Physical condition of the roll

The roll consists of fifteen membranes. There are entries on all of the face sides, but on none of the dorses. The roll is generally in good condition.

C 61/114, 1 Henry V (1413-1414) .

This roll, the first of the reign of Henry V, does not show any major differences from the rolls of the reign of his father. As was common for the beginning of a new reign, several entries confirm acts of the previous reign. Hence we find confirmations of grants given by Henry IV to Robert Holme, Carlos de Beaumont, Hugues Brouard and Pons VII de Castillon. 1 The office of bayle of Pouillon (Landes) granted for life by Henry IV to Bernat de France in 1412 was granted for life to Guiraut de Lestrade on 22 April 1413, while France was granted to receive a yearly sum of money as compensation on the small customs of Southampton. 2 Several offices and revenues were granted to Englishmen. 3

However, as in other areas of policy both at home and abroad, Henry V already showed he wanted to control to a greater degree the government and the finance of the duchy of Aquitaine. This is revealed by the new appointments he made of the constable of Bordeaux, the mayor of Bordeaux and his lieutenant, as we shall see, but he also asked on 12 June 1413 for a full report on all the lands, offices and revenues granted since the beginning of the reign of Edward III, and seized of all them into his hands. These radical measures were a consequence of the constant shortage of money to defend the duchy and to pay the wages of the king’s officers there. 4 Nevertheless, the rich and powerful Henry Bowet, archbishop of York, who had been constable to 1401 before his promotion to the bishopric of Bath and Wells (he had become archbishop of York in 1407), complained about this order and was exempted by Henry V from having the possessions he had obtained in Aquitaine seized by the king’s officers. 5

An attempt to control appointments to ecclesiastical benefices within the papal obedience acknowledged by the English crown (the papal schism was still continuing) seems to have failed. 6 But Guiraut de Brie, a liege man of the king of France from Cahors, finally succeeded in becoming dean of Saint-Seurin of Bordeaux and canon of Bordeaux despite the opposition of two Gascon clerks who hailed from Bayonne. 7

In order to avoid fraud on the payment of English customs, Henry V ordered his constable of Bordeaux, William Clifford, who had been appointed on 23 March 1413, only two days into the new reign, 8 to collect the cockets of English custom officers for goods brought in Bordeaux or Bayonne by English merchants and to send them to the English exchequer. 9 The king also confirmed the levy by three commissaries of a special taxation levy decided in 1413 by his brother the duke of Clarence to finance his 1412 expedition. The king's confirmation followed the same rules: no poll-tax to be raised and no esluz to be appointed by the Three Estates. 10 On 1 April John St John was appointed mayor of Bordeaux. 11 Powers were given to the king's uncle, Thomas Beaufort, earl of Dorset, who was in control of the duchy at the return of the king's brother, Thomas, duke of Clarence, to England shortly after the new king's accession. Dorset was formally appointed lieutenant on 23 July 1413 with 240 men-at-arms and 1,000 archers under his command. He continued military actions into Angoumois and Saintonge, taking several places which were then placed under the auspices of the duchy. 12

Two entries deal with complaints of the city of Bayonne. The first concerned the toll at Guiche on the river Adour which had been granted to Carlos de Beaumont by Henry IV. In making its complaint Bayonne was united on this occasion with other places situated on the course of the river Adour since Dax and Saint-Sever had also complained to Henry IV about this new toll. Henry V appointed two Gascon commissioners to hear and conclude this case. 13 The second entry concerned the fortalice built illegally, in the opinion of the men of Bayonne, by their neighbour the lord of Espelette. 14

There are also details about a complex trial between Henry Bowet and William Farringdon, who had been successive constables of Bordeaux, Bowet until 1401 and Farringdon from 1401 to 1413. Witnesses were to be heard both at Calais and Bordeaux. 15

Worthy of note is the assertion of the Bordelais Guarin d'Arengosse that the king had the right to create a new minter of Bordeaux and the duchy of Aquitaine at the time of his coronation. 16 Also notable is the confirmation of the lands and rights of the captal de Buch, Gaston de Foix, a leading supporter of the English ducal regime. 17

Barton is going, by the king's order, towards the regions of Aquitaine for the delivery of the Frounsak castle of Fronsac where Swinburne was captain. Commission of oyer and terminer to judge in appeal to both Master Bertran d'Aste, doctor of canon law , judge of the court of Gascony , Cerpot Guilhem Sarpout , 1 judge of the king's high council of the city of Bordeaux 2 Furthermore, the king firmly orders them, if they do not reach an agreement between both of them, they must make inquiries and later certify the king without delay before the 1 May 1414 concerning the articles mentioned below, so that the king may put an end to this appeal:

  1. first, if the new toll of Guiche is prejudicial to the franchises, liberties and privileges of the cities of Bordeaux, 3 Bayonne, Dax, the town of Saint-Sever and their regions around them, and to the prejudice of the merchants coming with their goods and leaving these cities, and they might stop coming there because of this new toll;
  2. for what reasons;
  3. if this toll is levied within the borders of the toll of the castle of Bayonne and the jurisdiction of the city of Bayonne;
  4. if this new toll is situated in the jurisdiction and territory of the Guissen castle of Guiche ;
  5. how distant the river [Adour] is from the castle of Guiche;
  6. if this new toll has been created against the franchises and liberties of these cities, and especially Bayonne, and to the prejudice of the tolls of the king's castle of Bayonne , of the places of Sordua Sorde , Peyreforard' Peyrehorade , Fastingues Hastingues and the Aquen' castle of the city of Dax ;
  7. if the castle of Guiche has jurisdiction and lordship on the river Adour and if the merchants coming with their goods on this river to Bayonne and returning from there are compelled to pay this new toll;
  8. if Carlos de Beaumont abuses his right in this levy beyond Henry IV's grant.
Order to the seneschal of Aquitaine, the king's council of this duchy and all the king's officers to obey and attend them in this matter.

On 22 August 1409, Henry IV had granted by his letters patent to Beimont Carlos de Beaumont, castellan of Mauléon , 4 at his supplication, for his lifetime, to receive in person or through his proctors a toll levied on the goods passing through the river Adour and the fishery of Guiche : 5 hardis guyennais for each load ( sumagium ) of cloth or other good, 2 hardis guyennais and half for each pipe of wine, 7 hardis guyennais for each barrel of woad, 5 2 hardis guyennais for each cartload ( carectata ) of iron, half of a hardi guyennais for each head of cattle, 2 hardis guyennais and half for each quintal of iron, 5 hardis guyennais for each piece ( tractus ) of leather, each hardi is worthing half penny ( obolus ), if it not at the prejudice of anyone who has franchises or tolls in these regions. And thereafter, the mayor, échevins, jurats, consuls and hundred peers of the city of Bayonne appealed to Henry, complaining that this new power was to their prejudice, and the jurats and community of Saint-Sever and the jurats and community of the city of Dax have joined this appeal. Bayonne, Saint-Sever and Dax have pursued this appeal before Henry IV, and now have supplicated the king to appoint commissaries to issue a final decision. 6

Formerly, Thomas [of Lancaster], duke of Clarence , earl of Aumale, king's lieutenant overseas, brother of the current king, had went with men-at-arms and archers in the land of Guyenne for its defence, and he summoned before him [as king's lieutenant of Henry IV in Guyenne] the Bourdeux, Burdaloys Three Estates of Bordeaux and Bordelais , as he was unable to keep the land in the king's obedience without help of the land [of Guyenne] and he requested the Three Estates to provide him convenient remedy. After several meetings, the Three Estates offered to levy:

Grant for 20 years, with the king's council assent, to Carlos de Beaumont, alférez of Navarre , of the land of Noaillan with all the lands, tenements, revenues pertaining to it and with all the lands and revenues which were owned for life by Johan Cantiran in the city of Bordeaux and in the towns and parishes of Marinach' Mérignac , Becla Bègles , Villa de Navus Villenave[-d'Ornon] and Cadaynach' Cadaujac and others in the duchy, in the same way that Johan de Cantiran held them during his lifetime. The king furthermore grants to Beaumont for his lifetime the custom on the wine called issac of Bordeaux, after the death of Radegonde Béchet, Mortemer lady of Morthemer who holds this custom for life according to a grant of Richard II . The king also grants to Beaumont the licence to bring and carry, him or his attorneys, 120 tuns of wine coming from the rebel places of the duchy 10 without paying any tithe or custom at the castle of Bordeaux or elsewhere and without bringing any wheat with this wine, and with priority before any others having such licence, in the same way as Tolleo, de Guilhem de Thouil , former clerk of the city of Bordeaux , had for life by the king's grant. Beaumont will render each year for 20 years 100 fr. at Easter and Michaelmas by equal portions. 11

Grant for life to John Dupont , the secretary of the duke of Clarence , of two houses with the profits, rights, rents and revenues pertaining to them. These two houses are situated in the street ( carreyre ) stretching from the Lombriere, Bourdeaulx castle of the Ombrière of Bordeaux to the Saint Pietre church of Saint-Pierre , 1 more precisely from the great gate of this castle to the other gate, and their rears adjoin the great tower ( grosse tour ) 2 and wall of this castle, while their fronts are on this street. These houses were formerly owned by la Barde Bos de Labarde, esquire , by grant of Henry IV . 3 They were sold by Labarde to Pigon Thomas Pigeon and confirmed for life to Pigeon by Henry IV. 4 But they have returned to Henry IV following Pigeon's death. Grant to Broart Hugues Brouard, esquire , 1 of the castellany of Cubzac and the office of castellan of this castellany with the crossing ( passagium et repassagium ) of the port of this castellany with also all the revenues, grain, wine and money as well as all the woods, pastures, questaux ( homines questales ) 2 pertaining to this castellany, to be held by Brouard for his life time from 30 May 1407, in the same way that Johan de Grailly and the other previous castellans had held it, notwithstanding the grant of the crossing of the port of Cubzac to Gombaut-Arnaut de Tizac made on 18 August 1407 3 which has been cancelled because of an ordinance of the king in the last Parliament held at Westminster 4 forbidding the grant of any issues of the land of Aquitaine from the beginning of this Parliament 5 until the end of the following Parliament. 6 As on 30 May 1407, the king had granted to Brouard for life, by letters patent, the office of castellan of the castellany of Cubzac with the fees, wages and profits pertaining to it, to be held in the same way the late Johan de Grailly held it, Brouard having returned these letters into the king's chancery for cancellation, asserting they were not valid since some revenues of the castellany were not included. 7

Order to Thomas [Beaufort], earl of Dorset , king's lieutenant in Aquitaine , the seneschal of Aquitaine, the seneschal of the Landes and the bayle of Hastingues to keep in the king's hands the place and parish of Léren and the Sanctus Petrus house ( aula sive sala ) of Saint-Pé of Sendos Juson with its appurtenances until the trial between Ramon-Arnaut de Domezain and the lord of Gramont is fully ended according to the local law, fors and customs, when the party to these places should pertain. Ramon-Arnaut [de Domezain], Domezayn lord of Domezain , kt , had supplicated the king that he had by hereditary right the place called Léren with its appurtenances, owned by his ancestors from time immemorial; and Domezayn Martin de Domezain, kt , father of Ramon-Arnaut, bought the house of Saint-Pé of Sendos Juson, situated within the seneschalcy of the Landes et in the baylie of Hastingues from the girl who had inherited it. And Martin and Ramon-Arnaut owned these places until Henry IV granted them after a false prompting, and Gornay Matthew Gournay, kt , 2 then seneschal of the Landes , delivered them to the Dagremont lord of Gramont 3 by virtue of Henry IV's letters without summoning the other party; 4 and thereafter the late Hugh Le Despenser, kt , and Henry [Bowet] , [now] archbishop of York , former commissaries of Henri IV [in the duchy of Aquitaine], 5 summoned the parties at Sanctus Severus Saint-Sever and after hearing them the commissaries decided to return these places to Martin de Domezain, notwhithstanding Henry IV's letters patent; but subsequently four years after, 6 the lieutenant of Matthew Gournay returned these places to Gramont against the commissaries' sentence and to the prejudice of Ramon-Arnaut who is seeking remedy from the king.

Order to Thomas [Beaufort], earl of Dorset , king's lieutenant in Aquitaine , that having checked the tenor of the general truces made between the representatives and commissaries of the king's adversary of France 1 for his lands and subjects and the king's ambassadors and representatives for his lands and his subjects by land and at sea, he has to proclaim publicly these truces in all the places of the duchy where he finds it expedient, and he should make them respected. These truces will last from 2 February 1414 to 2 February 1415 2 as appear in the letters patent of the French ambassadors the king them him attached with these presents.
