Physical condition of the roll

The roll consists of 14 membranes with an additional shorter membrane as a wrapper. There are entries on all of the face sides, but none on the dorses. The roll otherwise is generally clean and in good condition.

C 61/42 4 Edward III (1330-31)

Introduction.

As was often the case in the rolls of this period, several entries deal with sums of money owed to individual Gascons or communities dating back to the reigns of Edward I or Edward II. For instance the lord of Rions Guilhem-Séguin VII continued to press for the 2000 l.ch. promised to his father by Edward I in order to rebuild the town walls of Rions, the previous walls having been razed to the ground by the French in 1295. 1 The executor of a deceased prior of Saint-Esprit of Bayonne requested the latter’s wages which were still outstanding from the reign of Edward I. 2

Following the war of Saint-Sardos (1324-5), a peace treaty was finally signed (8 May 1330) with the then king of France (Philip VI). This is copied in full onto this roll. 3 The lord of Caumont, along with seven other nobles, requested that their sentence of banishment by the parlement of Paris be revoked, since the treaty of peace with the king of France, following the war of Saint-Sardos had not mentioned this. 4

The king gave full power to John Darcy le Cosyn and Guilhem-Sans II de Pommiers to receive men into the king’s obedience even though they had left it during the war of Saint-Sardos. 5 They were also ordered to inspect all the king’s castles and fortalices in the duchy of Aquitaine and provide men and victuals as necessary, very much reflecting the aftermath of war and ther perceived need to maintain defence. 6 John Darcy and John Haustede were commissioned to negotiate with the nobles and inhabitants of Agenais to secure their return to the king’s obedience. 7

Fortaner d'Esgoarrebaque had lost a lot of money by paying the ransoms of some of his men who had been made prisoner at Talmont-sur-Gironde by the French during the war of Saint-Sardos. 8 He also had to help to return the count of Foix into the king’s obedience. 9

Adam de Lymbergh, former constable of Bordeaux, was troubled because the treasurers of Périgord-Quercy-Limousin and Agenais had failed to render their accounts to him: their provinces had been conquered by the French during the war of Saint-Sardos and they had rendered their accounts to the French. 10

Master Guilhem de Gourdon, of Bourg (in Bordelais), was appointed king’s remembrancer in the duchy of Aquitaine, as well as in the courts of the king of France at Paris (the parlement of Paris) and in the French seneschalcies neighbouring the duchy of Aquitaine. Such an appointment underlines the importance of local appeals to the king of France’s court which caused much disruption to the king of England’s authority as duke of Aquitaine, especially once Edward III had accepted that he owed homage to the French king for the duchy. 11 Gourdon went to England in order to inform the king on such matters. 12 He was also a royal councillor in the duchy and was given a special protection by the king. 13

Several matters treated in the previous rolls continue to feature. A special commission had been appointed by the king to audit the account of Aubert Mège when he was constable of Bordeaux, since he was too old to come to England, although he had subsequently been ordered to go to England in person. 14 Following this case, the king issued an ordinance specifying that all constables of Bordeaux had to have their account audited at the exchequer of England at Westminster, and that the controllers of Bordeaux had also to come to England with their counter rolls. 15 A member of the king’s council at Bordeaux had to be sent by the seneschal of Gascony and the constable of Bordeaux to Bayonne to make a peaceful agreement between the community of Bayonne and the men of Labenne, Capbreton, and le Bouret, about fishing rights, linked to a conflict mentioned in the previous roll. 16 The king put under his protection and safeguard the Ségur brothers in order to protect them against Pey II de Grailly, vicomte of Benauges, who claimed to be their overlord. 17 The king also allowed them to bear arms to defend themselves against the vicomte. 18 Guilhem de Heugas had been pardoned, following a payment of a fine, for the murder of the lords of Amou and Athieu, despite the fact he had been imprisoned for this offence in the prison of Dax. He had broken out of that prison and been exiled. Bernat de Béarn called l’Aspès complained to the king that the lands and goods owned by Heugas he had been allocated had been ordered to be returned to Heugas. 19 It had been decided that they had to be returned in the king’s hands and delivered once again to Bernat de Béarn. 20 This was a grant made to Béarn by Edward II and confirmed by Edward III. 21 There remained complaints about the murder of Arnaut de Noaillac, of Penne-d’Agenais, whose perpetrators had been pardoned through a royal act copied in the previous roll. 22

A harsh conflict had arisen between Pey II de Grailly, vicomte of Benauges and Castillon, and his son and heir Johan II de Grailly, since the former claimed to be the executor of his late wife and mother of Johan II (Assalhida of Bordeaux), and his son had expelled his father's troops from his mother’s possessions in Bordeaux in order to put his men there instead, despite royal protection. 23

We find in the roll first mention of the claim of the chapter of Saint-André of Bordeaux to one third of the money struck at Bordeaux. This claim continued to be mentioned in the Gascon Rolls until 1354. 24 The king ordered that wages should not be paid in the duchy in local money beyond the value of this money in sterling. 25

We also find on this roll several letters allowing the building of fortalices. We can note particularly authorisation to build the ‘maison forte’ of Malengin which still survives today, although in ruins, 26 as well as authorisation to build the ‘maison forte’ of Monbadon, another fortalice still existing today. 27 The two medieval ‘maisons fortes’ still surviving in the commune of Saint-Germain-du-Puch (dép. Gironde) have the same origin. 28

Arnaut de Lescapon, was granted for a seven year period, the office concerning the king’s money struck at Bordeaux thanks to prestigious patronage (the king of Bohemia, the counts of Hainaut and Jülich). 29

It is noteworthy that the Gascon Pey de Martillac was given the keepership of the castle and castellany of Saint-Macaire at the request of its inhabitants. 30

Two entries deal with the murder of a citizen of Bordeaux. Its perpetrators were possibly still in the duchy of Aquitaine despite their banishment. 31 The accused claimed to be clerks and consequently they asserted they were under ecclesiastical judicial authority, not lay authority (including that of the king). 32

Other entries concern goods transported on ships. A merchant of Gascony complained that a master of a ship had retained his goods to his own profit. 33 As Reyner de Berfrey, burgess of Bristol, died intestate at Bordeaux, his goods which were in a ship of Bristol had been seized into the king’s hand as was customary in Gascony, but Alicia, her widow, showed his will, which led to an order that the goods of her late husband should be returned to her. 34

Assignment of John de Haustede, seneschal of Gascony , Master Galiciano, de Pey de Galician, constable of Bordeaux , Master Moleria, de Arnaut de Lamolère and Master Aukerio, de Johan de Augey , or the three or two of them, one being the seneschal or constable, to audit at Burdeg' Bordeaux the accounts of Master Medici Aubert Mège, king's clerk , from the time that he was constable of Bordeaux, both for the issues of the duchy and of the victuals and other goods of the king's father then in Mège’s charge, and to do everything to terminate the accounts. They are ordered to summon the controller or his deputy concerning the accounts from that time and do all that is necessary, and they are to report what they have done in this matter under their seals; the king has ordered the controller and Mège to obey and be intendant on them. Lately the king ordered the seneschal, and Master John de Weston, then constable of Bordeaux , to assign men to hear and determine the accounts of Mège, from the time when he was constable, by a commission of Edward [II], late king of England , then governor and administrator of the king's possessions and goods in the duchy , 1 under the seal then used in the duchy, and the king, for certain reasons then revoked the commission. Mège now states that he is too old and exhausted to come to England to render his accounts and requests that the king appoint people in the duchy instead, Oliver de Ingham, late seneschal in the duchy , vouches for the truth of Mège's message, and the king wishes to show him special grace.

Order to the seneschal of Gascony to check the inquiries and judgment on the conflict la Launde Arnaut de Lalande, lord of Breda La Brède had with some men of the duchy on the places of Artras Arsac and Cassac Agassac Lalande claimed. An inquiry requested by Lalande has been made, according to the local customs at the court of Gascony, on his hereditary right and the sentence of the said court, according to these enquiries, was in his favour, but this latter petitioned the king that this sentence has not been yet fully implemented, as he asserts. If the sentence has been properly delivered, the seneschal has to implement it according to the local fors and customs.

Order to the seneschal of Gascony that if he notices that the banishment described in this entry has been lawfully made and judged as asserted, then he has to approve this banishment by king's letters under the king's seal used in the duchy and enforce them on the king's subjects of the duchy. Soler, du Bonet de Soler petitioned the king before him and his council that Chikat Bernat Chiquet, former Burdeg' citizen of the city of Bordeaux , has been killed in a treacherous and premeditated trap against the king's peace on a public street of the said city by Mayensang' Pey de Mayensan called Pey-Ramon de Myes , Geres Pey de Gères of Caumont , 1 Guilhem du Brion , Pey [de Lacaze] and la Case Ramon de Lacaze of Cutures Coutures . These latter were called in justice for this crime before the mayor and jurats of the said city as proclaimed by trumpets in the four corners of the said city as it is customary, these malefactors being notoriously guilty of this murder, and in their absence were banished by the said mayor and jurats. If it happens that the exiles are found in the power of the king , the seneschal has to catch them without delay and make a swift justice of them according to the local law, fors and customs in order that the punishment of the said malefactors brings fear to the others who commit misdeeds.

Order to the seneschal of Gascony and the constable of Bordeaux or their lieutenants to hear the complaint of la Farge Ramon-Guilhem de Lafargue, merchant , 1 or his attorney on the fact that Lafargue appointed as master of his ship named the Sanctus Petrus 2 Lespiaup' Ramon [d']Espiau and entrusted to him 72 l. 17 s. 8 d.st. of goods to trade with to Lafargue's profit, and although Espiau, master of this ship, has freighted the ship several times and traded the said money, he has refused up to now to render to the said Lafargue the account on this trade or to pay him the profits coming from it and Espiau held the said ship and money in the regions of the said duchy to the great expense and damage of the said Lafargue, as this latter petitioned the king. The seneschal and the constable have to compel the said master Espiau to render to the said Lafargue or his attorney on this matter the said ship and the account of the freight of the said ship as well as of the money coming from this freight as they will see is suitable according to the local law, fors and customs. 3

Order to the seneschal of Gascony and the constable of Bordeaux, or their lieutenants, that having called the members of the king's council in the duchy, [the king's] proctors and others whom they consider ought to be called, they check the content of the petition of Lespes Bernat de Béarn, called l'Aspès he showed before the king and his council that Faugars Guilhem de Heugas killed at Bone Garde Bonnegarde the noble lords of Damor' Amou and of Datio Athieu , 1 these lords being under the protection and safeguard of Edward II, late king of England , father of the current king. Heugas has been condemned for this murder by the lord of Crodon' Craon , then seneschal of Gascony 2 and incarcerated in the prison of Aquis' Dax . Then Heugas broke out from this prison, secretly escaped from there, has been banished at this occasion from all the said duchy, and the lands and tenements which were possessions of the said Heugas and which came into Edward II's hand by the forfeiture of the said Heugas were allocated, it is said, by this latter to Bernat de Béarn partly in satisfaction of 100 l.st. per year granted by the king to him for life. Heugas suggested to the king the truth, that he has been falsely accused of these treacheries and murder committed in the prévôté of Aquens' Dax , so were treacherously obtained from the king some letters ordaining the seneschal of Gascony to make him justice according of the fors and customs of Dax, the seneschal decided to let him alone for the said murder with the payment of 300 s.morl. and to return to him his lands and goods according to the fors and customs of Dax, to the great expense and prejudice of the king and the great damage of Bernat de Béarn as is shown in the petition sent to the seneschal and the constable under the king's seal. The seneschal and the constable have to act on this matter for the advantage of the king and of his lieges, keeping his right according to the local fors and customs, and if treachery and murder in the regions of the duchy or in the baylie of Bonnegarde has been made as outlined, to revoke or make them to be revoked, the decision of the seneschal of Gascony being obtained through a distortion of the truth at the suggestion of the said Heugas. 3

The seneschal and the constable, if they find that this murder happened within the territory of Bonnegarde and Heugas has been previously proved to be guilty, then they have to revoke without delay the decision of the seneschal of Gascony on this matter and on the restitution of Heugas's lands to him and return them to the previous status. If perchance the lands of Heugas were seized into the hand of Edward II and were delivered to Heugas, then they have to return them into the king's hand, and deliver them to Bernat de Béarn in the form he held them previously according to the allocation of Edward II. On what they will do on this matter, they have to certify the king by their letters patent.

6 March 1330 . Wynton' Winchester . Of the punishment [inflicted] to those who killed Arnaut de Noaillac .

Order to the seneschal of Gascony or his lieutenant to have full information on the murder of Arnaut [de Noaillac] , brother of Noelake Estèbe de Noaillac, Penne in Agen' burgess of Penne-d'Agenais , who petitioned the king on the fact his brother Arnaut was wickedly killed in the said town of Penne by some malefactors and no punishment for this felony and murder happened to them. The king ordered the seneschal of Gascony to inform himself swiftly on the said felony and murder as well as on the names of the malefactors who perpetrated it and to castigate and punish those culpable according to their faults and the local fors and customs, on what he did nothing until now as is understood the king which is very surprising. The seneschal has to learn the names of the said malefactors who perpetrated the said murder and punish and castigate all the malefactors he will find guilty according to the local fors and customs.

Order to the seneschal of Gascony or his lieutenant, the constables, castellans, officials, all the king's bayles and liege men in the duchy, that they should maintain, protect and defend the abbot and the convent of the monastery of Sanctus Vincencius Saint-Vincent of Burgo super Mare, de Bourg 1 their men, lands, things, rents and all their just possessions, as the king granted them his safeguard,and to defend them against unlawful violence according to the law and the local fors and customs.

Grant to Berne, de, Aspeys Bernat de Béarn called l'Aspès in deduction of the 100 l.st. per annum from the issues of the duchy owed to him [by the king] of the value of the lands seized on Hougas Guilhem de Heugas . Bernat de Béarn petitioned the king to be part paid from these lands because Heugas was formerly convicted of felony in the duchy of Aquitaine, but the execution of the sentence was pending, and Heugas was incarcerated in the king's prison from which he broke out and escaped, for which reason he has subsequently been banished and his land seized into the king's hand.

20 March 1330 . Wynton' Winchester . For Pey [II] of Grailly, executor of the will of Asalhida de Bordeaux.

Order to the seneschal of Gascony or his lieutenants to investigate on the [following] matter to learn the truth. The king learned that Pey [II] de Grailly, Benaugesar' vicomte of Benauges and Castellionis Castillon , executor of the will of Burdeg' Asalhida de Bordeaux , his former wife, and was peacefully established in possession of her goods according to her last will and testament, and for their conservation the same vicomte has been put into the king's safeguard, and in sign of this safeguard were fixed and put on these goods the king's pennon, and a grant to have some serjeants to keep these goods was obtained by the vicomte at his request. This safeguard publicly forbade to attempt any unlawful violence on these goods. But Grelino, de Johan de Grailly , 1 Solerio, de Bonet de Soler , Calculi Pey Caillau and some other of their accomplices destroyed without respect this safeguard and expelled the armed body of men of the same vicomte, they took these goods by this attack, and removed with contempt the said king's pennon and from that time they acted in contempt of the king and his authority and thereby delayed the enforcement of the said will and the king's peace. Although punishment for this excess has been made public in the duchy, the seneschal has not yet implemented it, so these malefactors with presumption frequently attacked Pey de Grailly, perpetrating similar damage. The seneschal has to castigate in such way those who happen to be guilty according to their offences and the local fors and customs in a way that will bring fear to others who attempt to breach the king's peace on this matter. So the seneschal has to restore Pey de Grailly into his safeguard and the said possession as it is used for others in similar cases, to maintain and defend him according to the local fors and customs.

Order to the constable of Bordeaux, as the king learned that the wages were usually paid in the regions of the duchy in the current money of these regions beyond the value of sterling, not to pay any wages beyond the value of the same sum in sterling, at the profit of the king.

2 April 1330 . Wodestock Woodstock . Concerning a resolution to obtain on some disputes.

Order to the seneschal of Gascony and the constable of Bordeaux to send to the city of Baiona Bayonne a distinguished member of the king's council in the duchy with the king's letters for the resolution in a friendly fashion of the disputes between the mayor, jurats, hundred peers and the commune of the city of Bayonne on one hand, and the king's subjects of la Vene Labenne , Carberton' Capbreton and Boret [le] Bouret , on the other hand, 1 on the catch of fish and the capture and detention of fishing boats or small ships. The king has requested the mayor, jurats, hundred peers and the commune of the city of Bayonne to be well-disposed towards the resolution of these disputes. And if these disputes cannot be resolved in a friendly way and peacefully a leading member of the king's council in the duchy has to adjourn this business until the arrival of a magnate of the kingdom of England whom the king will send to the duchy for its reformation.

Letter to the Baiona mayor, jurats and hundred peers and the community of the city of Bayonne that he has learned about some disputes between them and certain subjects of the king of la Vene Labenne , Carberton' Capbreton and Boret [le] Bouret on the catching of fish and also the capture and detention of some fishing boats or small ships of the same subjects. The king desires to establish peace in these disputes, so he ordered the seneschal of Gascony and the constable of Bordeaux to send to the city of Bayonne a distinguished member of the king's council to resolve the disputes in a friendly fashion if he can. The king requests them to be well-disposed towards the resolution of these disputes, and if this resolution is not possible in a friendly manner, then this business has to wait until the arrival of a magnate of the kingdom of England[the king] will send to the duchy for reformation who will dispense justice to them and to the other subjects of the king of the same duchy on this business and other matters concerning the duchy.

2 April 1330 . Wodestock Woodstock . For the postponement of the dispute concerning the exactions of two parts [of the profits] from the mint of Bordeaux.

Order to the constable of Bordeaux that he postpone further action concerning the dispute between the king, the Burdeg' archbishop of Bordeaux and the dean and chapter of Saint-André of Bordeaux, concerning the exaction of two parts of the emoluments or profits of the mint of Bordeaux until the coming of John of Eltham, earl of Cornwall , the king's brother, and certain other magnates, whom the king is soon sending to the duchy for its reform, their having full power to resolve the matter in a just manner. 1

Order to the constable of Bordeaux, as Esmon Arnaut Aymon petitioned the king before him and his council that the king owed him 508 l. 12 s. 2 d. 1 ob. for his wages and those of the men of his retinue for the time he was in the service of Edward II , former king of England, father of the current king and the current king in the the war of the duchy as it is shown by the bills sealed of the king's court of Gascony and the constable of Bordeaux, to check these bills and to pay Aymon of what he will find in them or find another satisfaction from the issues of the duchy, receiving from him the said bills and his letters of acquittance. Order to the seneschal of Gascony that having called the members of the king's council in the duchy that ought to be called to make a swift complementary justice according to the local fors and customs about the tithes which Laubesk' Galhart de Laubesc and his ancestors had peacefully from time immemorial in the place of Pitan [Le] Pian[-sur-Garonne] in the jurisdiction of Sanctus Macharius Saint-Macaire . Laubesc petitioned the king about the fact that a former seneschal of Gascony occupied without right these tithes, which are still occupied until now to Laubesc's great expense and the risk of being disinherited, so he requested the king to provide him with a remedy.

Order to the seneschal of Gascony and the constable of Bordeaux to check the letters and memoranda concerning the exchange made by Edward II , former king of England, with Blavia Alaïtz de Blaye, Vrnon' lady of Ornon of some lands and tenements given to Alaïtz in compensation of the Blavia castle of Blaye , as Alaïtz petitioned the king before him and his council that she was removed without reason from the place of Marnyak Mérignac allocated to her at this exchange. Then, the seneschal and constable, having the full advice of the members of the council of the duchy, if they notice that this exchange was at the profit of the king and the agreement or pact has been not yet fulfiled in this circumstance, to fulfil what remain to be fulfiled of this agreement in order to settle it.

Order to the seneschal of Gascony or his lieutenant, the constables, castellans, officials, all the king's bayles, ministers and liege men, that they should maintain, protect and defend Gordonis Guilhem Gourdon, clerk and king's councillor in the duchy , his men, lands, things, rents and all his just possessions, as the king granted them his safeguard, and defend them against unlawful violence according to the law and the local fors and customs.

Order to the seneschal of Gascony and the constable of Bordeaux to see to if Walter de Weston has suitable houses to live in, and in which to keep the king's victuals in the castle of Bordeaux, or in the city as they and Weston will consider appropriate, and they are not to omit to do this, the king having appointed Weston to oversee the taking of various victuals to the duchy to sustain certain magnates that the king is sending there to reform the duchy.

Order to the seneschal of Gascony, or his lieutenant and the king's bayles and ministers nominated in the duchy that they should maintain, protect and defend Securo, de Bernat de Ségur, damoiseau, of Lopiaco, de Loupiac , his brothers Arnaut-Bernat de Ségur and Guilhem-Ramon de Ségur , their families, issues and lawful possessions as the king granted them his safeguard at pleasure, and defend them against unlawful violence. Bernat de Ségur explained to the king for himself and his brothers that Edward II , former king of England, father of the current king, kept the homage of Bernat de Ségur, and his brothers for their lands and possessions for which Bernat paid homage to Edward II as son and heir of the late Bernat de Ségur , their father, for what this latter held from [Edward II] in Lopiak Loupiac in Benaugess Benauges , and that Edward [I] , then duke of Aquitaine, 1 when was alive Henry III , former king of England, great grandfather of the current king, took this land in his hand at the occasion of the war that arose in the duchy 2 and made restitutiom of it to Bernat de Ségur, father of the said Bernat, Arnaut[-Bernat] and Guilhem[-Ramon]. But the current vicomte of Benauges 3 asserting that the homage paid to Edward II had to be done to him, inflicted damage and committed other harm with his force of arms to the said brothers and their families, in their persons and goods, thus the said Bernat petitioned again the king for himself and his brothers to provide them with a remedy. The seneschal of Gascony, or his lieutenant and the king's bayles and ministers have not to permit that they, their families or their possessions be injured in any way, making known publicly the king's safeguard, particularly to the said vicomte and some other persons, and to fix on the goods of the Ségur brothers the king's pennon as a sign of safeguard as often as it is requested by Bernat de Ségur. They have to forbid publicly all under forfeiture of bodies and goods, particularly the vicomte and some others, to inflict unlawful damage on Bernat and his brothers who are under the king's safeguard, whatever their nature, and if after the said intimation and interdiction people break the safeguard, so they have firmly to apply punishments on them by the capture, seizure and detention of their bodies and goods according to what is right.

Guilhem-Séguin [VII], Rynuncio, de lord of Rions petitioned the king before him and his council that his father Guilhem[-Séguin VI], former Rynuncio, de lord of Rions petitioned Edward I , 1 former king of England, grandfather of the current king and complained about his expenses he had in building the walls around the said town of Rions, walls that the men of the king of France destroyed 2 during the war between this latter and Edward I in the duchy without any fault of Guilhem-Séguin VI. Edward I wanting to help Guilhem-Séguin VI in this work ordered the constable of Bordeaux to allocate for the expenses for the building of the walls around the said town up to 2000 l.ch. , and then Edward II , former king of England, father of the current king ordered at the prosecution of Guilhem-Séguin VII the constable of Bordeaux to pay the arrears of what was owed of the 2000 l.ch. granted for the building of the walls around the said town, as is shown in the letters patent of Edward II on this matter that Guilhem-Séguin VII asserts to hold, and this payment has not been obtained by the latter, his father or someone else on their behalf. Letters of credence to the Benaugiar' vicomte of Benauges 1 thanking him for his constant fidelity towards the king and his predecessors, requesting that he continues in his loyalty which has contributed in large part to the peace and tranquillity of the duchy. However, some obstacles to that end have arisen since the king's assumption of government, which are as yet unresolved. He thus sent his envoys to the court of France and hopes for a successful outcome from the negotiations in progress there. The king orders the vicomte of Benauges he gives credence to what John Darcy called le Cosyn and Guilhem-Sans [II], Pomeriis lord of Pommiers shall say to him on the king's behalf to express the king's intentions.

The king adds that he has ordered his brother John of Eltham, Cornubia earl of Cornwall , to go to the duchy with a large company of magnates and nobles in order to improve its condition, and should any actions damaging to them be committed by the seneschal or any other of the king's ministers there, his brother is to ensure that they are redressed.

Letter to the lord of Caumont explaining that the king is sending his envoys to amend certain dubious clauses in the recent peace agreed with the court of France. He is conscious of Caumont's loyalty and good service to the king's father and him, whereby he had lost goods and incurred considerable expenses. The king wishes that the sentence of banishment imposed on him by the court of France 1 be revoked. To this end, he is sending an envoy, carrying his letters to the Tholosa archbishop of Toulouse , 2 in whose keeping of certain letters patent of Charles [IV], former king of France , whereby he promised to revoke the banishment, at the request of the king and his mother. When the king's letters are inspected, he is sure that the banishment will be revoked. Caumont is exhorted to not lose patience as a result of the delay, but to bear the present situation with equanimity, as the issue will soon be resolved.

TNA, SC 8/281/14037 is the petition of Ramon de Montaut at the origin of this entry. There he asserted that his father held lands in the power of the king of England, but that the majority of them were in the power of the king of France. His father did not take sides during the war of Saint-Sardos because he was ill in bed. Ramon, his eldest son, has remained faithful to the king of England. Because of his father's attitude, the seneschal of Gascony seized his father's lands situated in the king of England's power and those situated in the French power are possessed by his younger brothers, so he has nothing left for sustenance, so he requested the king to let him have his inheritance.

At the request of Durfort, the king had ordered 1 the constable to account with him of his wages and fees from the time he was in the service of Edward II , former king of England, father of the current king at Penna in Agenesio Penne-d'Agenais and other places in the duchy at the start of the war until the time he was banished and after the same banishment when Nicolas de Hugate was receiver of the money and victuals of Edward II in the said duchy, and John Travers , Master Medici Aubert Mège and Master John de Weston were constables of Bordeaux, and also of his expenses Durfort made in the same town [of Penne-d'Agenais] for the king's castle of Castrum Galhardum Castelgaillard 2 and the Peliser motte of Pélicier for the service of Edward II and the king [at the rate of] 1 st. worth 5 d.t. , but the constable did not care to apply this, to the surprise of [the king]. Pierre [Roger], bishop of Sens ; 1 Jean [de Marigny], bishop of Beauvais ; Jean [de Vienne], [bishop]-elect of Avranches ; Andrea [Ghini de Malpighi], [bishop]-elect of Arras ; Pierre [de Chastelux], abbot of Cluny ; Seinte Maure Guillaume de Sainte-Maure, chancellor [of France] ; Miles [X], Noiers lord of Noyers and de Essarz Martin des Essarts , councillors of the king of France, [the king's] lord; negotiators of [the king of France] for the said treaty; and Adam [Orleton], bishop of Worcester ; William [Ayermine], bishop of Norwich and Shordich John de Shoreditch , messengers and proctors of the king of England, duke of Guyenne sent to the king of France, sent on the behalf of their respective kings to negotiate on the articles, demands and requests following, and with the full power to do this by their letters patent sealed with their respective seals, the tenor of which follows, have agreed upon the following articles, demands and requests:

  1. First, the men of the king of France assert that, at the last peace or agreement signed during the reign of the current king of England, it has been agreed that all things and lands taken by force by the men of the current king of England will be returned to the king of France and set to rights, similarly for the things and lands taken by the men of the king of France from the men of the king of England.
  2. But the men of the king of France say that the men of the king of England did not do the said restitution, so the men of the king of France request to have full restitution, and if the men of the king of England say to them that some restitution has to be done, the king of France will do it.
  3. Item, the men of the king of France say that because of the same treaty of peace or agreement, the king of England has to pay to the king of France the sum of 50.000 m.st. for some reasons explained in this treaty.
  4. Item, because of travel to the duchy of Guyenne 2 [the king of England had to pay] 60.000 l.par. and the deadlines of payment of this sum have been exceeded, fully or in part, so they request to make satisfaction to the king [of France]
  5. Item, because the men of Dagenais Agenais complain of some novelties at Burdeaux Bordeaux and elsewhere, of some taxes levied in the land held by the king of England in the duchy of Guyenne against their customs, liberties and old franchises which are, as they request, to be respected according to the form of the peace and the novelties must be nullified.
  6. Item, the men of the king of France say that the money of the king of France is out of circulation in the land which the king of England holds in the duchy of Guyenne.
  7. Item, several banished people of the kingdom of France are received in the said duchy of Guyenne.
  8. Item, the men of the king of France assert that the castles of the twelve nobles who were banished from the kingdom of France following the last agreement have not be destroyed in the agreed manner, so they request them to be destroyed without fraud, and that no other fortresses have to be built on the site of these castles, and those which were built have to be destroyed.

There are the requests made by the king of England and duke of Guyenne:

  1. First, he requests the king of France to return to him the place of Sales Salles[-Mongiscard] with its appurtenances occupied by the Fois count of Foix , and the place of Sarrafront Sarron occupied by the Darmignac count of Armagnac according to the last treaty of peace, and also it has been promised and sworn by the marshal of France , Sir Galart Peire de Galard and Sir Solegnac Béraut de Solignac, Thoulouse seneschal of Toulouse , knights, commissaries appointed by the king of France to accomplish this peace, they will be returned with the issues levied on them since the said peace.
  2. Item, the place of Autirac Tirac occupied by the Daunay vicomte of Aulnay since the last war 3 be returned to la Mote Amaniu de Lamothe .
  3. Item, that the appurtenances of the castle and Puy Guillem castellany of Puyguilhem and all their jurisdiction be returned to Bascle de Gout Bascol de Got, Puy Guillem lord of Puyguilhem , 4 according to the last peace. There were returned to him by Despaigne Alphonse d'Espagne when he was before the castle of Puyguilhem and because of the said peace, and the king of France was restablished in the seneschalcy of Agenais, but these appurtenances were occupied by the French without any reason.
  4. Item, commissaries have to be despatched by the two parts on the fulfilment of the peace recently agreed and on the repairing and reformation of the things done against the content of the peace. The king of France has to restablish things to the king of England, and his men and subjects whatever has been done against the form of the said peace, as the representatives of the king of England will show to the those who will be appointed commissaries.

On these demands and requests written above presented by the men of the king of France to the king of England, duke of Guyenne, their respective councillors, diplomats, messengers and proctors had a great deliberation and agreement in the following manner:

  1. First, on the first request made by the men of the king's lord, the king of France, on the lands seized, the fulfillment of the restitution will be done now without delay according to the content of the agreement previously made on the occupied lands on the king of France by the men of the king of England and duke, and the same will be done of the lands occupied by the king of France and his men on the king of England and duke.
  2. Item, on the second and third request mentioning the money owed to the king of France, agreement that if it is found in the old treaties of peace or other obligations that the king of France owes to the king of England some of money, this sum will be deducted from the sum requested by the king of France of the king of England and duke, and what will remain on both sides will be resolved as soon as possible.
  3. Item, on the fourth article on the Dageneis men of Agenais complaining of several novelties, etc, it is agreed they have to be held and kept in their liberties and franchises according the form of the peace, all novelties being removed.
  4. Item on the fifth article where the men of the king of France say that his money is out of circulation in the duchy of Guyenne, it is agreed that the money of the king of France is legal currency in the duchy of Guyenne, and its value has to be proclaimed by the ministers of the king of England and duke in the duchy of Guyenne at the mandate of the king of France.
  5. Item, on the sixth article mentionning the banished people, the agreement is that those yet banished or who will be banished, for trespass or misdeeds by the Court of the king of France or his Parlement of Paris or by the seneschals or other officers of the same king in the case that they banish some of their subjects or others because of some trespass or misdeeds made in their jurisdictions, are from now not to be received in the duchy, but it is not the will of the messengers of the king of England and duke that, by this agreement, the said seneschals have the power to banish the seneschals, nor other officials or ministers of the king of England and duke because of some disobedience, misdeed or trespass accomplished by them in their office, nor other subjects of the king of England and duke because of misdeeds or trespass made in the duchy, even if the king of France or his court can do this because of their sovereign jurisdiction. And it is not the will of the diplomats sent by the king of France that this agreement causes prejudice to the king of France or his officials on these things or other rights if some of these were owned by them by right and custom before this present agreement.
  6. Item on the seventh article on the non-destroyed castles agreement is that the king of England and duke will demolish without delay the castles which have to be destroyed according to the form of this agreement.

It is agreed on the requests made on behalf of the king of England and duke [of Guyenne]:

  1. First, on the first request to have returned the place of Sal' Salles[-Mongiscard] , etc, it is agreed that the said places will be returned according to the form of the agreement.
  2. Item, on the second, the place of Autirac Tirac be returned to la Mote Amaniu de Lamothe , etc, is agreed, and has to be done by common commissaries sent to execute the agreement.
  3. Item on the third request on the appurtenances of the castle and Puy Guillem castellany of Puyguilhem and etc, it is agreed that the truth will be researched by common commissaries according to the form of the last agreement.
  4. Item, on the fourth, that commissaries have to be nominated on both sides, it is agreed that the two peaces agreed during the time of King Charles [IV] , predecessor of the current king of France on one hand, and the father of the current king of England 5 and the current king of England be fulfilled on both sides according to the form and content and according to the form of the agreements made between the men of both kings. And all the things agreed above by the councillors, diplomats, messengers, and proctors of both kings be kept and firmly fulfilled.

The councillors and diplomats delegated by the king of France on the said things swore that, when the said messengers and proctors of the king of England and duke will bring back or sent back this present treaty or agreement, ratified, approved and confirmed by the king of England and duke by his letters sealed with his great seal, the said king of France will confirm and ratify it by letters under his great seal in the same manner that the king of England will have done. And the messengers and proctors of the king of England and duke named above swore that the king of England and duke will ratify, approve and keep this present treaty and agreement by his letters sealed with his great seal, and they will send these letters to the king of France at the next feast of [Mary] Magdalene 6 . The tenor of the letters of the kings of France and England giving their representatives power to act in this negotiation follow:

As token of these things treated and agreed as above is said, the councillors and diplomats delegated by the king of France and the messengers and proctors of the king of England and duke have put their seals at this present treaty and agreement.

On which things, the king of England has sent to the king of France confirmation in the most suitable form that appears to the king and his council and the king of France has not yet accepted it. The king of England wants the said things be held and kept as far as he can saving the rights of the king's subjects of his duchy of Guyenne and the fors and customs sworn in the king's name.

Order to the senechal of Gascony and the constable of Bordeaux to have information, whatever the means used, as Garbache Fortaner d'Esgoarrebaque petitioned the king that several of his men, nobles as others, were killed by the men of the king of France in the last war of Gascony that broke out, 1 and others were made prisonners by the same French in the same war and Fortaner paid several sums of money to free these captured men, so he requested the king, in compensation of the damage he endured to grant him the bastide and place 2 of Seint Gyen Saint-Gein and Frondebeau Rondeboeuf to have for life worth a farm of 36 l.st. , it is asserted, together with the office of the driving and counting 3 of the cows [who pasture on the moors] of the Landarum seneschalcy of the Landes 4 to have for life. The king wants to have certification on the true value of the said bastide and place with its issues per annum and what forms these issues take, and information sent to the king under the king's seal in use in the duchy.

There Esgoarrebaque explained that he lost one day at Talmont[-sur-Gironde] three nobles, twelve foot serjeants and eleven horses killed next to him by the men of the king of France; and one of his knights as well as four nobles were taken and imprisoned for two years. And because of their ransoms, Esgoarrebaque paid a great sum of money without any help from the king's men. So he requested in compensation of his damage to have for life the office of the driving and counting of the cows he held in farm for 24 l.st. per annum from the constable of Bordeaux, and the bastide of Seint Gyen Saint-Gein and Frondebeau Rondeboeuf which are farmed for 36 l.st. per annum. On the dorse, the king agreed he has the office of driving and counting of the cows for life, keeping the 24 l.st. for himself. But he ordered the seneschal of Gascony and the constable of Bordeaux to learn the value of the bastide and then certify him. Letters of notification to John Darcy and John de Haustede , seneschal of the duchy of Guienne Guyenne , giving news of the king's business on which the bishop of Chester 1 and the bishop of Norwich 2 have been at the court of France. 3 These messengers returned before the king and informed the king that the king of France and his council did not want to accept the answers the king through his messengers to the request the king of France made, even if these answers were just and reasonable, and he did not reply to the requests of the king of England, but this king said himself to the =king of England's messengers that from now on he did not want to have treaty with him. So the king of England wants Darcy, Haustede and his subjects of the duchy openly know the negotiation the king proposed to the king of France to obtain a peace in order to avoid all form of discord, the king sent to them the requests made by the king of France and the answers made to these requests by the king's messengers in order that they openly know and are able to show to the king's subjects of the duchy the offensive and unreasonable behaviour shown by the king of France as a man who does not care or does not have the will to do him justice, but apparently wants the king of England's dispossession. Consequently, the king informs them that he made the decision, after advice and deliberation of his most reliable council, to seek the help of king's friends he might have, to defend, with God's help, the his rights, inheritance and his said subjects against the wickedness and the force of the king of France if he wants to wage war on him. And because the king still suspects that the king of France is thinking of sending an army towards the duchy of Aquitaine before the next winter season or to come there in person to put the duchy in his hands, the king informs them that in the case that the king of France sends some of his ministers to carry out in the duchy some of the articles between him and the king according to the content of the agreements, without any force that increases the perils in the king's lands, the seneschal of the duchy and the other king's ministers of the duchy kindly endure with pleasant talk without much resistance to get through these wicked times in order to prevent at another time the said executions when the king will have more time, and by such concealment the king and his subjects can avoid having abrupt damage with the destruction of their vineyards and their other goods and chattels. But if the king of France comes with an army or sends an army by which it is clear he comes to destroy and ride over the country and conquer the king's possessions, then he orders them and his liege men of the country to do their best to organize the resistance of the king's towns, castles and fortresses of the country under their authority until the king can send as soon as possible, with God's help, a rescue, promising to the king's subjects, about the damage and losses they could receive because of the maintenance of the king's heritage and their loyalty towards the king, the latter will compensate them of their losses and damage more generously than any of the king's ancestors in the past, as the bearer of these letters could say further in more detail. Concerning money to them, the king knows well that things cannot be maintained or be pursued, the king informs them that he will assemble a general council at Notyngham Nottingham with the prelates, counts and barons of his kingdom within a fortnight of next Michaelmas, and he will decide there in such manner with advice of his council that Darcy and Haustede and all the king's good men will be well conforted by a great sum of money and they will have enough means so they will be able to enlist men-at-arms and pay wages for the maintenance of the king's estate and to crush the French with God's help. So the king orders them to perform the said things in the best way they can with the advice of the members of the king's council in the duchy they trust the most, as Sir Till' Arnaut de Tilh, king's clerk and private adviser of the king , 4 will fully inform them.

The king pardons as well the corporal punishments inflicted on him and grants him his firm peace. Order to the constable of Bordeaux to return to Alesia Alicia , widow of Berfrei Reyner de Berfrey, Bristoll' burgess of Bristol , or his attorney all the Berfrey's good and chattels seized for the king at Bordeaux , allowing the execution of Berfrey's will. Alicia, executor of the will of her late husband has petitioned the king that when Berfrey was travelling towards the duchy of Aquitaine in a ship called la Leissoca of Bristol in which Roger Pynnok was master, in order to sell his goods in the duchy, and Berfrey had a natural death on this ship. As Berfrey had died intestate, all the goods which were in this ship have been seized in the king's hand according to the old custom of Gascony. But according to some letters patent of R[alph of Shrewsbury], bishop of Bath and Wells , presented to the chancery by Alicia, Reynard Berfrey made his will on 18 September 1330 and appointed his wife as executor of his will, and the said bishop, who had the administration of Berfrey's goods, granted them to Alicia.

Order to the seneschal of Gascony and the constable of Bordeaux to investigate to know the period when the receivers and lieutenants of Adam de Lymbergh, clerk, former constable of Bordeaux for Edward II , have rendered accounts, for which period they did not do it and for which reason, who were the receivers during the French chevauchée, which ones have rendered accounts or not, if yes to whom and when, and if the receivers of the time of the chevauchée have accounted with Lymbergh. Lymbergh has explained to the current king that Master Sancto Sereno, de Guiraut de Saint-Céré , treasurer , receiver and lieutenant of Lymbergh in Périgord, Quercy and Limousin, and Master Albinione, de Guilhem-Ramon d'Auvignon , treasurer , receiver and lieutenant of Lymbergh in Agenais, have expended their revenues in paying wages for men-at-arms and in arming fortresses, but as these territories have been occupied by the French before they rendered their accounts to Lymbergh and they have been forced to render their accounts to the king of France, Lymbergh was not able to summon them as they lived in French controled area. However, the treasurer and the barons of the exchequer want to make responsible Lymbergh for these revenues, so Lymbergh requests a discharge.

Order to the constable of Bordeaux, or his lieutenant, to inspect the letters of Edward [I], late king of England , the king's grandfather, of Edward [II], late king of England , the king's father and the letters procuratory of la Farge Ramon-Guilhem de Lafargue concerning the debt owed by the king's grandfather, and if it is found that the king's grandfather did owe the sum, that Lafargue is the proctor of those to whom it was owed, and neither those people or their proctor had yet been satisfied, then the constable is to cause Lafargue or his substitute to be paid the 320 l.st. or the value of the same in another currency, receiving from him the letters of the king's grandfather, father and the letters procuratory, together with sufficient acquittance from Largargue attesting his receipt of the money; and the constable will have due allowance in his account.

Lately Edward [II], at the request made to him by Arnaut de Saint-Martin, merchant of Baiona Bayonne , by petition exhibited before the king and his council, alleging that Edward [I], by his letters patent, was bound to certain men of Gascony in a sum of 320 l.st. for the arrears of wages from the time of the war between that king and the king of France, and that he was their proctor, ordered his then constable of Bordeaux to inspect the letters of Edward [I] and Saint-Martin's letters procuratory, and if it was found that the debt was owed, Saint-Martin was proctor, and neither the men or their proctor had been satisified concerning the debt, then he was to make payment in sterling or another currency from the issues of the duchy, just as was contained more fully in the latter's patent of Edward [II]. However, the money has still not been paid, and Lafargue, now the proctor of the men, has requested, by his petition exhibited before the king and his council, that the king will satisfy them of the full sum, and the king wishes to agree to this.

Order to the constable of Bordeaux to account, if it has been not done before, with Durandi Ramon Durand as this latter petitioned the king before him and his council that several sums of money were owed to him for his wages and those of Turribus Bertran de Lastours, kt , and other persons of his household, as well as for the restor of their said horses for the time they remained in the service of Edward II , former king of England, the king's father and the king in the wars that broke out in the duchy, and requested the king to pay them this sum or find another satisfaction. The constable has to very shortly pay these wages and restor of horses or find another satisfaction from the issues of the duchy in as much quantity of good money to Durand of what he will find in the account. The constable will have due allowance in his account.

Order to the constable of Bordeaux to check the bills of the constable of Bordeaux by which the king owed to Durandi Ramon Durand some wages for him and his retinue for the good service he did towards Edward II , former king of England, king's father and the king during the last war of Gascony, service for which, by the form of the peace made between the king and the king of France he was and is banished from the kingdom of France, these wages being allocated to him to be received during the banishment, but he has not yet paid of this wages, he asserts, and these wages were accounted in weak money with the constable of Bordeaux as it is shown by bills sealed by their seals owned by Durand and as Durand petitioned before the king and his council. The constable has to pay without delay in good money to Durand what is owed of these wages or find another satisfaction from the issues of the duchy, receiving from Durand the said bills. The constable will have due allowance in his account.

Grant forever to Bernat, Toyouse lord of Toujouse , because of his good service to the current king and his ancestors, former kings of England, and to the king and his heirs, of the high and low justice in the parishes of Sainte-Marie de Toujouse and Calkebane Saint-Pierre de Cocabane to have him and his heirs with all the esporles, fees, homages, rights, money and other appurtenances that the king has or should have in these said parishes, to be held from the king or his heirs by liege homage, excepting the resort of the king and his heirs in the said parishes.
