordeaux) under French rule, and granted permission to export wine coming from the same regions without paying any custom to him. 1 The duke of Brittany Jean V, son of Henry IV’s second wife Joan of Navarre, was particularly favoured, obtaining the right to buy and transport 100 tuns of wine coming from the Haut-Pays without paying any custom to the king. 2 Other kinds of grants were given to faithful Gascon liegemen. Take, for instance, the grant of 50 s. a year based on two shops situated below the castle of Bordeaux to the esquire Ysarn de Rouffignac. 3 Or the grant to the esquire Bos de Labarde forbidding the community of Saint-Émilion to have any authority over his goods and those of his sister or wife. 4 Grants on goods of ‘rebels’ (persons in French obedience) were the most common: for example, a grant of all the goods of ‘rebels’ in the castellany of Blaye and their other possessions to Maria de Montaut, lady of Blaye and her husband Johan de Gramont; 5 the Poitevin Hugues de Brouard obtaining the Bordeaux house of the late Bernat Audouin, seized because Audouin’s heirs who lived in Saint-Macaire, under French obedience since 1377, were ‘French’. 6

Inevitably, several entries concern commercial business. The king’s butler (John Mersh) was sent by Henry IV to Gascony in order to make purveyance of tuns of wine for the king's household. Similarly, the butlers of the Prince of Wales (Robert Ruddington) and of his younger brother Thomas of Lancaster obtained licence to buy tuns of wine and to bring them to England without paying any custom. The fact the Prince’s butler was allowed to buy and transport 600 tuns while Lancaster’s butler was allowed only 80 tuns may be an indication of the size of their respective households. 7 We also find in this roll letters of protection for merchants of Toulouse, Condom and Auvillar who brought wine and corn towards Bordeaux on the river Garonne on flat-bottomed river boats. This kind of licence is extremely rare in the Gascon Rolls despite the Anglo-French war and the fact Toulouse was the main rival of Bordeaux on the river Garonne as the de facto capital of the southern part of the kingdom of France. But it is likely this form of licence was customarily granted by the Bordeaux government rather than the Westminster one. 8 An entry informs us of the existence of a trading company set up by two merchants of Bordeaux selling wine. 9 This roll also informs us about two Gascon merchants (Guilhem Calmettes of Bordeaux and Jacmot de Contis of Bayonne) who were buying tin dishes in England and transporting them to the duchy. 10 The king also regulated the levy of taxes in the duchy: he forbade the imposition of a tax on the goods brought at Bayonne by ‘foreigners’ (people who were not citizens of the city) and also on any iron entering or leaving the city. 11

International affairs are also present in this roll. The Great Schism still caused trouble in the duchy. Henry IV ordered his officers in Aquitaine to protect Cardinal Francesco Uguccione, administrator of the archbishopric of Bordeaux since 1405 (he was archbishop between 1384 and 1405), against any sentence made against him by Pope Gregory XII. The king also ordered, following the decision of the council of Pisa, to acknowledge the new pope Alexander V. The Cardinal's long absence from Bordeaux allowed some of the king’s officers in Bordeaux to request payment of customs on the archbishop’s wine against the latter's customary rights. 12 There is also some information on the endless affair of the ransom of the count of Denia who had been taken prisoner at the battle of Nájera on 3 April 1367. The lord of Castillon, Pons VII, had obtained in 1409 confirmation of letters of marque granted by John of Gaunt in 1393 against the men of the crown of Aragon in order to get money owed to him by the count of Denia, Alfons the younger, and his father Alfons the elder. Complex details on English judicial matters concerning this ransom are also to be found on the roll. 13

Not surprisingly, several entries concern war with France. In 1410, Henry IV appointed three commissaries – the lord of Montferrand, the mayor of Bordeaux and the chancellor of Aquitaine – to maintain the truces with France despite local breaches made against them. 14 Of particular interest is the treaty of ‘Bourges’ signed at London on 18 May 1412. Because of the civil war between the Burgundian and Armagnac parties, the latter party had been forced to make an alliance with Henry IV in order to resist the duke of Burgundy who had then the control of King Charles VI of France. In return for military help, the French ‘Armagnac’ princes (the dukes of Berry, of Orléans, of Bourbon and the count of Alençon) were ready to pay homage to Henry IV as duke of Aquitaine without any mention of the king of France, and return to him the extended Aquitaine of the treaty of Brétigny-Calais. This treaty demonstrates that French nationalism was not as developed at this period as historians often believe, since French princes of high profile were ready to return a large sovereign Aquitaine to the king of England if it served their interests. It shows too that the real purpose of Henry IV, unlike his son Henry V, was not to obtain the crown of France, but to recover the large sovereign Aquitaine of the Brétigny-Calais settlement of 1360. 15 Thomas of Lancaster, recently created duke of Clarence and earl of Aumale, the second son of Henry IV, was appointed the leader of the English army composed of 1,000 men-at-arms and 3,000 archers which had to join the princes' forces at Blois. He was also appointed the king’s lieutenant in Aquitaine at royal pleasure. 16

A special characteristic of this roll compared to all previous ones is the copying in full of three petitions written in French. One of them still exists in its original form in the TNA. This is the petition of Johana de Preissac complaining that her inheritance was occupied by the lord of Montferrand, the husband of her niece. 17 The petition of the lord of Roquetaillade gives interesting information on the capture of men and cattle during actions against enemy places. 18 But the most interesting petition is that of the ‘king’s lieges of Guyenne’. They complained to the king at the English parliament that the men of Guyenne (Aquitaine) who lived in England were insulted by native Englishmen and called aliens despite they were true liege men of the king of England. Apart from mere xenophobia, this underlines the English difficulty to understand the exact situation in Aquitaine-Gascony as, for instance, Western Gascons were generally pro-English and Eastern Gascons were pro-French. 19

Order to the seneschal of Guyenne , the king's officers and subjects [of Guyenne] that, if some suits and sentences were made against the cardinal of Bordeaux 1 to the prejudice of his status of archbishop of Bordeaux by Angelo Correr under the name of Pope Gregory XII since 3 May 1408, they should neither carry out these trials and sentences against the cardinal nor do any damage and injury to him or his deputies, officers or domestics, but must obey and attend this prelate and his deputies and officers. Recently the general council of Pyse Pisa had proclaimed schismatic Lune, de Pedro de Luna called [Pope] Benedict XIII and Coraire Angelo Correr called [Pope] Gregory XII , and had elected as pope the cardinal Candi Pietro di Candia under the name of Alexander V . The king has proclaimed and ordered to all his liege men and subjects to accept Alexander V as pope. All the sentences made against the cardinals by Pedro Luna or Angelo Correr have been quashed.

Grant of letters of marque to Pons [VII de Castillon], Casteillon lord of Castillon permitting him, or others on his behalf, to take from the men and inhabitants of the cities, places, towns and lands of the Darragon kingdom of Aragon and of the Deyne count of Denia , and on their goods, up to the sums owed to Castillon, in full respect of the truces made between the king and the king of Aragon. The seneschal Trailly orders to all the officers and subjects of the Guienne duke of Guyenne 1 to permit Castillon to levy these marques and to attend him in this purpose. 2 All the seizures they carry out must be kept for the lord of Castillon in accordance with the truces. Alfonsso Alfons, Deyne count of Denia , 3 son of the Villaine marquis of Villena 4 is bound to Pons VII de Castillon by [letters of] obligations and other means to return to, and pay, him the following sums owed by Castillon:

  1. 1,500 gold fr. to Doguet John Doget, merchant of London ;
  2. 1,000 gold fr. to John Doget's representative and attorney for the expenses he incurret and because of the suits and executions he made against the lord of Castillon;

all these sums amounting to 3863 gold fr. as appears by several obligations, instruments and other writings. Count Alfons has bound his person and all his goods to pay these sums as appears in charters and public instruments to which he put his seal. But this count has surreptitiously left the land of Guienne Guyenne without taking his leave 8 , notwithstanding the pains he might incur because of perjury, and he has fled to his land which is in the Daragon kingdom of Aragon without having paid or satisfied any part of these sums against his faith and oath and the said charters and obligations. The lord of Castillon and the other creditors have sent messengers with letters of request to the count in Aragon requesting him to keep his oath in coming to Bordeaux as a hostage or to pay these sums. Thus, Lescrop William le Scrope, seneschal of Aquitaine and Durffort Galhart [II] de Durfort, lord of Duras and Blanqueffort Blanquefort , then governor of the seneschalcy of Aquitaine , Trailly's predecessor, have requested by their letters, two or three times for Lescrop and once in the case of Durfort, the king of Aragon 9 to compel the count Alfons, his subject, to keep his oath and to come to Bordeaux to be a hostage until he paid owed sums which he owned to his creditors. The king of Aragon and his council have seen the copies of Alfons' obligations sent by the seneschal and the governor, but this king did not want to compel Count Alfons to pay Castillon. The king asserted that the creditors could have full justice by writing to him or to his vice-chancellor whom he had made responsible for this matter. The marquis of Villena and the count of Denia have threatened the creditors both verbally and in writing, with the result that they did not dare come [to the kingdom of Aragon or to send deputies]. So that the lord of Castillon and the other creditors have supplicated Trailly to give them [letters of] marque . By deliberation and opinion of several barons, knights, wise men in canon and civil law, esquires, nobles, burgesses and others, Trailly has declared that the king of Aragon has neglected to do justice and has allowed the lord of Castillon to take marques on the men of the kingdom of Aragon.

Order to the seneschal of Aquitaine , the constable of Bordeaux , the mayor of Bordeaux 1 and the other king's officers that, having inspected the tenor of the attached petition of la Mota Guilhem-Arnaut de Lamothe, Darroquetalhada lord of Roquetaillade , they must do full justice to him according to the law and the local fors and customs. la Mota Guilhem-Arnaut de Lamothe, Darroquetalhada lord of Roquetaillade supplicates the king that:

  1. in these present wars, the place of Seint Machary Saint-Macaire and all its inhabitants owed a pati to him and did not pay it at the due term, so that Lamothe took as a marque an inhabitant of Saint-Macaire called Aymeron as it is usual to do in such cases in the land of Guyenne, and afterwards Lamothe's wife went from Bordeaux on water 3 with 24 pipes of wine to resupply Lengoun Langon which was then in the king's obedience, 4 Greilly when Johan de Grailly , tried to arrest Lamothe's wife and his son who was then with her, by the count of Foix 's order, 5 but he failed to do so and seized the 24 pipes of wine and put them in Cadilhac Cadillac , a place of the count of Foix, and Lamothe made a request about it but did not receive any answer.
  2. During these present wars, Lamothe with his men raided Armanhac Armagnac and he seized, among other things, a rich man, and when he went before the place of Gavarret Gabarret , a place of the count of Foix, a man called Burdeux Johan de Bordeaux with all the men of Gabarret took the said rich man with all they had seized up to an estimated value of 1,200 crowns ( escutz ). 6
  3. Subsequently, as Lamothe's men have raided through the land of Darmanhac Armagnac and have seized there 80 head of oxen and cows, the men of Mont-de-Marsan , which is a possession of the count of Foix, seized these oxen and cows by the order of the latter, up to an estimated value of 800 crowns.
  4. Lamothe requests that the king order his seneschal of Guyenne , his constable of Bordeaux , his mayor of Bordeaux and all his officers [of the duchy] to seize to the equivalent value in the city of Bordeaux goods of the count of Foix and his men of Gabarret and Mont-de-Marsan, until Lamothe recovers his losses.

The king forbids, under pain of 1,000 l. , the governor, échevins, jurats, hundred peers and community of the city of Bayonne , to levy the 2 d. per pound on all the goods passing through Bayonne brought by Englishmen and the king's liege men, and the 4 d. per pound for those brought by other foreigners who are neither English nor the king's liege men, and also to levy the tax( assisa ) of 4 d. per pound they were accustomed to take on the foreign merchants coming to the city with their goods, the king had granted to them by his letters patent. 1 For some causes presented before the king and his council in the last parliament, 2 the king has cancelled the grant of these taxes.

Calmettes is bound in various sums and obligations towards several liege men of the king and is pledge for other persons on some other sums of money to be paid at certain terms. As these sums have not been paid to creditors, Calmettes is now worried. The king does not want Calmettes nor his goods be arrested, imprisoned, or disturbed by any king's liege men of the duchy of Aquitaine.

Order to the seneschal of Aquitaine, the mayor of Bordeaux, the constable of Bordeaux, the prévôt of Bordeaux, the judges of the city of Bordeaux to release the ships of Edmund Arnald which have been arrested at Bordeaux , John Hauley the younger of Dertemuth Dartmouth , son and heir of John Hauley the elder against Arnald. They have to send to the king without delay under their seals the tenor of this complaint, and the king will examine it according to law and customs of the kingdom of England. As Edmund Arnald of Dartmouth has supplicated the king that he was bound in 160 l. to the late John Hauley the elder of Dartmouth, by a contract made within the kingdom of England and not elsewhere, and Arnald asserts he has respected his commitments, but Hauley the Younger complained falsely before the court of the city of Bordeaux as if the the contract had been made in Bordeaux.

Johanne, Preyssac, delatrau Johana de Preissac alias of La Trau , widow, 1 had informed the king several times about the great damages and spoliations she had suffered from the powerful Montferant lord of Montferrand . 2 , as trustee of his wife Ysabel, Preyssac Isabe de Preissac alias of La Trau since the death of the Saudan, Latrau Soudan de La Trau, kt , 3 He forcibly detains all the inheritance, sums of money, rights and appurtenances that ought to be owned by Johana according to the will of her father the Soudan de La Trau , 4 as well as the other inheritance and appurtenances belonging to Johana by the death of her mother Lady Rege Regina[de Pommiers] . The king had ordered to his Guienne seneschal of Guyenne and his other officers [of the duchy] to do her full justice, but they did nothing, notwithstanding the arbitration of certain wise men during a long trial when she expended a large amount of money, where the lord of Montferrand has been sentenced to the benefit of Johana, as appears by the final sentence given by these arbitrators. Johana has expended all she owned during this trial, so that she has nothing left to make a living and feed her little child. She requests the king to order to his seneschal of Guyenne and his other officers of the duchy to compel the lord of Montferrand, as keeper of Isabe de Preissac, to pay and return to Johana all her inheritance, money and possessions she should have from the inheritance of her father and mother, with all the arrears, expenses and damages she had had as a result of that. She requests the king to keep, maintain and defend her in her possession of these inheritances according to the local right and law. 5

The king orders the seneschal and the other officers that, having examined the tenor of this petition and all its articles, after summonning before them the parties and hearing them, they do full justice to Johana according to the local laws and customs, so that they provide a suitable remedy to her.

Inspeximus at the request the king's liege men of Aquitaine, of the tenor of a petition presented by them at the last parliament of Westminster , which petition has been enrolled in the rolls of this parliament. 1

The faithful liege men of the land of Guyenne make a supplication to the king and the lords of this present parliament that, because of the great oppressions, demolition of houses and destruction of goods, and disinheritances of their rightful inheritances and other rights and appurtenances, many of them have been expelled by the wars and forces of the king's enemies 2 which have lasted for a long time in Guyenne, and those desiring to keep their loyalty towards the crown [of England] have left their inheritance and goods and many of them have withdrawn to the kingdom of England , and several others have come to live there willingly, and have married there in several towns and are living and dwelling as the king's true liege men, and have acquired there various houses, lands, rents, possessions and revenues there by their hard labour and work. However, many people who were born in England do and say many injuries and evils to them day by day, such as calling them aliens ( alliantz ), and many other undesirable names. Such wrongs are committed to the great slander of the land of Guyenne and the great loyalty which it has always shown towards the crown [of England], and could lead to their permanent and final destruction, since they do not know where else to go in order to protect their lives and preserve their honour, if the king does not provide them with a remedy on this matter. The king's liege men of Guyenne request the king that all manner of people of Guyenne, whomsoever and of whatever estate or condition they may be, who at present are dwelling in your said realm, or have dwelt there, or will dwell there in future, and their heirs and successors forever, should be declared in this present parliament to be the king's faithful liege men, and that they should be able to live, sell, buy, possess and acquire lands, rents, possessions, tenements and other goods whatsoever, for themselves and their heirs and successors, within the kingdom [of England]. They should enjoy these goods as fully as the other king's liege men born within the kingdom [in England]. And they request the king to order all his justices, officers and subjects that none of his liege men of Guyenne dwelling in England will suffer any damage or impediment against their persons and goods. And if anything is done against them, the king's English officers and subjects should make amends and redress at once and without delay. The king is also requested to make proclamation in all the towns of England forbidding all the king's liege men to call the king's liege men of Guyenne aliens, or to speak any evil, injuries, or blame against them, under threat of penalty. All this should be recorded on the roll of parliament and be proclaimed throughout all the cities, boroughs and good towns of England. 3

The duke of Orléans will hold for life the Angolismen' county of Angoulême by grant and investiture of [Henry IV], king of England and duke of Aquitaine, and will do homage to the latter and his heirs, and this county will return to the king of England and duke of Aquitaine at the death of the duke of Orléans.
  27. The duke of Orléans will put into Henry IV's hands the castle of Castrum Novum super Charent' Châteauneuf-sur-Charente . And if this castle's revenues are not sufficient, the duke of Orléans will place there some captains and keepers acceptable to Henry IV, and these captains and keepers will swear on the Gospels to deliver this fortress to the hands of the king of England, his heirs or his deputies at the death of the duke of Orléans.
  28. The duke of Orléans will hold for life the Petragoricen' county of Périgord by grant and investiture of [Henry IV], king of England and duke of Aquitaine, and will do homage to this latter and his heirs, and this county will return to the king of England and duke of Aquitaine at the death of the duke of Orléans.

  30. The princes [of France] swear to Henry IV to conquer at their cost the duchy of Aquitaine.
  31. Henry IV promises to not have any agreement with Jean, duke of Burgundy. The princes swear to Henry IV to assist him against any person of the duchy of Aquitaine rebelling against him in helping the duke of Burgundy.
  32. It is agreed that [Henry IV], king of England and duke of Aquitaine, will rescue these princes, their subjects and vassals, against all affronts and damages made by the duke of Burgundy and his followers, and he will restore to them all damages and affronts made by any Englishmen.
  33. It is agreed that [Henry IV] will help the princes, at their request, with 1,000 men-at-arms and 3,000 archers which will come to Blesium Blois and the latter will receive there their wages for three months from the princes, each knight receiving 30 gold écus, each esquire 15 gold écus, and each archer 7.5 gold écus.

Barton should deal before his return to England, in his own name and the name of William Rokewode , Swinburne's other co-executor, with several debts, goods and chattels Swinburne had in Aquitaine, and satisfy the king of what is owed to him by Swinburne from the period he had the keepership of the castle of Fronsac. 2

If Johan de Homville's assertions are true, and if the goods seized pertain by right to Homville, they are to return them fully without delay to him, as well as the issues of them from the time he should have had them. Moreover, if by this inquiry it appears that these goods should pertain to the king, Homville will have these goods for life by the king's grant. The king has learned that Willelmus Arramon, Montausey Guilhem-Ramon de Montauser of the city of Bordeaux passed down by his last will all his goods, moveables and non-moveables to his daughter, his universal heiress, and later this daugther made in her will Bernat de Pinardyn her true heir as her closest heir according to law and custom of patria [...] Burdegalensis Bordelais as it is well known by legal inquiry, and that Pinardyn made, of his free will, Johan de Homville , of the region ( patria ) of Aquitaine, heir of all these goods. But the fiscal procurator [in the duchy of Aquitaine] has seized these good into the king's hands at the prompting of certain people wishing to damage Homville.
