Physical condition of the roll

The roll consists of 4 membranes, with entries appearing on the face of the membranes only. There is no cover, and hence the dorse of membrane 1, the outermost membrane, bears a variety of contemporary and modern headings and referencing notes. The roll is in good condition throughout, although the dorse of membrane 1 is slightly dirty and worn, as expected of a cover.

The roll is a comparatively short roll for the period of the principality of Aquitaine, but like the other rolls is dominated by letters of protection and attorney for those going out to serve in the principality, or for those continuing to stay there. Only a few entries concern other matters, and these fall into three distinct categories, justice, trade and confirmations.

As with the other rolls for the period of the principality justice only finds reference in matters of appeals. With the delegation of judicial authority to Edward of Woodstock as prince of Aquitaine, the only legal cases that came to King Edward III as sovereign lord were appeals from the prince's jurisdiction. In this roll, like the other rolls, orders were given to various individuals, to whom the king had delegated his authority, to deal with the appeals. Three of the entries concern complaints of Guiraut de Ventadour, lord of Donzenac, one of which being in conjunction with the vicomte of Turenne, against various individuals. Huc de Badefols and his associates were accused of dispossessing the lord and vicomte of their castle of Malemort; 1 the inhabitants of Donzenac are alleged to have acquired property in that town without their lord's consent; 2 and unnamed individuals are alleged to keep the lord from the lands of Beaumont and Chamboulive, which the lord had been bequeathed. 3 In all the cases Edward of Woodstock, or his lieutenant in Aquitaine, are ordered to do justice. To protect the lord of Donzenac further, he and his wife, children and household were received into the king's protection in the lordship of Aquitaine. 4

Two further, and very similar, entries concern the appeal of Trencaléon de Montpezat, wife (presumably widow) of the lord of Roquetaillade, and Pey de Lamothe, kt, lord of the same place, her son. Trencaléon and her son complained of certain unjust injuries done to them by Thomas de Felton, seneschal of Aquitaine, and his commissioners and ministers, in a legal case concerning the lordship, jurisdiction and justice of Salleboeuf, brought by several other lords of the Bazadais and Entre-deux-Mers. 5 In this and the other cases referred to below, the hearing and resolution was delegated to ecclesiastics and lawyers. In Trencaléon's appeal Pierre Tison, bishop of Périgueux, and chancellor to Edward of Woodstock was assigned together with the abbot of Saint-Croix in Bordeaux, and the official of Bordeaux. The bishop was again called on to hear the appeal of the prior and chapter of the almshouse of Saint-Jean-Dehors outside the walls of La Rochelle concerning a dispute over a rent in the town with a local family. 6 . In the remaining case the official of Bordeaux was assigned with the dean of Saint-André, and the lawyer Master Reynaut Desclaus. 7 Unlike the earlier rolls, none of these cases had previously appeared in the Gascon Rolls, so it is unclear how efficiently the king was able to deal with his appelate jurisdiction.

A number of entries relate to the trading of goods. Several are the familiar licences granted to merchants and others to take victuals to Gascony. 8 For reasons that are not completely clear all of the licences not only appear together, date to the period 12 October to 8 November, concern the export of beans and peas, and/or wheat, but also relate to men from Bridgwater in Somerset. But this is where the similarities end. All except one Hugh Cran were to export their goods from Bridgwater, Cran being free to export his goods from whichever port he wished to do so.They were also treated in different ways. Of the five, four had to find security to take the goods to specified destinations, but only one of these had to find them upfront. Two had to take their goods to Bordeaux, one to Bordeaux, Bayonne or La Rochelle, one to Gascony, and one to Gascony or Ireland.

The other two entries relate to a Bordeaux merchant, and a Lombard merchant. Of the two, the grant and safe-conduct granted to Johan de Lagrave, merchant and burgess of Bordeaux, are perhaps the most interesting. 9 As is set out in the grant, Lagrave explained that he had planned to ship a variety of merchandise bought in Flanders by himself and other men of Bordeaux, back to Bordeaux by sea. However, because of the war, he did not feel that he could freight the goods home safely, and had requested greater security so that he could do this. The king granted him permission to ship the goods to England, unload them there and ship, and then ship them in the ships of other subjects to Bordeaux without paying the customs, and gave him safe-conduct as well. The other was a grant to a ship of Jacopo Jacobino, merchant of Lombardy, to bring a cargo of woad and other merchandise from Aquitaine to England. 10

The final entry to receive comment is the inspeximus of the grant by Edmund of Langley, earl of Cambridge and vicomte of Aulnay, to John de Nowers, kt. Nowers had gone out to Aquitaine in 1369-70 in the company of Langley, and seems to have been trusted sufficiently to be granted the custody of the castle and castellany of Aulnay and Chef-Boutonne, and the castle and place of les Gours in northern Saintonge and Poitou. Aulnay in particular was an important possession of the English, and as the war progressed, must have become increasingly exposed, so that this grant may well have been an attempt to shore up the garrisons in this area. 11

To all sheriffs, mayors, bailiffs, collectors of customs and all other subjects and faithful people.

Order that la Grava Johan de Lagrave, merchant and burgess of Burdegalen' Bordeaux , be allowed to enter England peacefully with his goods and merchandise, unload them as he sees fit, and transport them out of the realm to Bordeaux without paying any custom, exaction or payment. Lagrave has requested greater security from the king for himself and his goods, as he had intended to ship a variety of merchandise, bought in Flanders by himself and other men of Bordeaux, back to the city of Bordeaux by sea. However, on account of the wars and other causes, he is not now able to freight those goods securely. The king has therefore granted permission for him to bring those goods into England, and to unload them and transfer them into the ships of other subjects of the king or others to be transported more securely to Bordeaux. He may do this without paying any customs, provided that he does not sell or attempt to sell any of this merchandise within England, nor any other goods brought into England from Flanders, unless he pays the due and usual customs.

Order to the official of Burdegalen Bordeaux , the dean of the Burdegalen church of Saint-André, Bordeaux , and Master de Clavibus Reynaut Desclaus, lawyer , that they hear and determine all matters pertaining to the appeal brought before the king at the last parliament held in Aquitaine by Vitalis Pey Bidau, son and heir of Vitalis Johan Bidau, citizen of Bordeaux , deceased , concerning certain pronouncements and sentences made and promulgated by both Master Pey de Madéran, keeper of the seal for contracts of the city of Burdegalen' Bordeaux , and the lieutenant of the seneschal of Aquitaine , and by the court of Edward [of Woodstock], prince of Aquitaine and Wales , in favour of Broun Thomas Brown , Peter Edon and Richard Henry , merchants of England, and against Bidau, concerning various sums of money owed to Brown, Edon and Henry. They are to call the parties before them, together with any others who ought to be summoned, hear all the matters put forward which either confirm or weaken the original pronouncement, and proceed to judgment on this with minimum delay, according to the fors and customs of those parts.

Order to the bishop of Périgueux , chancellor to Edward [of Woodstock], prince of Aquitaine and Wales 1 in the principality of Aquitaine, that he should hear and determine the appeal of the case between the prior and chapter of the de la Fors almshouse of Saint-Jean-Dehors outside the walls of La Rochelle 2 and Master Ryvaut Jean Rivaud and his wife, Brune Marguerite Brun , 3 regarding an annual rent of 16 l. . The prior and chapter have claimed that the rent, payable at the feast of All Saints, belonged to them and their predecessors for a long time past, and belonged to them by virtue of the gift and assignment of Bruni Guillaume Brun , who had previously possessed the rent by right, and for which they have the charters and muniments in their possession. However, Rivaud and his wife claim the rent by virtue of a sale and deed made by one Poncetti Pierre Poncet and his mother to Master Bruni Pierre Brun , father of Marguerite, and thus the rent ought to be payable to them. They sought the rent and its arrears, and the documents, at the assize of La Rochelle , held by Harpeden John de Harpsden, seneschal of Saintonge , and procured an adjournment by a general serjeant of Edward [of Woodstock], prince of Aquitaine and Wales , in the town, castellany and resort of Rupella La Rochelle , to their great damage, and they have appealed the case before the king, as king of France and England, at the last parliament. The bishop is to call the parties and others before him, examine the principal matter and everything else pertaining to the case, determine the issue and make execution, so that neither party suffers through fraud or burdensome expense.
