Gascon Roll for the 15th year of the reign of Edward III in England, and the 2nd of France

Physical condition of the roll

The roll consists of 37 membranes. There are entries on all of the face sides of the membranes, but only twelve of the dorses have entries entered on them. The roll is generally in good condition, though membrane 1 is noticeably dirtier than the other membranes with staining on the lefthand marginal headings and the righthand side of the text of two entries by the application of gall. For some reason in this roll many of the entries that are orders, and which begin Et mandatum est ..., and relate to the entries immediately preceding them have been squeezed into the cramped space left between entries. These were clearly added at some time very shortly after the initial drawing up of the roll, and insufficent space had been left for them.

C 61/53 15 Edward III (1341-42)

Introduction.

This roll dates to the period immediately after the failure of Edward III’s campaign in northern France and the Low Countries, and amply illustrates that this period of warfare also impacted on Aquitaine. Indeed, although the roll contains the customary range of material relating to trade, appointments to office, justice and so on, the majority of entries concern payments to loyal supporters, and compensation for them for losses in the war, both of lands and properties, and measures to cope with the dislocation caused by the war. Always present, however, was the imminent threat of the resumption of hostilities, though major conflict was not to break out in the duchy until the campaign of the earl of Lancaster in 1345-6.

On the military side, the impact of the war is very apparent from the numerous grants made to, and orders in favour of those who had remained loyal to the king-duke, and who had lost lands, offices, jurisdictions and revenues, all of whom required some king of support. There are literally dozens of such entries, and since the revenues of the duchy were finite, and must have been severely depleted in resisting the French, and also because of the territory damaged or lost to the French and their allies, and which consequently produced nothing for the ducal coffers, the strains on the finances of the duchy must have been immense. Yet orders to make provision for those that had lost their possessions continued to emanate from the king and his chancery. The grant made to Guilhem-Sans III de Pommiers on the great custom of Bordeaux, could only have further burdened a resource already heavily drawn on. ¹ The sheer scale of these can be demonstrated by the provision made for just one individual, Johan Diés. He was owed for his wages, and for compensation for lost horses, the staggering sum of 557 l. 9 d. one ob. , and although he had been extremely lucky to obtain partial payment in England, was still owed over 337 l. , which the seneschal of Gascony, and the constable of Bordeaux were somehow to pay. ² Matters had got so difficult, that one of the former lieutenants of the king in the duchy, had resorted to paying several from his own resources. ³ Another example can be found in the treatment of the ducal minting of money. Several entries relate to this. In June 1341, Arnaut de Poyloaut was granted the profit from his own bullion or plate converted into money at the mint’s in Bordeaux or Dax. ⁴ At about the same time Bernat d’Aramits, a citizen of Dax, received a similar grant. ⁵ Also at about the same time Guilhem Baquer was to be paid the arrears of the 100 l.st. annuity that the king had granted to him, from the issues of the mint at Bordeaux. ⁶ By the 10 August Arnaut de Poyloaut received a further grant, this time of the profits of the mint, to repay a debt of 900 l.st. , part of which was owed because of money paid to the men of Bordeaux on behalf of the king for the use of ships. ⁷ Despite this grant to Poyloaut, at the same time as his grant, the king ordered that John de Lisle, the then mayor of Bordeaux, should be paid the arrears of 100 l. owed to him for his wages, from the same source, Lisle having to be satisfied before all others. ⁸ Only a few days after the grants to Poyloaut and Lisle the king made a further provision for payment on this source of funding. Arnaut III de Durfort, was to be paid 1,000 l. from the issues of the mint, once Poyloaut had been satisfied. ⁹ This was just one source of funding, but its revenues had been assigned to meet the repayment of debts long into the future, often with claimants competing for payment from the same source at the same time. And it was not just the profits of the mint that were used in the same way. Other sources of revenue, such as the various taxes on wine bought and sold in Bordeaux, were heavily burdened.

The demands were many, and not always for the most obvious reasons. Alongside the various complaints about losses, can be found the complaint of Bernat de Harambeltz, burgess of Dax, who sought compensation for three houses built outside the town walls, which were demolished in aid of the town’s defence against the French. ¹⁰ The benefits of loyalty offered the potential for extracting concessions from the king-duke. It is perhaps no accident that many of the major towns and cities sought confirmation of their rights and liberties, and the acquisition of new ones. Bordeaux received grants relating to fairs in the town. ¹¹ Both Dax and Libourne received grants to enable them to repair and improve the defences of their respective towns. ¹² . Libourne also obtained a confirmation of its liberties, ¹³ Hastingues saw the opportunity to have the location of the payment of the landing tax paid by ships coming up river from Bayonne transferred to them from Sorde, a town that had sided with the French. ¹⁴ The town of Bourg sought and was granted liberties. ¹⁵ Other towns and communities took the opportunity of confirming their relationship with the king-duke, extracting promises that their towns would remain forever annexed to the crown of England, and would never be granted away. ¹⁶ But the king could also stand firm. The request of Saint-Émilion on a matter that finds frequent reference in the Gascon Rolls, the passage of wine down the Dordogne or l’Isle towards Libourne after 11 November, was rejected because of its impact on neighbouring Libourne. ¹⁷

In the face of all of the demands on the duchy’s resources, the king and his council and administrators had to ensure that all sources of revenue were tapped. Alongside the granting of offices, and revenue raised on places still in the king’s obedience, there was a resort to places that theoretically at least were the king-duke’s lands or jurisdictions, but which were in the hands of the French and their allies. Despite this there are numerous grants on places that were not then in the king’s hands. Some of these were clearly granted with the intention that when they returned to the king’s hands, the grant would become active. ¹⁸ There was also considerable pressure placed on those who owed money to the king-duke. The seneschal of Gascony was ordered to discover whether the sizeable debt of 5,000 l.t.parv. was still owed by the archbishop of Bordeaux, and the dean and chapter of the cathedral. If they were, they were to be compelled to make payment. ¹⁹ Although it is possible to get the idea that the king-duke and his government did not fully comprehend the situation, and dispatched a steady stream of instructions that simply could not be met. We have seen in other rolls, and also on this roll that this was not necessarily the case. An order to the seneschal of Gascony and constable of Bordeaux gave them clear instructions that when they received letters which contradicted earlier grants by the king or his ancestors, unless this subsequent grant made specific mention of the earlier one, then it had not to be implemented. ²⁰

The matter of the war was evidently a difficult one. From the entries on the roll it would appear that not even the king was sure what the state of affairs was. In this roll it is possible to see the normal reminders from the king-duke to his local officials to see that the defences of the duchy were properly maintained. The seneschal was ordered to compel inhabitants who neglected the walled defence of their towns to put matters in hand. ²¹ In July the seneschal and Guilhem-Ramon, lord of Caumont, were ordered to inspect the castles and strong places of the duchy. They were to see to it that those that could be defended were to be properly provisioned, those in private hands would be kept securely defended, and those that could not be held demolished. ²² Despite the threat of demolition, new fortifications were still being permitted. The grant to Hélias de Lescours permitted him to build a fortalice near Saint-Émilion, whilst in the borderland with the Iberian kingdoms, Martin de Tartas, lord of Urtubie was permitted to build another fortalice at Urtubie, apparently as defencive protection in a volatile borderland. ²³ By mid-August matters had moved on, and seemed far close. The king was ordering the mayor or vicar, jurats, hundred peers and other men of Bayonne, that at the end of the truce, they were to harass and damage the enemy and their adherents on land and at sea, and were to prepare their ships against the French. ²⁴ But matters had again changed by September, for the king had superseded the order to Bayonne to send ships to aid him on his planned campaign. In a letter to the community of Bayonne, the apparent frustration of the king is expressed. The king had been informed that the king’s allies and other faithful people ‘wish to have an extension of the truce until Pentecost’, a view supported by the English nobility when they met with the king. The king was ‘much perplexed’ by the suspension of his expedition, since it ‘was close to his heart’. He had agreed to a truce ‘much against his own will’. ²⁵

One of the dominating issues of the roll was the trouble that the king-duke was enduring in his relations with the duchy’s second city – Bayonne. There is the normal range of business, mainly to do with the settlement of disputes with neighbours. For instance the mayor and community complained about the activities of Pey d’Albret, lord of Guiche, who had constructed a weir that impeded river passage to Bayonne, and who robbed those caught in the river obstruction. ²⁶ Similarly, the mayor and community complained of the men of Labourd, Gosse and Seignanx who, at the behest of the lord of Albret, had attacked the people of Bayonne. ²⁷ The mayor and community in their own turn were ordered to conduct themselves in a peaceable manner to the people of Labourd, admitting them to the city, and permitting them to buy and sell victuals. ²⁸ However, the real problem, which is spread throughout numerous entries, and was to lead to an appeal directly to the king-duke, concerned the king’s demands on the city in the disturbed times. Throughout the roll, the king repeatedly requested that the community send him twenty ships to aid him in his planned expedition, and there are several letters sicut alias on this. It would seem that they were never sent because the order was ultimately superseded by the truce extension with the French noted above, and that they were not sent despite repeated orders, perhaps hints at the less than friendly relations between the king-duke and Bayonne. What had become the major issue was the king-duke’s request that they temporarily set aside the customary system for the appointment of the mayor, and appoint Pey de Poyanne as a governor during those troubled times. For many in Bayonne this seems to have been acceptable, but for a group of important townsmen, many of them peers, this was not, and it would seem that there was extreme antagonism between the governor, who took for himself the title of ‘vicar’, and this group. Although it is difficult to see now whether Poyanne had genuinely overstepped his authority, or whether he had been forced to act harshly because of the intransigence of his opponents, expelling many of them from the city. The king was forced to act with a potential civil war on his hands in Bayonne, and with appeals being made directly to him. Initially Edward III, on 4 June, directed Oliver de Ingham, the seneschal of Gascony, to persuade Poyanne to give up the office and go to England, physically removing him if he was not willing, but it is clear that his actions against Poyanne, whom he had himself promoted, were as much about his needs for Bayonne shipping as about the actions of Poyanne. ²⁹ Letters directly to Poyanne followed, urged him to relinquish the office, but still requested he intercedes with the king’s liegemen for shipping. ³⁰ By the end of July, matters were still not resolved, and the king informed the community of Bayonne that measures were being taken for the safe hearing of the appeals lodged by some of their number. ³¹ By mid-August, in an effort to remove Poyanne from the scene, Edward III requested that Pey de Poyanne be sent as admiral of the ships he had requested from Bayonne. ³² However, at the same time the king was still issuing a grant to the community of Bayonne, that Poyanne’s as mayor or vicar would not detract from the city’s privileges, statutes or customs, but requesting that he be their governor or vicar. ³³ That the matter had still not been resolved by the end of the year is amply illustrated by the letters of protection granted to those in opposition to Poyanne. ³⁴ At the same time the seneschal of Gascony, or his lieutenant, was ordered to go to the city in person on the first Saturday in April, ³⁵ rectify the punishments committed by Poyanne on some of his fellow citizens, and to see to it that the customary procedure for the election of mayoral candidates was held, and he was to select the new mayor from them. The king was so concerned about this, that the custom for the election was given in full detail in the letters to the seneschal. ³⁶ Finally, in the matter of the appeal against the actions of Poyanne by a group of citizens, the king assigned the case to the hearing of Hugues de Genève, lord of Varey and Anthon, and to Antonio Usodimare, lieutenant of Niccolò Usodimare, constable of Bordeaux, to hear and determine the matter, though, as is evident from later rolls, the dispute took a considerable time to settle with appeals from Poyanne himself. ³⁷

In the matter of trade Bayonne also figures prominently. One entry concerns a long term complaint, of losses suffered during earlier reigns to the Castilians, and which should have been dealt with by agreements between the monarchs of England and Castile, but which had remained unresolved. This had concerned the making of restitution for mutual seizures at sea and other losses, and the king granted permission for the complainant of Bertholomiu de Beyries, heir and executor of Johan de Beyries. ³⁸ Another entry refers to a more recent attack by a Castilian fleet of Bayonne merchant vessels. ³⁹ In yet another entry the community of Bayonne were asked to treat the masters and mariners of the Cinque Ports kindly, to be done with the intention of mitigating the threats from the enemy on the sea. ⁴⁰ On the behalf of the merchants of Bayonne, the king also requested that the duke of Brittany, and the burgomasters, echevins and consuls of Bruges, Ghent, Ypres and Sluis would allow peaceful trading relations. ⁴¹

This roll reveals the desperate measures that the king-duke was prepared to go to to keep those important supports who had remained loyal satisfied, making financial provisions that could not possibly be fully met. But certain individuals were particularly rewarded. This is most noticeable with the extended Albret family. Bernat-Etz V, lord of Albret had served as lieutenant in the duchy, and, as has been seen, used his own assets to meet some of the financial demands on ducal resources. The king was prepared to look very favourably on Albret, taking measures to pay him money owed to him, protecting grants of land made to him, and granting offices to him. ⁴² Not only had he served the king as lieutenant, but he was called on to do further service. He was assigned to protect those going to Bordeaux to trade, he received a commission to receive former rebels back into the king-duke’s fealty, and, unusually, a record of Albret’s homage to Edward III is recorded in detail. ⁴³ A similar range of documents can be found for individuals such as Bérart I d’Albret.

Grant to Bérart d'Albret, that whereas the king lately, for his faithful service, granted to him the Podium Norman' castle of Puynormand for his life, just as is more fully contained in the king's letters patent, he now, for his good service and losses, grants to him in enlargement of the previous grant that he should hold the castle to him and his legitimate heirs from the king and his heirs by the services owed and accustomed forever. ¹

The king has ordered the exemplification of the letters by inspection of the enrolled transcript which was enclosed amongst letters of the privy seal lately sent by the king into chancery. ²

Licence granted to Curiis, de Hélias [II] de Lescours ¹ that he or his heirs are able to build in stone and crenellate a fortified house or fortalice in his land called Villa Nova Villeneuve in the Entre-Dordogne near Sanctus Emilio Saint-Émilion ² , and once built to hold the same to him and his heirs without any impediment of the king, his heirs and of their ministers. Proviso that the fortified house should be rendered to the king or his heirs at the order of the king, his heirs or their seneschals of the duchy in times of peace and anger. ³

Appointment of Guilhem Séguin son of Estèbe Séguin for his good service and for that of his father of the office of receiver of the toll of the town of Sanctus Makarius Saint-Macaire and keeper of the king's victuals for the provisioning of the Sanctus Makarius castle of Saint-Macaire for the term of ten years and beyond during pleasure on condition that he behaves well in that office, and taking 12 d.st. daily while he holds the office. Séguin had requested that the king would grant him the office, the king having granted that office to Estèbe Séguin, his father, late burgess of Burdeg' Bordeaux and Sanctus Makarius Saint-Macaire , who is now dead, by his letters patent in compensation for his service, holding the same from 10 June 1335 for the term of ten years taking 12 d.st. daily.

Order to the seneschal of Gascony, or his lieutenant, to view the following letters of the king's father, and if he is able to find that the letters and the order of the king's father were not executed, then all the goods and merchandise of the men and merchants of the Castella king of Castile that he is able to find within the duchy up to the value of 800 m.st. are to be arrested without delay, and kept safely until Berys Bertholomiu de Beyries, heir and executor of Berys Johan de Beyries , his father , has been fully satisfied, or the king orders otherwise:

Order by Edward [II] to the seneschal of Gascony, or his lieutenant, to arrest all the goods and merchandise of the men and merchants of the Castella king of Castile which he finds in the duchy up to the value of 800 m.st without delay, and cause it to be safely kept until Bertholomiu de Beyries, sole son and heir of Johan de Beyries, and executor of his father's testament, in the name of his father, is fully satisfied for the 800 m.st.

In the reign of Edward I , the king's father, there was grave discord between Sancho [IV], Castella king of Castile and his people and subjects on the one part, and the king's citizens of Baion Bayonne on the other part, concerning various robberies and seizures of goods amounting to a great sum of money by people of the king of Castile on the citizens of Bayonne, amongst whom was Berys Johan de Beyries , who is now dead, who had lost goods and merchandise to the value of 800 m.st. to such robberies as had been well attested.

Afterwards the king of Castile sent Master Juan, judge of his court , and Martini Gonzalo Martínez with letters of the king, and the mayor and community of the city sent de Villar' Arnaut Duviella and Dardir Johan Dardy , their fellow citizens, with sufficient letters and instructions to settle the dispute to the king's father. [Edward I] then ordained with these proctors' agreement, and in their presence that all the ships and other goods of the citizens of Bayonne should be restored by a certain time, long since passed, by the king of Castile to the citizens of Bayonne from whom they were taken, or their heirs or attorneys just as appears by inspection of the rolls of chancery of the king's father for his 21st year.

Afterwards, in the king's reign, Fernando [IV], king of Legio Castile and León on the occasion of further discord between his people and the citizens of Bayonne, sent proctors as did the citizens of Bayonne to the king. The king deliberating with his council on this new discord and the old one from the time of his father, ordained, with the consent of the proctors, that the first ordinance made by his father and confirmed by King Sancho should be completely and firmly observed.

Afterwards Bertholomiu de Beyries desiring the recovery of his father's goods carried the king's special letters to Fernando, then king of Castile, and to his commissary assigned by him to complete and observe the ordinances, and to the king's commissary similarly assigned, but when they met at Fons Rabidus Hondarribia , ¹ and viewed the ordinance under the great seal [of Edward I], it was found that the king of Castile's commissary would do nothing just as the king is informed by the letters patent of Sancto Paulo, de Galhart de Saint-Paul, kt , lord of Syro Céros and Master Vico Per-Arnaut de Vic , who had been deputed by the king's commissary. ²

The king has established that the letters were made by inspection of his father's letters, and accepts that they were not executed following the complaint of Beyries.

Order to Bernat-Etz [V], lord of Lebreto, de Albret that, if it is true that he, his household and supporters have committed oppressions, prosecutions, prises, arrests both of bodies and things, redemptions, woundings, and robberies against the citizens and inhabitants of the city of Bayonne, and destroyed their vineyards and other possessions and burned their houses and other things, so that they are so oppressed that they are not able to bring victuals from the lands around to the king's and the citizens' prejudice, and to their great cost and harm, he is to make amends with all speed, and see to it that the goods of the people of Bayonne are restored to them. Albret is to compel his household and supporters to comply with this so that the king does not need to act on this again. The citizens and inhabitants have requested remedy, and the king wishes to provide this and has received them into his special protection and safe-keeping. ¹

Order to the seneschal of Gascony, or his lieutenant, to obtain fuller information, with those of the king's council there, concerning the request of the mayor, jurats, hundred peers and other citizens and community of Baion' Bayonne , and he should send certification of what he finds to the king under the king's seal used in the duchy without delay together with this writ. The mayor, jurats, hundred peers and other citizens and community have shown that it is the custom in Bayonne that if anyone has killed someone and he is convicted of the crime, he will be condemned to death, but in neighbouring parts there is another custom that when a man has killed another man he can find redemption for the payment of 300 s. , because of which difference in the two customs the citizens and inhabitants are suffering under this problem in many ways, and request that the king will grant that if any of the citizens kills anyone from the neighbouring locality in the city he can find redemption by the payment of 300 s. , or that the king will lay down that those who dwell in a neighbouring locality are subject to the custom in the city, that is to death for a death without a redemption for money, so that killing can be deterred on other occasions.

Order to Lebreto, de Bernat-Etz [V], lord of Albret , that he should cause the damage and injuries inflicted by his brother and men upon the men of Bayonne to be corrected and amended without delay, and all things taken from them should be restored, and all impediments preventing the carrying of victuals and other merchandise to the city should be removed so that no further complaint comes to the king on this. The king further informs Albret that unless he acts on this the king will not be slow in providing other remedies to the citizens and merchants of the city . The king has received a complaint from the mayor, jurats, hundred peers and other citizens and community of Baione Bayonne that la Bret Pey d'Albret , bastard brother of Bernat-Etz [V], has constructed a fortalice at Gynsen Guiche and is arresting ships and boats and taking the victuals and other merchandise from them at a weir on the la Dore river Adour , and detains the men until they pay great redemptions to the intolerable damage and harm of those men, the boats carrying victuals and merchandise to the city necessary for its provisioning and for providing for the sustenance of the inhabitants there; and the bayles and other keepers of Albret at a place called Duyre Oeyre act in a similar manner taking and arresting the men until they pay redemptions, customs and tolls, though it was not customary to do so, in contempt and prejudice of the king, and to the great damage and harm of the men, and they have requested remedy.

Order to the seneschal of Gascony, or his lieutenant, to cause the Dort vicomte of Orthe , and his people of Hastynges Hastingues and Pereforad' Peyrehorade , and the bayle of Hastynges Hastingues to cease the demands and extortions that they have made on the people and merchants [of Bayonne] travelling through those places and the baylie, and they are not to compel them to pay any exactions other than those that they were accustomed to do in the past. The seneschal is to induce this to happen in any necessary way, and to stop these prejudicial things happening in the future after the injunction and warning. If they continue to do this then the seneschal is to compel them to comply, and he is to see to it that whatever has been unjustly extracted is restored to the people and merchants together with the losses that they have suffered.

The king has received a complaint, as above, that the people of the vicomte, and of those places, and the bayle are demanding customs and tolls and other unfair customs both on the men and merchants of Bayonne, and on other loyal subjects of the king travelling through those parts contrary to what used to be done. For this reason the people and merchants and others are delaying travelling with their goods and merchandise to the detriment and the great loss and damage of that city and its inhabitants and they have requested remedy, and the king is not prepared to tolerate such unjust exactions being made as this is clearly detrimental to the city.

The mayor, jurats, hundred peers and others have complained that various nobles such as the lord of Lebreto, de Albret , the lord of Lespare Lesparre and Grely Johan [II] de Grailly, Puch' captal de Buch , claim that goods and merchandise of the men and merchants, both of the city of Bayonne and elsewhere, which are oftentimes thrown up on their lands and lordships by storms pertain to them as wrecks of sea and goods lost by accident, and take the ships, the merchants and mariners in them and the wine and take it away unjustly and to the damage and loss of the citizens and inhabitants, and in breach of the liberties which the king's progenitors granted to them, upon which they request remedy.

Order to the mayor, jurats, hundred peers and the masters and mariners of the ships of Baion' Bayonne to treat kindly the masters and mariners [from the Cinque Ports] whenever they come to Bayonne, to join amicably with them for the honour of the king's business, utility and defence, and to bind themselves in allegiance and alliance with them in suitable time. The king has ordered the keeper of the Cinque Ports, the mayors, bailiffs and law-worthy men, merchants and mariners of ships of the Cinque Ports , that they enter into similar agreements with them. The king has noted the countless scandalous happenings and losses, arson and crimes, and other damage which has been sustained up until this time by the king and his subjects by the frequent hostile incursions of pirates and other of the king's enemies, and that they are still occuring. Thinking of the close friendship and allegiance between the mayor, jurats, hundred peers and the masters and mariners and the keeper of the Quinque Portuum Cinque Ports , and the mayors, bailiffs and law-worthy men, masters and mariners of ships of those ports, and every port along the coast in England, the king wishes a treaty of friendship be entered into between the mayor, jurats, hundred peers and the masters and mariners and the king's subjects in England, and observed so that this threat is defeated.

Order to Geneva Hugues de Genève, lord of Vareys Varey and Hanton' Anthon , lieutenant in the duchy , that he peremptorarily summon the seneschal of Gascony and the judge appellate , before whom the following case was being heard, to appear on 1 June next if they consider their interests to be involved, to be before the king or his council in London to prosecute the appeal brought by Bidau de Castet , Johan de Listo , Villa Arnaut de Bielle and Bisandiu Simon de Bézaudun , proctors of certain people of the community of Bayonne, which appeal came before him as king of France as well by way of petition as king of England, the king felt ought to be admitted. And, unless they appear in court, the king will proceed with the appeal without their presence. Nonetheless, the king bids them, while the appeal is pending, not to proceed against any party appealing to the king in anything, and they are to restore anything done in the meantime to its original state. They are to send what they have done in the matter to the king or his council before the 1 June, endorsed on these present letters of citation, affixing their seal to the dorse to show that the order has been carried out.

Discussion has been had on a dispute before the seneschal and judge appellate between Domenges d'Ibos , Sancto Loberio, de Ramon-Guilhem de Saint-Loubouer , Puteo, de Pey Duputs and others their fellows ( consocii ), appellants ( appellantes ) on the one part, and Castet, Listo , Bielle and Bézaudun as proctors on the other, defendants ( appellati ), and afterwards the case was devolved to the king by an appeal.

The king requests that the duke write to him on the matter by messenger.

Order to the mayor, jurats, hundred peers and others of Baion' Bayonne that at the end of the truce formerly made between the late kings of England, the king's progenitors, and the kings of Ispannia Castile for the men of the coast both of Castile and Bayonne , they are to prepare themselves to defend the king's rights against his adversaries as powerfully as possible, and will apply themselves with courage to receive retribution for pursuing the king's and their interests and honour. And because the messengers and other citizens of the city, instructed about these matters and other things for the utility, honour and common good of the city, and having explained this business to the king and council faithfully and wisely, the king commends them to the mayor and jurats; he had explained his purpose concerning secret matters to these messengers, and the mayor, jurats and hundred peers are to give full credence to what the messengers will say to them.

Amongst certain petitions of the mayor, jurats and hundred peers brought by Fabrica Arnaut de Fargues, canon of Baion' Bayonne , and other messengers , there was an article complaining that, contrary to the alliance made between those kings for the men of the coast, a huge fleet of up to 200 Castilian ships attacked a certain number of ships of Bayonne at sea carrying wine and other goods to England, capturing some of the merchants and mariners, and killing some of them, and taking most of the ships and their cargo of wine and goods, and disposed of them as they desired. And the king and his council answered this article that the truce included the men of Castile, which would end on the 24 June next, and if peace is not restored, then it will be ordained in such a way for their safety that they will be satisfied.

Order to the seneschal of Gascony that having heard the complaint of Podio Alto, de Arnaut de Poyloaut , and having called before him those who ought to be called, he should cause full and speedy justice to be done to him according to the fors and customs of there. Poyloaut has complained that Podio Alto, de Johan de Poyloaut, canon of Pampilonia Pamplona , was taken and imprisoned by the admiral of the king of Castile until he had made a fine of 1,000 rials ( floreni regales ) with the admiral for his delivery; and afterwards Johan de Poyloaut took 1,000 rials from merchants of the power of the king of Castile for that sum taken from him, and the seneschal took and imprisoned Arnaut de Poyloaut for taking the money from the merchants and unjustly detained him until he paid the constable of Bordeaux 1,000 florins ( floreni ), although Arnaut was in no way culpable of taking the money, to his great cost and harm, and he requests remedy.

This indenture attests the treaty and agreement made between Oliver de Ingham, kt , seneschal of Gascony in the king's name on the one part, and Monpoy Fauquet de Monpuy, damoiseau in the name of Insula Gaston de L'Isle, damoiseau on the other:

firstly, that l'Isle will do homage to the king and duke, or to the seneschal in his place, and will be his liege man and vassal, for him and his heirs, and will swear an oath of fealty and obedience for his life to the king and duke, or the seneschal in his place;
L'Isle is to aid the king and duke or his seneschal against all persons on this side of the sea or abroad, without any exception, when required by the king and duke or the seneschal, l'Isle being paid the customary wages;
L'Isle is to deliver the castles, places and buildings which he holds from the king and duke and the heirs of the same in fee to the king, or anyone delegated by him, as his predecessors were accustomed to do, when he will have had an order from them in times of war;
Monpuy, in l'Isle's name, for the holding and observing of the premises has promised that l'Isle will aid and follow the king and duke and his officials in England or the duchy, for his tenure in the duchy, against all men;
the king will keep l'Isle indemified for the present and future wars both in bodies and goods, as he will be able, and when there is peace or a truce, he will include l'Isle and his followers, ² in so far as they are waging war for the king by the king's order or that of his officers, and to uphold his rights;
the seneschal promises in the king's name to assign to l'Isle 1,000 l.t. of annual rent to be held from the king for the term of his life in good and suitable place in the duchy or elsewhere with high and low justice;
the seneschal has granted to Monpuy, in l'Isle's name, and to l'Isle's heirs and successors all right that he has in the bastides, places and parishes of Viana Vianne and Sanctus Julianus de Carborbiza Saint-Julien-de-Colorbisse , with their appurtenances, with both high and low justice, and full and shared jurisdiction, and other customary dues and rights which the king used to have in those places, and their baylies, in times of peace, L'Isle holding the same from the king, resort and suzereignty only excepted;
the seneschal promises to try and procure that the king will grant to l'Isle and his heirs and successors forever all right, actions and interest that he has in the inheritance, places, towns, castles, rents or other moveable goods which lately were Insula Jordan de L'Isle[-Jourdain]'s, kt , deceased, L'Isle's uncle ( patruus ), by forfeiture, condempnation and in other manners, the king retaining nothing except resort and superior jurisdiction;
the seneschal promises, in the king's name, to give and pay to Insula his wages and those of 100 mounted men-at-arms of his retinue and 500 foot serjeants or as many as l'Isle is able to find for the king's service in the present war, and in payment or part payment of those wages he should have 3,000 d. of gold called écus ( scusselli ) or the value in other money at Whitsun, or as soon as it can be done;
L'Isle is to be bound to make war on the king's enemies after fifteen days of having been paid the 3,000 d. of gold or its value in other money, and the seneschal undertakes to provide him with letters of licence on this;
further customary wages are to be paid to L'Isle from month to month in good faith and without fraud;
damages suffered by L'Isle, his retinue, riders and people, and which they lose because of the war are to be restored to them in the duchy in suitable places or in the realm of England if it cannot be provided in the duchy.

The seneschal promises to obtain the king's confirmation of all and singular of the agreement under the great seal of England.

The king accepts what has been agreed by the seneschal and confirms the contents of the agreement for him and his heirs. ³

Commission to Robert de Hardres , Henry de Valoyns , Stephen de Dolham and John de Mereworth, sheriff of Kent to buy and purvey as quickly as they are able 1,000 quarters of wheat and 150 quarters of beans in Kent where it is to the king’s advantage and to the least harm of the people, for the king’s use for his money to be paid by them or their deputies, and cause it to be carried to the Sandewicum port of Sandwich by the 7 May next; and to certify the king of the names of all those who oppose them in the purveyance, and of all their acts. The king grants that all and singular mayors, bailiffs, good men and other faithful people are to be intendant upon Hardres and the others. The sheriff is ordered that he should pay those from whom the wheat and beans has been purveyed from the money from the fines, amercements, assessments and issues of forfeitures or judgments concerning various extorsions, oppressions, harassments and excesses committed by the king’s ministers in Kent heard and determined before the king’s justices assigned to do this, which money the sheriff had been assigned to levy.

Miossens has requested that the king will wish to cause him to have satisfaction for the costs that he has been put to by the order of the seneschal and constable around enclosing the castle and town of Mauléon , and around the buying of victuals for the same, and around the sustenance of the engineers and artilliators for the provisioning of the castle, to which the king wishes to agree for the diligence of Miossens.

4 May 1341 . Westminster . For Guilhem-Amaniu de Castillon . ¹

Grant to Chastiloun Guilhem-Amaniu [II] de Castillon that he and his heirs should hold the place of Pelagrua Pellegrue with its appurtenances, with high and low justice with both full and shared jurisdiction, homages and all other things pertaining to it by the service owed and accustomed in the value of 15 l.st. per annum without rendering anything to the king forever, saving to the king superior jurisdiction and resort. The king previously granted the same to Castillon for the good service that he had done, and would do in the future, Castillon having informed the king that the value of the same did not exceed 15 l.st. , on condition that if the same was valued in excess of this, Castillon and his heirs would be bound to pay the excess to the king and his heirs, just as is more fully contained in the king's letters patent. However, by information sent to the king by the seneschal of Gascony and the constable of Bordeaux by the king's order, the value of the place is assessed at only 8 or 9 l.

Order to the seneschal of Gascony that, having viewed the respective letters of the king for Bertruc de Mestre , and for Claveria Guilhem-Ramon de Claverie, king's serjeant-at-arms , granting them each the office of the Burdeg' king's tower of Bordeaux with the custody of the prison within that tower, and if he is able to find that the possession of the same still pertains to Mestre, then the king does not wish him to be removed from the same before the end of his term, and he should be permitted to hold it according to the power and effect of the king's grant to him, the committing of the same to Claverie notwithstanding. The office is to be committed to Claverie after the expiry of Mestre's term if Claverie is still living. The king appointed Mestre to the office on 30 May 1331 for his service to the king overseas, for the term of ten years, and afterwards, for his continued good service, granted that he should have the same for a further five years just as is more fully contained in the king's letters patent. Now Mestre, by his petition exhibited before the king and his council in parliament, ¹ has requested that the king will provide indemnity to him for the office because Claverie by virtue of a grant to him of the same office for life is attempting to have Mestre removed from the office. ²

Inspeximus of letters patent of Bernat-Etz [V], lord of Lebreto, de Albret , kt , lieutenant and captain general in the duchy of Aquitaine , and Oliver de Ingham, kt , seneschal of Gascony under the seal of the court of Gascony, and the seals of the lieutenant and seneschal in these words:

16 September 1340 . Burd' Bordeaux .

Grant of Albret and Ingham to Ramon Lagut, damoiseau , for the service that he has done in the present Gascon war, and so that he will continue in the same, and having consideration of the injuries and damage that he has suffered in that service and continues to suffer of 100 l.bord. of an annual rent upon the communs ( comuni ) ¹ of the places of Moichidanum Mussidan and Sanctus Sesterus Saint-Astier which pertain to the king, by the advice and counsel of the king's council there. They further grant that he should take the same in person or by deputy by the hands of the collectors of the communes during the king's pleasure.

The king has granted and confirmed the letters of the lieutenant and seneschal, and wishes and grants that Lagut take the same for his life.

Order to the seneschal of Gascony, or his lieutenant, that having heard the complaint of Maurini Pey Maurin, citizen and merchant of Burdeg' Bordeaux upon the recovery of the sum of money for wine that he sold to Leybourn' Gerald Edward, called de Leybourne, merchant and citizen of Burdeg' Bordeaux , ¹ and on the damages which have been sustained by Maurin by the delay in payment, and he should cause full and speedy justice to be done to him just as ought to be done by right and according to the fors and customs there. It has been shown to the king on Maurin's behalf that Edward has acknowledged to have received from Maurin 49 tuns and two pipes of good wine to be carried to the port of the city of London in a ship called la Margarete of Sandwicus Sandwich of which Brige Thomas de Bridge was master, which wine Maurin sold to Edward for 65 l.st. to be paid to Maurin within two months of the receipt of the wine in the port of London just as is contained in letters under the seals of the executor of Bordeaux and of Edward, and by public instruments which Maurin has in his possession, but Edward now unjustly refuses payment to Maurin's damage and harm against the form of the letters and instruments upon which a remedy is requested for Maurin.

Grant to Johan de Béarn for his service and his losses in that service of the Saugon baylie of Saujon in Xanton' Saintonge with its issues, emoluments and other appurtenances which baylie is in the hands of the king's enemies, holding the same for the term of his life from as soon as it happens to return to the king's hands, with the proviso that on Béarn's death the baylie should revert to the king and his heirs. Béarn has requested by his petition exhibited before the king and his council that the king will wish to grant the baylie to him in recompense for his service in Gascony and Scotia Scotland , and for the loss of his horses, harness and other goods, the king having received certification of this from Oliver de Ingham, seneschal of Gascony and Usus Maris Antonio Usodimare, constable of Bordeaux , certification being made by the king's order.

Order to Oliver de Ingham, seneschal of Gascony to go to the city of Baion' Bayonne if he is able, and restore order, and if those involved in the dispute and others do not wish that Puyano Pey de Poyanne remains as mayor, then he is to persuade him to go to the king in England who will provide for his estate. He is to do this amicably if he is able, but if he encounters some reluctance or difficulty he is to remove Poyanne from this office without delay, and is to ordain for the good governance of the city with the counsel of the king's liegemen, so that the city remains faithful and secure. The king has been given to understand that there is dangerous trouble ( periculosa turbacio ) in Bayonne because Poyanne, by pretext of royal letters that requested that the jurats, hundred peers and community of Bayonne appoint Poyanne for the duration of the war without prejudice to their statutes and privileges, took the title of vicar ( vicarius ), and drew the greater part of the city to his party, and made the king's subjects swear an oath to him and not to the king, which the most powerful and rich citizens object to, and great trouble is feared.

The king orders to the seneschal that he is to permit de Villa Arnaut de Bielle , Burdeg' Arnaut de Bordeaux , Lesebay Jacmes de Lesbay , Pey-Ramon Dardy , Villa Pey de Bielle of the Port de Suseye ¹ , Villa Pélegrin de Bielle , Villar, de Arnaut Duviella , Villa Pey de Bielle , la Farga Estèbe de Lafargue , Clayrak' Bidau de Claracq , Prat, de Arnaut Duprat , Franc' Guilhem de France , citizens of Bayonne, to provide the ships that they promised for the king's war effort, receive if other mariners receive wages and victuals in the king's service, that they can appoint an admiral, and the seneschal is to aid them. They had offered to find eight to ten ships at their own costs for two months service in the war, to strengthen the Bayonne fleet, in case the king should need the fleet, provided that if the existing ships in the fleet receive wages they do so as well, and that they be allowed to have an admiral.

The seneschal is to request from the jurats, hundred peers and the community that they provide the ten further armed ships and as many galleys for the king's service for two months, which the king previously wrote to them about. The king had requested that they grant them for the two months and if the king needs them for longer, with wages and they should be satisfied with that.

Order to the seneschal of Gascony and constable of Bordeaux, or their lieutenants, that they cause 560 l.t. to be assigned to Cassanea Ramon de Cassagne, burgess of Agen , upon the lands of the king's enemies and rebels in the Vasates' Bazadais and Agenes' Agenais , having and taking the same each year until he recovers the lands and tenements that he lost, any gift, assignment or order to the contrary not withstanding; receiving from the same Cassagne his letters of acquittance, and the constable is to be discharged from the same. Cassagne has requested by his petition exhibited before the king that, whereas he has lost his lands and tenements to the value of 1,200 l.t. per annum because he has adhered to the king in the present war in the duchy of Aquitaine, and Bernat-Etz [V], Lebreto, de lord of Albret , lieutenant of the king in the duchy from his own lands and rents assigned to him 640 l.t. in part compensation of the 1,200 l.t. , that the king will wish to assign to him the residual 560 l.t. upon the lands of the king's enemies and rebels in the Bazadais and Agenais, and the king having heard laudable testimony of Cassagne's good conduct towards the king, wishes to show favour to him.

Request to Puyano Pey de Poyanne, Baion' citizen of Bayonne that he cease persisting in holding the office of mayor or vicar ( vicarius ) of Bayonne against the will of those who oppose him, and give it up to avoid greater danger for the king, and that he come to the king in person to inform the king on this matter and others, and the king will reward him considering his past and future service. The king has heard that there is serious trouble and dissention in Bayonne because of Poyanne's appointment as mayor or vicar, and the king has sent special letters to the jurats and hundred peers of the city to pacify the discord without delay, and ordain for the good governance of the city, because it is not the king's intention that the city's privileges be infringed.

The king informs Poyanne that de Villa Arnaut de Bielle , Burdeg' Arnaut de Bordeaux , Lesebay Jacmes de Lesbay , Pey-Ramon Dardy , de Villa Pey de Bielle of the Port de Suseye ¹ , Villa Pélegrin de Bielle , Villar, de Arnaut Duviella , Villa Pey de Bielle , la Farga Estèbe de Lafargue , Clayrak' Bidau de Claracq , Prat, de Arnaut Duprat , Franc' Guilhem de France had offered to find eight to ten ships at their own costs for two months service in the war, to strengthen the Bayonne fleet, in case the king should need the fleet, provided that if the existing ships in the fleet receive wages they do so as well. Poyanne is to discuss the provision of ships with the king's liegmen of Bayonne, and he is to induce them to aid the king further with ten ships and a similar number of galleys too. The king asks to be excused for not observing the agreement with Poyanne, and that what he cannot afford at the moment will be fulfilled in the future.

Order to the constable of Bordeaux that having viewed the bills that Porut Pey de Pourrut, burgess of Sanctus Severus Saint-Sever has for his wages and those of his men, and having accounted with Pourrut or his attorney for the same, he should make payment to him of what he is able to find is owed from the issues of the duchy as quickly as he is able; receiving from Pourrut his bills and the constable will have due allowance in his account. Pourrut has requested that the king will wish to make payment to him of various sums of money that the king is bound to him for his wages and those of his men whom he retained in the king's service for the garrison and defence of the town [of Saint-Sever] against the French enemy, and from the time that he and his men were in the king's service elsewhere in the duchy, just as appears by bills under the constable's seal that he claims to have in his possession, and the king wishes to agree to the request. ¹

Confirmation to Gout, Bascul Arnaut-Gassie de Got, called the Basque, lord of Podium Guillelmi Puyguilhem for his good service of the grant and assignment made to him by Bernat-Etz [V], le Breto lord of Albret and Geneva Hugues de Genève, lord of Varrai Varey and Hantona Anthon , lieutenants and captains general in the duchy, and by the seneschal of 110 l.st. in part satisfaction of the 200 l. annuity which the king granted to Got. For the great service that Got has done to E[dward II] and to the king in the wars in the duchy, and for the damage and harm that he has suffered in his castles, lands and vineyards which are destroyed and consumed, the king granted to him by his letters patent the Herbefaver prévôté of Born, Labouheyre, and Mimizan with all its appurtenances in relief of Got's estate, without rendering anything to the king, until the king ordains otherwise for his estate. Subsequently, the king, for Got's service to the king and his progenitors, granted that he should hold the same prévôté for life unless the king for legitimate reasons touching the king and his duchy will order it to be assigned elsewhere, which if it happens, the king grants to Got that, in place of the prévôté, he should take each year 200 l.st. for life from suitable places in the duchy to be assigned to him by the king or the seneschal, just as is more fully contained in the king's letters patent. And afterwards by an indenture made between Oliver de Ingham, seneschal of Gascony on the one part, and le Breto Matha d'Albret, lady of Montenak' Montignac and of Gensak Gensac on the other, as part of the agreement contained within it the prévôté or baylie of Born, Labouheyre and Mimizan and other lands in the duchy were granted to Matha d'Albret and her heirs forever for other lands and places that she gave to the king. And because lord d'Albret, as brother and heir of Matha d'Albret, by virtue both of the king's letters to Matha, and the seneschal's letters in the king's name to Bernat-Etz, had the prévôté with other places and castles, lord d'Albret and Genève, lieutenants and captains general in the duchy, and the seneschal, at the request of Got for the 200 l.st. each year which the king promised to grant to him for his life should he ever be removed from the prévôté, assigned to him in part satisfaction of the 200 l.st. , 50 l. from the issues of the prévôté or Baione castellany of Bayonne each year for Got's life by the hand of the prévôt there or his lieutenant, and 60 l.st. from the Aquis prévôté of Dax , which prévôté Got was to hold in person or by proctor or attorney for his life with all high and low justice with both full and shared jurisdiction, rents, rights, customary payments and appurtenances pertaining to it just as appears by the king's letters patent under the king's seal of the court of Gascony and the seals of Albret and Genève.

Order to the seneschal of Gascony and constable of Bordeaux that having obtained fuller information with those of the king's council of those parts and others whom they wish to call as to the damage or prejudice to the king or anyone else and what damage that will be if the king grants the request of the mayor, jurats and community of Aquen' Dax , they are to send certification of what they find to the king under the king's seal used in the duchy without delay together with this writ. The mayor, jurats and community have requested that the king will wish to grant that all the citizens, merchants, neighbours and inhabitants of the city be quit of the payment of the toll called the great custom ( magna custuma ) received for wine at Burdeg' Bordeaux for the great sums of money that they have expended around the fortification and enclosure of the city both with walls, ditches, barbicans, bride , ¹ springalds and other necessaries for the defence of the city against the attacks of the king's enemies, without any subsidy from the king or elsewhere.

Order to the seneschal of Gascony and constable of Bordeaux that having obtained fuller information of all and singular touching the request of the mayor, jurats and community of Aquen' Dax and the value of the toll of Dax, they are to send certification of what they find to the king under the king's seal used in the duchy without delay together with these present letters so that upon viewing the same the king and his council can consider what ought to be done. On the behalf of the mayor, jurats and community it has been requested that the king will wish to grant for the term of 40 years the toll that the king has been accustomed to receive in the city of Dax which is valued at no more than 24 l.st. per annum in aid of their expenses in the repair of the ancient walls and towers of that city, and building of new walls outside of the old ones in parts of the city which used to be enclosed by a pale, for the salvation of the city, and so that it was better able to resist the king's enemies.

Order to the seneschal of Gascony that he should cause high and low justice in the parishes of Illatz Illats , Lassatz Louchats , Gilouz Guillos , Braks Brax and Sanctus Michael de Ripa Frigida Saint-Michel-de-Rieufret to be delivered to Sancto Simphoriano, de Johan de Saint-Symphorien, lord of Landirans Landiras , son and heir of Sancto Simphoriano, de Galhart de Saint-Symphorien , with rights, liberties, emoluments and profits pertaining to that justice in those parishes, according to the letters of the king's father to Saint-Symphorien's grandfather, and the king's confirmation to Saint-Symphorien's father, reserving the justice in the Ousten' parish of Hostens to the king and his heirs, notwithstanding gifts, assignments or confirmations made by the king or his ministers in the duchy of Aquitaine to Andriu [I de Budos], lord of Budos , or others of the parishes after the making of the confirmation by the king to Saint-Symphorien's father and his heirs. Now Johan de Saint-Symphorien has requested that the king will put the confirmation into execution because Galhart, his father died in the king's service before it could be done, and the king for Johan de Saint-Symphorien's laudable service to the king, both overseas and in the duchy, wishes to agree to the request.

Grant for life to le Breto, de Thomas d'Albret of all the lands with appurtenances which were Monlawe Bertran de Montlau's , enemy and rebel of the king, which lands were confiscated into the king's hands because of Montlau's adherence to the enemies of the king, on condition that after Albret's death the same land should revert to the king and his heirs. Foussat has requested that the king will wish to make payment to him for the various sums of money that the king is bound to him in for his wages and those of his men, mounted and on foot, from the time that they stood in the king's service in the wars in the duchy just as appears by various bills under the seal of the constable which Foussat has in his possession.

Grant to the mayor, jurats and worthy men of Aquen' Dax , for their constancy and loyalty to the king and his house, disregarding personal danger and detriment to their goods, that the city, high and low justice with both full and shared jurisdiction, lordship, homages and fealties of the city or jurisdiction pertaining to the city and Aquen' prévôté of Dax will not by put out of the king's hands by sale, gift, or exchange, except to heirs of the king of England, and nor will he grant superior justice to anyone, but justice relating to the city will wholly be reserved to the king in the special royal chamber.

Order to Oliver de Ingham, seneschal of Gascony or his lieutenant that he, by all means that he considers appropriate according to the customs of those parts inquire as to whether the three houses of Arrampz' Bernat de Harambeltz, burgess of the Aquens' city of Dax lately built outside of the walls of the city abbutting the gate were demolished, for what reason it was done, and what they were valued at before demolition, and what other damages Harambeltz has suffered because of this, and he should send certification of what he finds to the king in chancery under the king's seal used in the duchy with all speed that he is able so that the king is able to compensate him of what he ought by right to have. Harambeltz has requested that the king will wish to satisfy him for his losses and damages as the three houses were demolished by order of Ingham and Berne, Lespes Bernat de Béarn, called l'Aspès , captain of the city of Dax for the fortifying and security of the city against the enemy, and Harambeltz has inccurred losses as a consequence amounting to 68 l.st. , and the king wishes to be certified on the matter.

Order to the seneschal of Gascony and the prévôt of the Umbraria, Burdeg' Ombriére of Bordeaux that having heard the complaint of la Rook Guiraut de Laroque, merchant of Vascon' Gascony , and having obtained fuller information upon the taking of the ship carrying his wine by all ways and means that they are able, they should do full and speedy justice to Laroque just as by right and according to the customs of those parts ought to be done. The king has received complaint from Laroque that he had put 58 tuns of wine of Rabasteyns Rabastens in a ship called Sanctus Johannes whose master was Martin Esmerillion at Burdeg' Bordeaux to be carried to Flandr Flanders , and that Mannyng' Robert Manning of Dertemuth' Dartmouth and certain other malefactors by force and arms boarded the ship when it was anchored in the Gerond' Gironde ¹ and took the ship and wine to Cork in Hibern' Ireland and sold the wine to Laroque's great damage and to the impoverishment of his position, for which he has requested remedy, and the king wishes justice to be done in the recovery of the wine and his damages.

Order to the constable of Bordeaux that having viewed the letters that de la Forest Jaufré de Laforêt has, and having obtained fuller information, if he is able to find that Laforêt was captured at the fall of the Blavia town of Blaye , and lost horse, harness and other things to the value of 247 rials ( floreni regales ) and has not received anything for them, then he should pay Laforêt the same sum from the first money that comes into his hands from the issues of the duchy, receiving from Laforêt the letters and his letters of acquittance attesting to the receipt of the money, and the constable will have due allowance in his account. Laforêt has requested that the king will wish to satisfy him for those losses that he sustained when he was in the company of Lebreto, de Bérart [I] d'Albret when the town of Blaye was taken by the king's French enemies, ¹ which losses amount to 247 rials as is attested by letters under the seal of the seneschal of Gascony that Laforêt has in his possession.

Grant by Albret, Genève and Ingham to Ferroll' Guilhem Ferréol, damoiseau for the good service that he has done and in future will do, and also because he came to the king's obedience voluntarily and on account of this is exposing himself to danger and loss, of the fourth part of Villa Francha Villefranche[-du-Queyran] to Ferréol which he had had by reason of a gift made by Ferroll' Estèbe Ferréol, lately deceased , his uncle ( advunculus seu papo ) with high and low justice with both full and shared jurisdiction of the same; saving the usufruct of the same to Guilhem Ferréol's father; and also the baylie of Villefranche with all high and low justice with both full and shared jurisdiction ( merum et mixtum inperium ac alta et bassa juridicio ) in Villefranche and its appurtenances which the king and duke has, and is accustomed to have, as advised by the king's counsellors. He is to hold all of the same in person, or by a deputy, all usurpers being removed, for as long as it is the king's will and that of the grantors.

For the good service of Ferréol the king confirms the grant of Albret, Genève and Ingham, and grants that he should have the same for his life, gifts made or to be made to the contrary notwithstanding.

The lord of Thouars has requested that the king would retain his lordship of Thouars and the inhabitants of the same place in the king's possession with appeal ( resortum ) to the seneschalcy of Agenais, and that he and his lordship and the inhabitants in the same be exempted from the jurisdiction of the Vyane, Viane bastide of Vianne or to any other town or bastide, since the place of Toars Thouars and the inhabitants of the same of the lordship of the lord of Thouars and his ancestors, have from time out of memory made appeals to the bastide of Vianne, but the same bastide has now been granted to Insula Gaston de L'Isle by the king.

Grant to Gordonis Guilhem Gourdon of Burgum Bourg , king's clerk , that the 12 d.st. a day or the value in other money that the king previously granted to Gourdon during pleasure to be taken from the issues of the duchy of Aquitaine for the sustenance of Gourdon, his father, mother, brothers and sisters until provision can be made for Gourdon to take the same sum from any office or baylie at the king's will, should be taken, as long as Gourdon conducts himself well towards the king or until provision can be made for the sum to be taken from and office of baylie. Gourdon had requested that the king would make some provision for him and his family since they relinquished their houses which they had in the Burgum town of Bourg after the time that the town was taken by the king's French enemy because they wished to remain loyal to the king, and they came to Burdeg' Bordeaux and did not have anything to sustain them. The king granted the 12 d. for the great costs and labours that Gourdon had sustained in the king's service, and now revises the grant for the good and great service that Gourdon has for a long time done and in the future will do. ¹

Order to the seneschal of Gascony that having called before him the king's procurator and the Sanctus Emilio mayor and jurats of the town of Saint-Émilion , and having heard the complaint of Greyliaco Pey [II] de Grailly , vicomte of Benaugiarum Benauges and Castellion Castillon , upon the injuries done to him concerning claims to jurisdiction in the place of Perefita Pierrefitte , and having taken full advisement with the king's council of those parts he should do full justice in the matter just as by right and according to the fors and customs of thos parts ought to be done, the letters surreptitiously obtained by the mayor and jurats or other things not withstanding. On the behalf of Grailly it has been shown to the king that Grailly ought to have, and he and his predecessors as vicomtes were accustomed to have from time out of memory, all high and low justice with both full and shared jurisdiction in the place of Pierrefitte which is in the jurisdiction of the vicomté within the honour and power of Castillon, and the king's procurator and the mayor and jurats, by the pretext of certain letters obtained by the mayor and jurats, alleging that Pierrefitte is in the jurisdiction of the Sancto Emilio, de town of Saint-Émilion propose to remove Grailly from possession of the jurisdiction in Pierrefitte, although a plea is pending between the parties, and the vicomte is daily harrassed and disturbed in his possession of the jurisdiction, by which the vicomte has requested that the king will revoke and annul the letters which were unjustly obtained in his prejudice.

Commitment of power to Jebennis Hugues de Genève, lord of Varey Varey and Hanton' Anthon and Usus Maris Niccolò Usodimare, constable of Bordeaux , or their lieutenants, to hold the case and proceed properly in the appeal concerning Jacmes de Lesbay in the duchy, and in a suitable place, and to cancel what has been done since the appeals and restore it to the state it was in beforehand, and to determine the appeals, and granting sufficient coercive powers to do this. The king has received Lesbay's complaint that an ordinance was made by the Baion' mayor of Bayonne that each ship of Bayonne carrying wine to England ought to return to Baion' Bayonne charged with corn under a certain penalty; and afterwards Ansete, de Martin d'Anzieta, master of a ship called la Dieulagard of Bayonne , ignorant of the ordinance, came to England to Bristoll' Bristol , and discharged his cargo of wine and charged it with the king's wool by the king's order and sailed to Burdeg' Bordeaux with the wool. The mayor of Bayonne demanded 200 m.st. from Lesbay, the owner of the ship, because the ship, according to the ordinance, had not returned charged with corn, and arrested Lesbay and detained him in the Baion' castle of Bayonne . Lesbay appealed to the seneschal of Gascony on account of default of justice. Afterwards, and contrary to Lesbay's appeal made to the seneschal of Gascony on account of the default of justice, the mayor wishing to delay the appeal prohibited his notary, upon the pain of losing his office from allowing instruments relating to the appeal to be delivered to Lesbay in Lesbay's prejudice, and in contempt of the king's court of Gascony. And then the mayor, to labour Lesbay in obtaining his justice, put an appeal into the king, and got a citation against the king's seneschal and judge in Gascony and against Lesbay to appear before the king on 1 June. And because, in such cases it is not usual to appeal to the king's hearing, and because the seneschal and judge, and Lesbay cannot leave the duchy and appear before the king, because of the war without great danger, Lesbay has requested a remedy.

Order to the seneschal of Gascony and the constable of Bordeaux or their lieutenants that they should diligently discuss the request of Ferandi Bernat Ferrand concerning land in Bordeaux with those of the king's council of those parts whom they consider most suitable and knowing the truth of the matter, and if they find that an exchange is more beneficial to the king than restoring the land to Ferrand, then the king commits full power to them to put the exchange into effect according to the customs of those parts or otherwise to restore them. Ferrand has requested that the king will restore to him or make an exchange with him for certain pieces of land in the Burdeg' town of Bordeaux adjoining the walls of the castle of the town which he held from the king in fee and in inheritance which John Travers, late constable of Bordeaux , when he was constable took into the king's hands for certain reasons and built houses on them with the king's money, Ferrand having requested to the seneschal and constable for restitution for them or an exchange for other pieces of land or rents in any other part of the duchy in pertpetuity, but the seneschal and constable did not wish to do so to Ferrand's great damage and disinheritance.

Grant to Dasta Forti Guilhem d'Astaffort for his good service which the king has heard from praiseworthy sources, and for the service that he will do in the future, and in recompense for his damages and injuries, that he should take, in person or by a deputy, 300 l.t. a year for his life from the issues and profits of the parts of Montjoye Lamontjoie that pertain to the king, and from the goods of rebels now existing in the king's hands. And in case that the same issues and profits of Lamontjoie and the goods of rebels are not sufficient to make the annual payment, or the goods of the rebels are afterwards restored by the king's grace or otherwise no longer pertain to the king, the deficiency in the payment is to be taken from the issues and profits of that part of Valence in the Agenn' diocese of Agen which is the king's, or upon the Podium Mirolli baylie of Puymirol , receiving this for life, gifts and ordinances to the contrary notwithstanding. If the issues of Lamontjoie, or of Valence and the baylie of Puymirol exceed the sum of 300 l.t. , Astaffort is to answer annually to the king for the surplus.

Bernat-Etz [V], lord of Lebreto, de Albret , kt and Geneva Hugues de Genève, lord of Varroi Varey and Hanton' Anthon , kt , lieutenants in the duchy, and Oliver de Ingham, seneschal of Gascony had found out that Astaffort had come into the king's service willingly, and had behaved loyally to the king, losing his father's house for his adherence, and the Brulhesium archdeaconry of Bruilhois , and the church of Dunes , valued each year at 300 l.t.parv. , they granted to him that he should take in person or by a deputy each year for his life 300 l.t. from the issues of the custom of Bordeaux in part compensation for his service and the goods that he had lost, just as is more fully contained in their letters patent made under the seal of the court of Gascony, and the seals of the lieutenants, in favour of Astaffort.

Astaffort has claimed that the customs of Burdeg' Bordeaux are so charged with assignments that they are not sufficient for him to be paid, and has requested that the king grant to him that the sum can be taken annually for his life from the issues and profits of the parts of Lamontjoie in the diocese of Condom which pertain to the king, and from the goods of Filartiga Diairois de Filartigue, wife of Forces Huc de Fourcès , Laryvau Bertrana de Laribau, wife of Podio Guiraut Dupuch and la Farge Johan de Lafargue , the king's rebels then in the king's hands; and if the issues and profits, and the goods are not sufficient for the payment of the sum, or the goods of the rebels are afterwards restored to the rebels or no longer pertain to the king, would the king grant that the deficiency be taken from the issues and profits from those parts of Valence which pertain to the king, or from the baylie of Puymirol, if those of Valence are still insufficient for the payment of the sum, once those places come into the king's hands.

Order to the seneschal of Gascony and the constable of Bordeaux or their lieutenants that they should make payment to Dyens Johan Diés or his attorney of 337 l. 7 s. 9 d. ob. st. and 60 l.bord. from the first money or other goods sent by the king to the duchy, or make satisfaction in another manner, any order or ordinance to the contrary notwithanding; receiving from Diés those bills that he has for the same, and also his letters of acquittance, and the constable will have due allowance in his account. Diés has requested that the king will wish to make payment to him for various sums of money amounting to 557 l. 9 d. one ob.st. and 60 l.bord. in which the king is bound to him for his wages and restaur of horses lost in the king's service from the time that Diés stood in the king's service in the king's war in the duchy of Gascony just as more fully appears by letters under the seal of the constable which Diés claims to have in his possession. 1.: The Soule was divided into three messageries ( messadgeries in Gascon), the Haute-Soule (in Gascon Sole Sobiran ), the Arbailles and the Basse-Soule or La Barhoue (in Gascon Sole Jusan or La Barhoa ). This latter, composed of 27 parishes, was itself divided into the three dégairies ( degaeries in Gascon) or vics of Aroue , Laruns and Domezain . Each of the messageries was headed by a messager ( messadgé in Gascon) which was a justice official who applied the judgments of the court of Licharre , the representative assembly of the men of Soule. Vidimus of Oliver de Ingham, kt , seneschal of Gascony of letters patent of Prince Edward, firstborn son of the king of England ¹ of certain privileges written in the letters, Ingham having seen, read, held and touched the letters ( vidisse, legisse, tenuisse, palpasse ) which were under the great seal of the prince in green wax which is true and whole and appended by a cord of green and red silk to the letters, the letters not being cancelled in any way and being beyond doubt, in these words:

29 September 1270 . Vallis Viridis Vauvert .

To the archbishops, bishops, abbots, counts, barons, justiciars, vicomtes and all bayles and faithful subjects.

Grant by charter to the burgesses of the town and port of Leybourn' Libourne that they should have a commune in the town with all the liberties and free customs that pertain to the town of the following:

item, that the burgesses are able each year to select twelve jurats, and those jurats each year should select two law-worthy men from their community for the mayoralty, the jurats being selected on 21 July, the two candidates for the majoralty on 22 July, and the two men are to be presented on 23 July, in the castle of Bordeaux, to the seneschal of Gascony, or his lieutenant, or the constable of Bordeaux; and the presentation having being made, either the seneschal, his lieutenant or the constable are to appoint the mayor, but if the seneschal, lieutenant or constable fail to do this on 22 or 23 July, then the jurats can appoint the mayor that they choose themselves from the two candidates to govern for a year, and this is to be done in perpetuity;
item, that the town of Libourne should remain in the hands of the king of England in perpetuity such that at no time it should leave his hand or demesne( de manu nec de mensa );
item, that the burgesses, present and future, and their goods in the town of Libourne should be free from all customs due to the king or his heirs entering, in coming to, leaving and residing in the town;
item, that they should not be bound to do military service ( excercitus ) except in the Burdeg' diocese of Bordeaux , and in the Vasaten' diocese of Bazas , and that they and all their goods should be quit and free throughout all the king's lands of England, Ireland, Wales and Scotland from all new customs put in place there;
item, that each member of the community of the town should contribute towards the costs and expenses made for the community and town just as is assessed by the mayor and jurats;
item, that the burgesses should not be distrained in the area of the king's authority for another man's debts unless they are pledges or capital debtors ( debitores capitales ) so long as they are ready to stand trial with their creditors before the mayor.

The king confirms the liberties, customs and privileges granted to the burgesses by his grandfather, and just as they have used them since the making of the grant, and for their loyalty and for the losses and expenses that they have sustained, the king grants that neither the town of Libourne, its jurisdiction nor its rent should be alienated by sale, gift or exchange out of the king's hands, except to future heirs of England. ²

Order to the constable of Bordeaux that having viewed the letters of Fargos Assaut de Fargues , if he is able to find that the king owes him 1732 l. 12 s.bord. for his wages, then he is to make payment to him for the same without delay from the issues of the duchy; receiving from Fargues the letters that he has, and his letters of acquittance attesting to the payment, and the constable will have due allowance in his account. Fargues has requested that the king will wish to make payment to him for that sum in which the king is bound to him for his wages from the time that he stood in the king's service in the duchy and elsewhere as is attested by letters patent of the seneschal of Gascony that Fargues has in his possession, to better maintain him in the king's service, and the king wishes to agree favourably to the same. ¹

Grant for life to Cassanea Ramon de Cassagne, burgess of Agen for the damage, injuries and harms that he has sustained because of his adherence to the king, and for his good service, of Agulons Aiguillon , Monjoy Lamontjoie , Salvitas Saberas La Sauvetat-de-Savères with their lands, rents, tolls, homages, high and low justice with both full and shared jurisdiction ( merum et mixtum imperium, jurisdictio alta et bassa ) and all their other appurtenances which are now in the hands of the enemy from as soon as they shall return into the king's hands, any gifts, assignments or orders to the contrary notwithstanding, on condition that after Cassagne's death, the places should revert to the king and his heirs. Cassagne has requested, by his petition exhibited before the king and his council, that the king would wish to grant him those places in recompense for his damages, injuries and harm that he has sustained by his adherence to the king in the present war in the duchy of Aquitaine, his brother German ¹ and certain other kinsmen and many others of his household having been killed, and his wife and children and certain others of his friends having been imprisoned, where they remain, and his goods and possessions having been destroyed by the king's enemies and rebels.

Order to the seneschal of Gascony and the constable of Bordeaux to accounted with Ramis Bernat d'Aramitz, citizen of Aquen' Dax , for his wages and his losses, and assign to him and cause him to have a moiety of the emoluments from the striking of coins from bullion or plate brought by Aramitz to the king's exchanges ( cambia ) of Burdeg' Bordeaux and Aquen' Dax , and he is to receive the same until he is fully satisfied for what is owed to him; receiving from Aramitz any bills and letters if he has them, and his letters of acquittance attesting to the payment of the same, and the constable will receive due allowance in his accounts. Proviso that the king's exchanges and mints in the cities should not in any way be impeded by this grant. Aramitz has requested that the king will assign the moiety of the emoluments in payment to him of the various sums of money that the king is bound to him both for his wages from the time that served the king in the war in the duchy, and for restoration of certain damages that he sustained in his goods and property on occasion of the war, and the king wishes to agree favourably to the same. ¹

Order to the seneschal of Gascony and constable of Bordeaux or their lieutenants that having obtained information of the true value of the Port Bertrem barony of Portes-Bertrand and other places which Andriu [I], lord of Budos has lost, and of the damages and losses sustained by him by his adherence to the king, and having also informed themselves of the value of the Bersacum prévôté of Barsac , the Damasan baylie of Damazan and the land of the place of Veyrines with all their profits and emoluments, rights and appurtenances by the ways and means that they are best able, they are to cause the prévôté, baylie and land to be assigned to him for as much annual rent as they are able, the lord of Budos holding the same until he recovers his barony and places, any order or assignment on the same made by the king or others contrary to this notwithstanding. If the prévôté, baylie and land are not of the same value of the barony and other places that the lord of Budos has lost, then they are to make an assignment in as suitable place to make up the deficiency. The lord of Budos has requested that the king will wish to grant him the prévôté, baylie and land in recompense for the barony and other places both outside and inside the duchy which are to the value at 375 l.st. per annum which he lost because of his adherence, and the king having heard testimony of the lord of Budos' good conduct towards him wishes to agree to the request. ¹

Filartigue has requested that the king will to pay him the 50 gold rials that he is bound to him in for the restaur of certain horses lost in the king's service as more fully appears by certain bills under the seal of the constabulary which Filartigue has in his possession.

Order to the seneschal of Gascony that he should do full and speedy justice to Tuscanan Johan Toscanan and Arnaut [Toscanan] his brother with as much favour as he is able upon the recovery of their inheritance. Toscanan and his brother have requested full and speedy justice concerning the inheritance of Johan de Saye their uncle , since their uncle by his testament made them his heirs to all his goods moveable and immoveable should he die without children, and after his death without legitimate children Sancto Symphoriano, de Hélias de Saint-Symphorien occupied the place of Palugandru which was part of Saye's inheritance and detains it though he has no right to it, against the fors and customs used in Burdeg' Bordelais to the brothers' manifest prejudice. ¹

Order to the seneschal of Gascony and the constable of Bordeaux that they should desist from making all manner of wrongful exactions, levies and collections in the Libornia town of Libourne , and that they should permit the mayor, jurats and burgesses of that town to use and enjoy the liberties and privileges which they and their ancestors were accustomed to use and enjoy without impediment, and they should not be harmed against the form of their privileges. On the behalf of the Libornia mayor and jurats of the town of Libourne it has been requested that the king will wish to provide them with a remedy concerning their complaint that, although it was granted to them by Edward I by a charter that the burgesses and all their goods should be free from all customs and impositions due to the king and his heirs in the town of Libourne and in all the duchy of Aquitaine and elsewhere within his lordship with all their merchandise and other things entering into, remaining in or departing from the town, and have continued to enjoy the same since the grant, the seneschal, constable, Lebreto, de Bernat[-Etz V] d'Albret and Geneva Hugues de Genève , the king's lieutenants in the duchy have levied from each burgess of the town 10 s. from each tun of wine brought from the parts of the country in the hands of the French to the town during the truce, and also various tolls due to the king and certain other nobles by reason of the Burgo town of Bourg , which impositions were not levied previously but are new and are wrongly collected and levied from the burgesses to their great cost and against the form of their liberties.

Order to Oliver de Ingham, seneschal of Gascony , that he is not to proceed in the matter concerning the request of the burgesses of Sanctus Emmilianus Saint-Émilion that no wine in any year should proceed down the Dordoigne Dordogne or Lile l'Isle towards Libornia Libourne before 11 November (Martinmas), without first having called the king's procurator and the men of Liborn' Libourne , and heard and considered their arguments. The burgesses had lately made the request, and the king recollects that he had made an order to the seneschal to examine to whose prejudice this would be if was granted. The king now realises that the grant would be to the prejudice and damage of the king's people of Libornia Libourne . ¹

Grant for life to Master Ferant Bertran Ferrand, king's clerk for the service that he has done to Edward II and to the current king, and for his future service, and also for his losses, imprisonment and other injuries that he has sustained for the king of which the king has received laudable testimony, of his fee of 100 l.t.parv. and also his wages of 20 s. a day wherever he is in the duchy. Ferrand has requested that the king would confirm the grant of the fee and wages made to him by the seneschal of Gascony when he retained him for the king's council in the duchy of Aquitaine.

134: 3 June 1341 . Turris London' Tower of London . For the community of the city of Bayonne .

Request to the Baion' jurats, hundred peers and the community of Bayonne , the king being aware of their signal service to his royal house and wishing to maintain unity, that they will take steps to put an end to the present discord, and informing them that it is not the king's intention to do anything to curb the privileges of the city. The king further requests that they choose a suitable person as mayor as they did before the war, and instructs them not to obey anyone against the privileges of the city, but see to it in every way that the city is safe as it has always been in adversity, and the king hopes to repay them. The king has written to Poiano, de Pey de Poyanne , whom the king wished to serve as mayor for the duration of the war, that he is not to govern without the consent of the appellants and the whole community.

Villa, de Arnaut de Bielle , Burdeg' Arnaut de Bordeaux , Jacmes de Lesbay , Pey-Ramon Dardy , Villa Pey de Bielle of the port of Suseye , Villa Pélegrin de Bielle , Villar, de Arnaut Duviella , Villa Pey de Bielle , la Farga Estèbe de Lafargue , Clayrak Bidau de Claracq , Prat, de Arnaut Duprat and Franc' Guilhem de France , their fellow citizens have offered to find, at their own expense, for two months for the war eight to ten armed ships to relieve the city’s fleet in case the king needs to have the fleet away from the city for a time, so that if others receive wages and victuals for their ships for their service, they are to receive them for their own ships. The king requests that they consider the difficult times facing him, and that they will grant to him ten other ships and the same number of armed galleys at their expense for two months, and at the end of two months he will pay them the wages they are owed if they are still in the king's service. The king does not wish that they are disturbed, and states that if he doesn't retain the agreements lately entered into by his council and Poyanne and other of their fellow citizens in every particular, which he could not easily do now, but if God grants that the king prosper, he will see to it that they are rewarded and will rightly be contented.

The king considered the good standing in which Poyanne, their fellow citizen, has been held, and hoping to provide for the governance of the city in the troubled times, and remembering that he had particularly asked that they see to it that Poyanne was appointed as mayor for the duration of the present war, it was not the king's wish to take away their privileges and rights, after the end of the war, to choose a mayor each year as was usual. And the king understands that now Poyanne, using as a pretext the king's request, has, with the connivance of others, taken over the governance of the city against the wishes of the leading citizens, calling himself vicar of the city ( vicarius civitatis ) and has compelled the people to swear an oath not only to the king, but to himself against normal practice, causing grave disturbance in the city which, unless swiftly quelled, will put the city in grave danger.

Order to the constable of Bordeaux that having accounted with Sancto Symphoriano, de Johan de Saint-Symphorien, Landirans lord of Landiras , son and heir of Sancto Symphoriano, de Galhart de Saint-Symphorien, late marshal of the king's army in the duchy of Aquitaine , he should make payment of the sums of money that he finds are still due to Saint-Symphorien's father from the issues of the duchy if prompt payment can be made to him from them, or from the money that the king is sending to those parts, or otherwise by assignment on the issues of the Sancta Fides baylie of Sainte-Foy[-la-Grande] in Agenes' Agenais ; receiving from Saint-Symphorien his letters and bills if he has them, and his letters of acquittance attesting to the payment of the sums, and the constable will have due allowance on his account. Saint-Symphorien has requested that the king will wish to make the payment ordered to be made to his father to him, since the king ordered payment to be made to Saint-Symphorien's father for various sums of money that he was bound to him both for his wages and those of his men, both mounted and on foot, and for restaur of horses lost from the time that he stood in the king's service in the Gascon wars from the issues of the duchy, or the money sent to the duchy, or from the issues of the bayie, but Saint-Symphorien's father died before payment could be made, and the king wishes to agree favourably to Saint-Symphorien's request.

Order to the constable of Bordeaux that having accounted with Aylhano, de Amaubin d'Aillan for his wages and those of his company and for restaur of horses, he should make payment to him of the sums of money that he finds are owed from the issues of the duchy if prompt payment can be made to him from them, or from the money that the king is sending to those parts; receiving from Aillan his letters and bills if he has them, and his letters of acquittance attesting to the payment of the money, and the constable will have due allowance on his account. Aillan has requested that the king will wish to make payment to him for various sums of money that the king is bound to him in for the wages of him and his company from the time that he stood in the king's service in the Gascon war, and for the restaur of horses lost in that service, and the wishes to agree favourably to this.

Grant to the Sanctus Severus jurats and worthy men and whole community of the town of Saint-Sever in the duchy of Aquitaine for their constancy and loyalty, and for the losses that they have sustained that the town, high and low justice with both full and shared jurisdiction, lordships, homages or fees of the same town or jurisdiction pertaining to the town should not be put out of the king's hands by sale, gift, exchange or by any other title except to future heirs to the kingdom of England.

The king formerly granted the same sum to Guilhem-Sans [II de Pommiers], then lord of Pommiers, the father of Guilhem-Sans [III de Pommiers], now lord of Pommiers for his life for his service to Edward II, and to the current king in Gascony and elsewhere and to support his status as a knight which he took up from the king, just as is more fully contained in the king's letters patent, and Guilhem-Sans III has requested by his petition exhibited before the king and his council that the king will wish to grant the same sum to him because he has lost all his lands, tenements and rents by reason of his service to the king in the Gascon war and has nothing to live on, and the king wishes to agree to this.

Order to the seneschal of Gascony and the constable of Bordeaux or their lieutenants that having called those of the king's council of those parts and the king's proctor there, and diligently obtained information as to what of the banlieue of the city [of Bordeaux] that the Dornoun lady of Ornon or her heirs hold, by what title, for what reason, in what manner, of its true value per annum in all issues, how much of the banlieue is in the king's hands, and how much in the hands of others, of what value, and what are the bounds of the banlieue, and also both of the right that the mayor and jurats have in the banlieue or to sell the same, and of the king's rights in this and other circumstances touching it, they are to send the information to the king under the king's seal used in the duchy by some faithful subject of the king deputed by them, and by some of the burgesses of the city of Bordeaux without delay. The Burdegal' mayor and jurats of the city of Bordeaux have requested by their petition exhibited before the king and his council that the king will wish to cause the banlieue of the city to be restored to them with high and low justice by sea and land to be held just as they were anciently accustomed to hold it, any usurper notwithstanding, because, they claim, a great part of the banlieue has been given to the lady of Ornon in exchange for her rights in the Glayves town of Blaye to their prejudice and disinheritance.

Grant to the mayor, jurats and community of Libornia Libourne , their heirs and successors, for their fidelity to the crown and their magnificent defence against the king's enemies, of all stones and sand thrown out by ship or other vessels coming to the Dordonia Dordogne and landing at the port of Libourne or elsewhere from Burgum Bourg to Libourne, and taking the same for the repair of the walls of the town in perpetuity. ¹ And for the ease of access to the walls for the defence of the town if the enemy are attacking, the king grants that no burgess of the town, nor anyone of whatsoever status or condition should build anything in the road, ways or places adjoining the walls and towers of the town by which access to them is impeded, and all the roads and their environs are not to be obstructed by the depositing of excrement or other rubbish, and nothing is to be piled up, to ensure that all armed men, both mounted and on foot, can defend the town at the beginning of an attack without impediment. And the king further grants that all men who are not of the the king's obedience who bring salt or other merchandise by the river should be bound to land with their ships or vessels at Libornia Libourne and discharge their salt or merchandise within the walls of the town, on condition that, if the men of the town cannot agree a reasonable price for the purchase of the things, then they should be put back in the ships and allowed to go on their way. And because the king is given to understand that the burgesses of the town are put to great expenses around the construction of their walls, and wishes to gratefully repay them for this, he grants to the mayor, jurats and community that they are able to dig a ditch and fore-ditch ( profossata ) around the town, ² holding the same to them and their successors for the fortification, enclosure and utility of the town together with all other liberties granted to them by the king forever. ³

The king further grants to Révignan that the 300 l.t. that should be taken from the castles and places of Castelnaud and Saint-Pastour should be taken by him and his heirs and successors each year from Boloihn' Boulogne and Sancta Mora Sainte-Maure , from Torrebien Torrebren , Durense Durance and Damosan Damazan , until Révignan, his heirs or successors are in part or total peaceful possession of Castelnaud and Saint-Pastour, provided that what he receives from Castelnau and Saint-Pastour is deducted from the assignment of 300 l.t. received by him from Boulogne and the other places. If Révignan is not able to take the 300 l.t. from Boulogne and the other places, then the king grants that he should take what is deficient in the sum from the issues of the duchy from the constable of Bordeaux until the places and castles of Castelnaud and Saint-Pastour will have come into Révignan's hands in part or in total, any gift or ordinance made to the contrary notwithstanding.

Bernat-Etz [V], lord of le Breto Albret and Geneva Hugues de Genève, lord of Varray Varey and Anthon' Anthon , the king's lieutenants in the duchy of Aquitaine, and Oliver de Ingham, seneschal of Gascony granted the those places and castles of Castelnaud and Saint-Pastour to Révignan and his heirs forever with all of its issues, by the advice of the king's council there, to be taken by him and his heirs forever from in recompense for his damages and losses and his service, and because Révignan came into the king's obedience, and gave up an equivalent grant made by Vales' Philip of Valois to aid him against the king. And if the rent did not amount to 300 l.t. a year, the shortfall was to be made up in the territories and places nearest to Révignan where it is most suitable, and to minimum damage to the king. Révignan has now requested, that since those places and castles are occupied by the king's French enemies, and he is not able to take the 300 l. , that the king will grant him those places and castles, to be held by him and his heirs and successors forever with their emoluments, issues, profits, and with high and low justice, and both full and shared jurisdiction, and with whatever else pertains to them, when they come into the king's hands. He has further requested that the king assign to him that the 300 l.t. can be taken from Boulogne, and Sainte-Maure, Torrebren, Durance and Damazan, and the issues and profits of the same, to be held and taken by Révignan, his heirs and successors, until they have peaceful possession of the places and castles of Castelnaud and Saint-Pastour.

Grant to Insula Gaston de L'Isle for his service that the 3,000 l.t.parv. which the king previously granted to him to be taken from the customs and toll of Sanctus Macharius Saint-Macaire and from the customs of Roian Royan by the hands of the constable of Bordeaux for his life or until he is provided with the value of the same in lands and tenements in the duchy, can be taken by L'Isle in person or a deputy by the view and testimony of someone appointed on the king's behalf for his life or until he is provided with those lands and tenements, any grant or assignment on those customs or toll by the king notwithstanding, provided that L'Isle will answer for any sum in excess of the the 3,000 l.t.parv. from the customs and toll at the Bordeaux exchequer each year, and should the issues not be sufficient then the constable of Bordeaux is to be bound to pay the deficiency from the issues of the duchy. For the support and service that L'Isle has shown to the king against Valesio, de Philip of Valois who has usurped the king's hereditary right, the king granted him 2,000 l.t.parv. in support of his status, to be taken each year from the issues of the duchy of Aquitaine by the hands of the constable of Bordeaux for his life or until he is assigned with sufficient lands for the same. Afterwards Oliver de Ingham, seneschal of Gascony promised to assign to L'Isle 1,000 l.t.parv. annual rent for his life to be taken in suitable places in the duchy or elsewhere just as is more fully contained in certain indentures sealed with the seals of the king's court of Gascony and of L'Isle. Subsequently, the king wishing to enhance this assigned to L'Isle that the 3,000 l.t.parv. should be taken from the customs and toll of Saint-Macaire and the customs of Royan by the hands of the constable of Bordeaux for his life, or until the king provides him with lands and tenements to the value of the 3,000 l.t.parv. each year in the duchy or elsewhere or for his life. Now L'Isle has requested that he can take the money in person or by deputy.

Order to the seneschal of Gascony and constable of Bordeaux, or their lieutenants, to summon those of the king's council and the king's proctor there, and diligently, secretly and faithfully obtain information upon the request of the mayor, jurats and community of Burdeg' Bordeaux , negotiating with the people of the city, and sending certification of what they find by someone they trust and by some of the burgesses of the city without delay with this writ. The mayor, jurats and all the community of the city have requested by their petition exhibited before the king that the king would wish them to be able to take and receive the custom on the wine growing near Burdeg' Bordeaux in the Seint Ylegge common house of Saint-Éloi ¹ as was customary, since in the city of Bordeaux in past times the usage was that the custom of the wine growing there was to be levied before the mayor and jurats of the city in the presence of the constable, and according to the 20th part of the price for which one of the three chapters of Bordeaux ² sold a tun of wine, excepting the wood [of the tun]. However, the constable, having no consideration for this, has demanded a higher sum in greater quantity than should be levied according to the custom and estimate.

Order sicut alias to the seneschal of Gascony or his lieutenant that having viewed the instruments of those obligations and other evidences concerning the money owed to the king by the archbishop of Bordeaux and the dean and chapter of the same place , if they are able to find by that inspection that they have not yet satisfied the king in part or in total for the same and by right or the custom of those parts they ought to be compelled to make payment, then they should compel the archbishop, dean and chapter to make the payment of the 5,000 l.t.parv. from their temporal goods to the constable of Bordeaux for the king and the heirs of Master la Case Arnaut de Lacaze, late canon of the church of Saint-Seurin of Bordeaux to whom the debt was originally owed. The king was given to undertand that the archbishop, dean and chapter were bound to Lacaze in 2,500 l.t.parv. of 5,000 l.t.parv. , the terms of payment of which had elapsed, and which sum ought to remain to the king for his use for certain reasons by the assent and will of the heirs of Lacaze as more fully appears by that composition and certain obligations, and previously ordered the seneschal or his lieutenant that having viewed the instrument and obligations and to compel payment of what he was able to find was due, but has not done so to the king's prejudice and to the manifest damage of the king and Lacaze's heirs. ²

Order to the seneschal of Gascony to hear the complaint of Blankaford Pélegrina de Blanquefort, wife of the late Goutz Galhart de Got, lord of Arbanas Arbanats , and her daughter concerning the wrongs done against them by Andriu [I], lord of Budons Budos , and summon the parties, and do full and speedy justice to Blanquefort and her daughter according to the fors and customs of those parts, getting her freed from prison, and doing what is just for an oppressed widow. Blanquefort has shown to the king that her husband faithfully served the king in his war, and died in that service, and in his testament he demised the custody of his daughter and heir, the castle of Arbanats and his land to Blanquefort which she then held, but the lord de Budos, then a rebel of the king, by hostily entered the castle and took Blanquefort and her daughter to his castle of Budos and imprisoned them there, and still detains them, and took and carried away their moveable goods to the value of 500 l.st. and more, and from that time unjustly took the fruits and profits of their lands of Arbanats to the sum of 800 l.st. in contempt of the king and to the oppression, misery and injury of Blanquefort and her daughter upon which she requests remedy, and the king wishes that justice be done.

Order to the seneschal of Gascony that having obtained information concerning the injuries that the ancestors of Menaut de Brocas, son and heir of Guilhem-Arnaut de Brocas have sustained by reason of the their service in the wars in the duchy of Aquitaine, and of what service they did to the king, by whatever ways and means that he considers expedient, he should send that information as quickly as he is able under the king's seal used in the duchy together with this writ. Menaut de Brocas has requested that the king will wish to compensate him since Guilhem-Arnaut de Brocas , his father, and his ancestors have lost their manors, houses, mills, rents, vines and other things in the towns and baylies of Saut Sault , Bonagard' Bonnegarde and Sarian Saint-Sarian in the Sanctus Severus prévôté of Saint-Sever on account of their faithful service to the king in the wars in the duchy for the maintenance of the king's rights, and in defence of the duchy, and they have not received any compensation from the king or his progenitors, and the king wishes to be certified on this.

15 June 1341 . Westminster . For the mayor, jurats and community of Bordeaux . ¹

To all archbishops, bishops, abbots, priors, comtes, barons, vicomtes, seneschals, constables, prévôts, ministers and all bayles and the king's faithful subjects in the duchy of Aquitaine.

Charter granting to the Burdeg' mayor, jurats and community of Bordeaux for their great service to the king, that they, their heirs and successors, burgesses of Bordeaux should forever have in the city two fairs each year for 32 days duration, one for eight days before the feast of the Ascension, the feast day itself and for the seven days following, and the other for eight days before the feast of St Martin in Winter (11 November), the day of the feast and for seven days following, with all privileges, liberties and free customs pertaining to the fairs, provided that the fairs are not damaging to neighbouring fairs.

The king further grants that all merchants and others coming to the fairs should not be compelled to pay tolls on there possessions and merchandise that they bring to the fairs or their debts there within the first seven years unless the day of the payment of the debt is pre-arranged in the fair. After the elapse of seven years the king should take 4 d. in the pound from things sold at the fairs from the seller and the same sum from the purchaser, for his and his heirs' use.

And the king further grants that the burgesses of the city, their heirs and successors should be free and quit from impositions, tolls, customs and exactions forever, just as they and their predecessors were accustomed to be free and quit before the making of these presents. ²

Order to the constable of Bordeaux that having viewed the bills that the consuls of the town of Veyrak Vérac claim to have concerning their wages, if he is able to find that the sum of 1,760 l.bord. is due to them then he should make payment to them from the issues of the duchy or from the money which the king is sending to those parts from England ; and having made that payment he should receive the bills from the consuls, and also their letters of acquittance, and the king will make due allowance to the constable in his account. The consuls have requested that the king will wish to make payment to them of the sum of 1,760 l.bord. which the king is bound to them for their wages by pretext of their service to the king in the present war in the duchy of Aquitaine just as appears by those bills under the seal of the seneschal of Gascony, and the king wishes to agree favourably to the request.

To the seneschal of Gascony and constable of Bordeaux and the other officials and ministers of the king in the duchy.

Confirmation to Bernat-Etz [V], lord of Lebreto, de Albret of the assignment and livery made to him by the seneschal of the places, baylies and lands of Pontosio Pontonx , Auree Vallis Auribat , Gossa Gosse and Sonhas Seignanx in place of the prévôté and Mountandre castellany of Montendre and the corn tax ( bladagium ) of Blaya Blaye and the land that the lady of Blaye held when she lived, which had been granted to Matha d'Albret in part exchange for land elsewhere, Bernat-Etz being Matha d'Albret's heir, the prévôté and castellany, and corn tax ( bladagium ) being in the hands of the king's French enemies. The seneschal, constable and others are ordered to let Bernat-Etz take actual possession of the same, with the rights, jurisdictions and homages, full and shared jurisdiction, and all other things that pettain to them, if he does not have possession already, and he is to be maintained in his possession once he has it. It is further ordered to the king's subjects and vassals of those lands delivered to Bernat-Etz, to swear homage and fealty to him and his heirs and successors and to do other customary obligations and dues. Notwithstanding any other grants, assignments or alienations to anyone else, and notwithstanding that the places and castles of Brigerac Bergerac and Montinhac Montignac in the seneschalcy of Périgord , and of Pinoliis, de Pineuilh and Ventenacum ¹ in the senescalcy of Tartas ² are held by the king, some of the king's subjects but rather followers of the French enemies.

On behalf of Bernat-Etz it is requested that the king will wish to confirm the assignment made by the seneschal pursuant to an agreement was made between the seneschal in the king's name on the one part, and le Bret Matha d'Albret, lady of Montinhac Montignac and Gensac on the other, namely that Matha d'Albret granted to the king all the right and all actions that she had in the place, castellany and Brigerac prévôté of Bergerac with its appurtenances, and in all other places which were the lord of Brigerak' Bergerac's in the diocese of Périgueux , ³ to be held by the king and his heirs in perpetuity; and she also granted to the king the castle and Montinhac town of Montignac with its appurtenances, to be held in perpetuity; and Matha d'Albret during the Gascon war granted and delivered to the king and his heirs, and his seneschal the keepership of the castles and places of Gensac and Montmyr Miremont , and Mauron Castelmoron and Moncut Montcuq . In compensation for these the seneschal in the king's name promised to Matha d'Albret the castle, place, prévôté and castellany of Montendre, and the corn tax ( bladagium ) which the king had in the town and Blaia castellany of Blaye , together with the land that the lady of Blaye lately held from the king there, and also the manor of Condacum Condat and the prévôtés of Born , Meymisan Mimizan , Erbefaveira Labouheyre and of Brasent Brassenx with their appurtenances, to be held by Matha d'Albret and her heirs from the king and his heirs forever; saving to the king the homages, fealties, resorts and other customary dues which are due to the king in similar places, just as is more fully contained in the indentures made between the seneschal and Matha d'Albret, which the king has accepted and confirmed by his letters patent; but because the prévôté and castellany of Montendre and the corn tax of Blaye and the land that the Lady of Blaye held when she lived were in the hands of the French enemy the seneschal granted, by letters under the king's seal then used in the duchy, to Bernat-Etz the places, baylies and lands of Pontonx, Auribat, Gosse and Seignanx, to be held by him until he could have peaceful possession of the prévôté, castellany and corn tax. Bernat-Etz requests the king's confirmation of the same, and the king having considered the advantages and disadvantages in regard of Bernat-Etz's service, wishes to agree with the request by the advice of the council. ⁴

Grant to Master Pinibus, de Guiraut de Piis, king's clerk , that he should hold the office of procurator in Agenn' Agenais and Vasates' Bazadais with the fee assigned for it while he conducts himself well and faithfully, the king having granted this, having heard laudable testimony of Piis' good conduct, in enlargement of his appointment to that office during pleasure by Oliver de Ingham, seneschal of Gascony , which Ingham made by his letters patent under the king's seal then used in the duchy, which appointment the king has previously accepted and granted by his letters patent.

Grant to Pons [IV], lord of Castellioun Castillon that he should have and hold Mountynac Montignac with all its appurtenances, until he is able to recover the castle and Mons Andronis castellany of Montendre with its appurtenances which was previously granted to him, to have and to hold the same to Pons and his heirs with all the rights and appurtenances from the king and his heirs by the customary service forever. Pons had previously requested that the king would grant him the castle and castellany in fee in compensation for the damages and injuries that he had sustained on account of the war in the duchy of Aquitaine in the king's service. The king wishing to be certified on the true value of the castle and castellany, and whether the grant of the same could be done without prejudice to the king or anyone else, ordered the seneschal of Gascony and the constable of Bordeaux that having obtained that information, they should send certification of what they find under their seals, and by that information returned before the king and his council it was accounted that the castle and castellany for an annual render of 300 l.t. when demised in times of peace. Pons, because he could take no profit from the castle and castellany which has been taken by the king's French enemies and rebels, has requested that the king will wish to grant to him Montignac which ought to have forfeited into the king's hands by the rebellion of Sparra Bernat de Lesparre , and the king wishes to agree favourably to the request because of Pons' laudable service.

Order to the seneschal of Gascony and the constable of Bordeaux to hear the complaint of Duro Forti, de Guilhem-Ramon de Durfort , or his attorney, concerning the inheritance of Gensak Ramon-Guilhem de Gensac , and summon before them Madelhano, de Guilhem-Ramon de Madaillan , and view the legal process concerning this, and if they find that Durfort's allegations are true then they are to supersede the execution of the king's charter in favour of Madaillan, or orders of the king directed to them concerning the part of the Gensac inheritance pertaining to Durfort, until the legal process has been determined, and they should render void anything that has been done to Durfort's prejudice against that process. On Guilhem-Ramon de Durfort's behalf it has been shown to the king that inheritances in the duchy of Aquitaine, in the absence of male issue, ought by custom to be divided between the daughters according to the fors and customs of those parts, and the inheritance of Ramon-Guilhem de Gensac, because he had no sons ought to have descended to his two daughters - Guirauda , mother of Guilhem-Ramon de Durfort, whose heir he is, who married Duro Forti Arnaut de Durfort who is dead, and Talesia Thalèsa, wife of Madelhano Guilhem-Amaniu de Madaillan , and ought to have been divided between them; and eighteen years elapsed and at the beginning of the war in the duchy a plea in the court of Gascony and also by appeal in the parlement of Paris ( curia Franc' ) was made for Arnaut and his wife, Guilhem-Amaniu and his wife then having occupied the whole inheritance unjustly, and three arrests were decided, but because of the war these were not executed. Guilhem-Amaniu de Madaillan was against the king in the war, and now Guilhem-Ramon de Madaillan, son of Guilhem-Amaniu holds the other part of the inheritance. He has newly adhered to the king, and the whole of the inheritance has been granted to him by the king by his charter at Madaillan's request, the king being ignorant of the matter. Guilhem-Ramon de Durfort has requested that the king will have consideration of the matter and revoke the charter granted to Madaillan in prejudice of Durfort, and the king wishes justice to be done. ¹

Order to the constable of Bordeaux or his lieutenant that having accounted with Menaut [de Brocas], son of Guilhem-Arnaut de Brocas for the wages of his father and his men if he has not already done so, he should make payment to him of what he finds is due from the issues of the duchy or from the money that the king is sending to those parts, or a suitable assignment from the same issues without delay; receiving from Menaut his letters of acquittance, and also bills if any were made, and they will have due allowance in their account. Menaut de Brocas has requested that the king will wish to make payment to him or a suitable assignment for the sums of money which the king owed Guilhem-Arnaut de Brocas , his father from the from the time that he stood in the garrison of Sanctus Severus Saint-Sever from the beginning of the present Gascon war to the day of his death, for his wages and those of his men-at-arms and foot-soldiers in his company residing in the garrison, Guilhem-Arnaut having made Menaut his son his heir in rents, goods and debts, and the king wishes to agree favourably to the request.

Order to the seneschal of Gascony that he should deliver to Master Gordoun Guilhem Gourdon , king's clerk , the writing office of the seneschalcy and assise court of Agenesium Agenais , and of the baylie ( ballagium ) of the Agennum city of Agen according to the tenor of the king's letters. as soon as it comes into the king's hands. The king granted the office to Gourdon for the faithful service that he has done and will do, the same office being in the hands of the king's French rebels, having the same from as soon as it will come into the king's hands, provided that the king or his progenitors have not already granted the same to others for the term of their life or years, just as appears in the king's letters patent on this.

Order to the seneschal of Gascony and the constable of Bordeaux, that the constable should pay to Gordonis Guilhem Gourdon of Burgum Bourg , king's clerk , the 12 d.st. a day which the king has granted to him from the issues of the duchy for as long as Gourdon conducts himself well and faithfully to the king, or until he is provided with an office or bayle where he is able to take the sum or the value in other money, and the constable will receive due allowance in his account. Gourdon requested that the king would wish to provide him with anything whereupon he and his father and mother and their children can live, since Gourdon's father and mother, he himself and his brothers and sisters from the time that the king's French enemies took the Burgum town of Bourg had to relinquish their houses and goods which they had in the town because they wished to remain loyal to the king, and they came to Burdeg' Bordeaux and did not have anything to sustain them. The king having consideration for their faithfulness and for all that they had sustained, granted the 12 d.st a day to Gourdon to be taken each year during pleasure for the sustenance of Guilhem, his mother and father, and his brothers and sisters, until an office could be provided. And afterwards, the king wishing to show Gourdon further grace granted that he money should be taken while Gourdon conducts himself well and faithfully towards the king. ¹

Order to the seneschal of Gascony and constable of Bordeaux or their lieutenants that they cause 560 l.t. to be assigned to Cassanea Ramon de Cassagne, burgess of Agen , upon the lands of the king's enemies and rebels in the Vasates' Bazadais and Agenes' Agenais , having and taking the same each year until he recovers the lands and tenements that he lost, any gift, assignment or order to the contrary not withstanding; receiving from the same Cassagne his letters of acquittance, and the constable is to be discharged from the same. Cassagne has requested by his petition exhibited before the king that whereas he has lost his lands and tenements to the value of 1,200 l.t. per annum because he has adhered to the king in the present war in the duchy of Aquitaine, and Bernat-Etz [V], Lebreto, de lord of Albret , lieutenant of the king in the duchy from his own lands and rents assigned to him 640 l.t. in part compensation of the 1,200 l.t. , that the king will wish to assign to him the residual 560 l.t. upon the lands of the king's enemies and rebels in the Bazadais and Agenais, and the king having heard laudable testimony of Cassagne's good conduct towards the king, wishes to show favour to him.

Grant to the mayor, jurats and community of the Burgum supra Mare town of Bourg for their great and laudable service that they have done to the king and his progenitors, late kings of England, which they have done not without labour and costs, that they and their heirs and successors should have and hold all the privileges, liberties, exemptions and quittances granted to them by charters of the king or of his progenitors, late kings of England, and to fully enjoy and use them just as they and their ancestors reasonably used and enjoyed them, notwithstanding that when the town was taken by the king's enemies and rebels, their charters and other memoranda, privileges, liberties, exemptions and quittances were lost, saving the king's rights in all matters.

Licence granted to Martin [de Tartas], lord of Urthuby Urtubie , that he or his heirs are able to build a castle or fortalice at Urthuby Urtubie with ditches and walls of stone, to be held from the king and his heirs for the salvation and defence of those parts forever. Proviso that the castle or fortalice should be rendered to the king and his heirs at the order of the king, his heirs or their seneschals in times of war and peace. The lord of Urtubie has requested that the king would wish to grant him the licence for the salvation and defence of those parts because Urtubie is on the march of Ispann' Spain ¹ and Navarr' Navarre in a dangerous place situated near the king's enemies with no castle or fortalice within three leagues. ²

Order sicut alias to the constable of Bordeaux to make payment to Master Martin de Vera, late surgeon ( cirugicus ) of the king's father ¹ or his attorney of the arrears of the 20 l. per annum from the time that he was seised of the same by virtue of the grant of the king's father from the issues of the duchy or the treasury which is in the constable's custody, any order of the king's directed to him to the contrary notwithstanding; receiving from Vera his letters patent or those of his attorney attesting to the payment, and the constable will have due allowance in his account. And if there is any reasonable cause why the same should not be paid then he should send certification of the reason to the king in chancery under the seal used in those parts together with this writ without delay. Vera has requested that the king will wish to satisfy him for the 20 l.st. annuity or the value in other money which the king's father granted to him for life by his letters patent for his good service to the late king, to be taken by the hand of the constable of Bordeaux from the oven in the Sancta Fides town of Sainte-Foy[-la-Grande] or from the other issues of the duchy, which grant the king afterwards confirmed, and the king wishes to agree to the request.

Order to the seneschal of Gascony, or his lieutenant that the landing tax ( applicatio navium seu portus ) paid by ships coming up river from the city of Bayonne and elsewhere be paid at the bastide of Hastingues from henceforth. The king has granted to the jurats and community of the Hastyngs bastide of Hastingues , for the improvement of the situation of the bastide situated on the frontier of Navarre and certain places of the king's enemies, and also for the good and laudable service of the jurats and community to the king, that the landing tax formerly paid at the town of Sorde should be paid at the Hastyngs bastide of Hastingues during pleasure. On the behalf of the jurats and community of the bastide it has been requested that the king will wish to grant that they have this landing tax paid at their bastide for their service to the king in the wars in the duchy and the great labours and damage that they have sustained. Ships coming from Bayonne were accustomed to pay the tax at the town of Sorde , but the inhabitants sided against the king in the war and surrendered the town to the king's enemies who still occupy it, and the king wishes to agree to the request.

Order to the seneschal of Gascony that having diligently informed himself as to whether Montinaco Montignac which was la Sparre Bernat de Lesparre's , he being an enemy and rebel of the king, ought legitimately to pertain to the king because of the rebellion, as the king has been given to understand, if he finds this to be the case then he is to take it into the king's hands, and if any in the place contend that they have rights to the same, then having called the king's procurator and others of the king's council, do full justice.

Order to the seneschal of Gascony and the constable of Bordeaux that when they receive orders or letters from the king concerning the livery of lands, possessions, jurisdictions, offices or other things granted by the king to some people, if they are able to find that the lands, possessions, jurisdictions, offices or other things had already been given or granted by the king or his predecessors, then livery is not to be made unless special mention is made in the orders or letters of the previous gift or grant, since it is not the king's intention that such grants be revoked because the king makes grants of the same to persistant supplicants, not recollecting these earlier grants.

Commission to Oliver de Ingham, seneschal of Gascony and Guilhem-Ramon, Calvo Monte lord of Caumont to survey all the castles and strong places ( loca fortia ) both of the king's and those belonging to others within the king's power in the duchy of Aquitaine, and those that they find can be defended for the king against the king's enemies in the present war are to be provisioned with victuals and other necessaries, and those that are not are to be demolished, and Ingham and Caumont are not to allow anyone to build new castles or fortalices unless they have found sufficient guarantees and security beforehand that the castles or fortalices will be safely and securely defended at their own costs for the king's use. They are to undertake their commission in the way that they consider best for the king, and the king has granted that all and singular of the king's ministers and faithful subjects and inhabitants of the duchy are to obey and attend upon them in all the premises.

Letters of protection granted to Andriu [I], Budes lord of Budos , kinsman of Cardinal Fargiis [Ramon-Guilhem] de Fargues , ¹ , his household, things, rents, possessions and his goods, since the king in his pleasure at Budos' coming into the king's obedience not withought great loss of his goods, and wishing to show him favour has received him and them into his safe-keeping. They are to be maintained, protected and defended from violence and harm, and speedy amends should be made to them for any forfeitures that they have suffered.
