C 61/45 7 Edward III (1333-34)

Introduction.

In this roll we see how Edward III tried to improve the duchy of Aquitaine’s finances which had been badly hit by the war of Saint-Sardos (1324-7). He ordered his constable and controller of Bordeaux to pay his debts at the lower rate of money of the duchy of Aquitaine and not at the higher rate that was otherwise being used at this time. 1 Hence the financial records had to be closely checked. 2 A special committee made up of three Gascon clerks was appointed to check the accounts of the late John Travers, a former constable of Bordeaux (1331-34). 3 The seneschal of Gascony and the constable of Bordeaux were ordered to resume into the king’s hands all the baylies, issues, rents and offices that had been granted by their predecessors John de Haustede and Pey de Galician without the king’s warrant. 4

Judicial conflicts in Aquitaine between the officers of the king of England and those of the king of France seemed to have become more complicated, as is revealed by the king making several measures on this matter. The Gascon Bertran Ferrand was appointed by the king to continue royal business concerning the last treaty of peace signed with the king of France. 5 Six Gascon advocates and proctors of the king were to show records of their suits at the Parlement of Paris to the king’s advocates and proctors there. Elias de Joneston, keeper of these processes, was ordered to do the same. 6 As in the previous roll, two English king’s clerks alongside two Gascon clerks were to enquire about lands and revenues occupied on both sides by the kings of England and France and their subjects. 7

Letters of protection were granted to Gascon lords (the lords of Castillon and Laneplàa) as they planned to join the king’s army in England to fight in Scotland. 8 The Bayonnais Guilhem-Arnauton de Bielle was pardoned for the murder of Per-Arnaut de Lesbay because he took part in the royal war in Scotland. 9 Great quantities of wine had to be sent to supply the king’s army fighting the Scots. 10

Because of the killing of Ramon Durand, seneschal of the Landes, during a ‘police operation’ against some noble bastards of the Landes, someone else had to be appointed to this office. 11 The vicomte of Tartas Guitart d’Albret wanted the king to acknowledge his purchase of the lordship of Guiche (in Labourd), though he occupied by force its castle against the late Ramon Durand who had bought the lordship before him. 12 The seneschal of Gascony, Oliver de Ingham, had obtained money from Ramon Durand which was claimed by the Pope because it had been taken from the goods of a deceased bishop of Dax. 13 Because the Pope had not been paid, Ramon Durand had been excommunicated and his body had not yet been buried in consecrated ground. 14 Galhart Durand, son and heir of Ramon Durand, complained that the bastards who were murderers of his father, were still in the duchy despite their banishment. 15 Gui Durand, Ramon’s brother, had had to stop his studies because of his brother’s death. He now requested the king to ask a benefice or prebend for him to the archbishop of Bordeaux. 16

One entry asserts that it was customary to appoint Englishman as mayor of Bordeaux and underlines that the appointment of Guilhem-Sans II de Pommiers to this office (1332-3) was exceptional. It appears that this assertion was untrue and reflected more the policy that Edward III wanted to follow from now on, the king having the right to appoint the mayor. Indeed, after Pommiers, all the mayors of Bordeaux would be English until 1451. 17 In order to avoid conflict between local nobles appointed to locally strategic offices and the local inhabitants, Edward III also wanted to appoint Englishmen to the keepership of the towns of Puymirol and Penne-d’Agenais, the only two strongholds he still held in Agenais. 18

A group of Bordeaux citizens requested again 19 to have a religious fraternity confirmed by the king. But the king did not grant this since he did not have the rules of this fraternity and feared that it could cause trouble to his royal authority at Bordeaux. 20

The community of Bayonne complained about the decision 21 on fishing rights which favoured the inhabitants of Labenne, Capbreton and Bouret. 22

The king tried to continue to pay annual rents to influential members of the family and close associates of Pope John XXII (who came from Cahors), such as Cardinal Gaucem Johan, 23 two of the Pope’s nephews, 24 the Pope’s usher Arnaut de Commarque, 25 and a brother of another person close to the Pope. 26

Martin de Vera, Edward II’s surgeon, was granted an annual rent on the revenues of the duchy of Aquitaine (here the ovens of Sainte-Foy-la-Grande). 27

We learn that 404 sacks of wool brought from England to Gascony by the Bardi society had been arrested at Bordeaux by the seneschal of Gascony and the constable of Bordeaux, because the latter considered that the Bardi had not paid the English customs due on them. 28

[in French]

Letters of appointment of John Travers, canon of the church of Lichfield and Master Oxenford John de Oxford, judge , diligently to accomplish in every particular the clause mentioned below of the agreement made between the king and the king of France with the two delegates appointed by this latter on this matter or one of them. They have to honestly report to the king what they have done and order according to the content of the said agreement and clause, and the king gives to them full power on these matters. The king ordered all his justices and subjects to obey them in all the things concerning this agreement and clause. Formerly, the king nominated to the fulfilment of this agreement the said Travers and Master Ildesle John de Hildesle, Cicestre canon of the church of Chichester , with the two delegates appointed by the king of France or one of them, 1 and as Hildesle cannot do this, Oxford is deputed instead of him. A certain agreement has been formerly made between the councillors, negotiators and proctors of Philippe VI, king of France, the king's lord and cousin , namely Pierre Bertrand, Custoun bishop of Autun ; Andrea Ghini de Malpighi, Darraz bishop of Arras ; Jean de Vienne, Tirwan bishop of Thérouanne ; Pierre de Chastelux, abbot of Cluny ; Seynt Maure Guillaume de Sainte-Maure, chancellor of France ; Gui Baudet, clerk ; Raymond Saquet, clerk ; Miles X, Noiers lord of Noyers , kt ; Guillaume de Flote, Revele, de lord of Ravel , kt and Coigners Pierre de Cugnières, kt , on one hand and the king's messengers and proctors, namely Adam Orleton, Wircestre bishop of Worcester ; William Ayermine, Norwiz bishop of Norwich ; Guillaume I d'Avesnes, count of Henau Hainaut ; Henry de Percy ; Daudeleye Hugh d'Audley and Shordich' John de Shoreditch on the other. The king expressly ratified, approved and confirmed this agreement and among other things there is this clause: Item, on the lands and immovables taken by the king of England, duke of Guyenne, his men, his subjects and obedients on the king of France, his men, his subjects and obedients since they submitted to the late king of France and the late Charles, count of Valois or another in the name of the king of France and the same is agreed for the lands and immovables taken by the king of France, his men, his subjects and obedients on the king of England, duke of Guyenne, his men, his subjects and obedients, since and against the truces formerly passed before le Reole La Réole , between the said Charles, count of Valois and Edmund of Woodstock, earl of Kent until the peace has been made between Charles IV, king of France and Edward II, king of England, duke of Guyenne, father of the king . It has been agreed that four people will be chosen, two by one part and two by the other, and they will fully inform themselves by any means they could, in hearing the proctors of the said kings and those who are concerned by the said takings, detentions and occupancies who want to come, who possessed and held the said occupied lands at the time of the said submission and at the time of the said truce, and when they have been taken, occupied and kept, and by whom and the circumstances of what happened. And everything they will find occupied by the king of France, his men, subjects, obedients, nobles and others after the said submission before or after the said truce until the time of the peace made between Charles IV and Edward II, the said four people or two will seize the issues in their hands for one part and the other, and they will keep them in their common hands, or they will deliver them to some people to hold them for the said parts. And the same is agreed for the king of England and duke of Guyenne, his men, subjects or obedients, nobles and others for the lands occupied between the period situated after the said truce and the said peace. And everything they will find that will be to return to the king of France, his men, subjects and obedients, nobles or others or to restore in the state they had before the submission, they will return and restore in their state if no just reason is shown by which the said things should not be restored, nor restored in their state. And the same if agreed for the king of England, duke of Guyenne, his men, subjects and obedients, at the time of the truce. And there was if any doubt or discord on these things or some of them for any reason they will report it under their seals with everything concerning this doubt and discord to the king of France for the days of the duchy of Guyenne in the next Parlement 2 that will follow the said doubt and discord. And the parties will be summoned to these days of the said Parlement each time there will be doubt or discord and the king of France will do justice on these doubts and discords in his Parlement, his court being filled with six peers of France. And the four people will swear on the Holy Gospels that they will do well and loyally the aforesaid things without fraud and trouble for one party and the other. And if any of the four died or were prevented in another way by a rightful reason before the completion of this business, others will be put instead of those dead or prevented. 3

Edward II granted for life to Commarque 12 d.st. each day for his wages and 40 s. per annum for his robes to be received by the hands of the Petragorz treasurer of Périgord in the absence of Commarque living in the Pope's household, and the king confirmed this grant and granted it for life to Commarque to be received by the hands of the constable of Bordeaux from the issues of the duchy, as more fully appears in Edward II's letters and the king's letters. Lately, after the death of Sancto Philiberto, de John de Saint-Philibert, Englishman , last mayor of Bordeaux , Oliver de Ingham, seneschal of Gascony and John Travers, constable of Bordeaux , committed at pleasure this office to Pommiers, by advice of the king's council in the duchy in the king's name by the letters patent under the king's seal in use in the duchy, perceiving the customary fee of this office. Order to the constable of Bordeaux to make the purveyances of wines that the king ordered as quickly as he is able, and also to provision as soon as possible the castles and other places in the duchy of the necessary victuals and armaments, any other orders or allowances done by the king notwithstanding. The king ordered him in the past by several of his letters to do several payments, to some persons of the duchy and other persons to whom he was bound in various sums of money, on the customs of the wines and other issues of the duchy, as more fully appears in these letters. Because the men of Scotia Scotland have already moved to the boundaries of the kingdom of Anglia England invading it in hostile manner, in obvious breach of the peace made between them and the king, it is necessary to have great purveyances of wines and other things for the maintenance of the king's subjects who came to the king towards these parts.

Order to the constable of Bordeaux and his controller to make payment from now on of the king's debts in taking in account the time they were originally owed and the current money according to the strong and weak money of this time which happens to be dued. Various debts are claimed from the time of the king's ancestors and the king's time which the king is bound in the duchy, and the money called bordelais ( burdeleys ) has been altered several times, and weak moneys have been made at the times of the trouble of the war in these parts as well as during the time of peace, and because of this the due money which is requested from this time seems now to be higher than what was due in the money current in the past. 1

By K. and C.

1.
The money struck at Bordeaux had been depreciated during times of trouble and war (The war of Gascony, (1294-9/1303) and the war of Saint-Sardos (1324-5)), but this money had been revalued since. Consequently, the king's debts made during these periods appeared higher because of the revaluation of the money. So the constable was ordered to pay these debts according to the rate of the money when these debts had been incured. It was made in order to avoid to pay in strong money a debt incured when the money was weak.

Same as above For Master Bernat de Bruget.

Order to the seneschal of Gascony and the constable of Bordeaux that having taking information on the time of the commitments made by Edward II , and the occupation and work took by Master Briget Bernat de Bruget when he held the office of Agenn' judge-ordinary of Agenais and he was later relieved for the most part of this occupation and work and is still relieved until now, he should negotiate with him to fix to him a reasonable fee, and satisfy it to him. And he should order afterwards what he will see is reasonable to do for the king's honor and profit. The king has learned that Bruget, appointed ordinary-judge of Agenais by Edward II with the full fee that the other judges from the time of the king's ancestors while the land of Agenais was fully in their hands used to receive, claimed to be paid although the main part of this land is not at present in the king's hand. 1

Same as above Concerning various baylies and offices to be taken back in the king's hand . 1

Order to the same to resume in the king's hand all the baylies, issues, rents and offices they will notice were commited by John de Haustede, former seneschal of Gascony and Pey de Galician, former constable of Bordeaux or one of them without the king's warrant to any persons and whatever manner there were commited. So that the emoluments coming from them be answered to the king as it should be. And they should certify the king by their letters of the issues and profits received from them in the meantime. The king does not want that anyone levy anything from them for the present until the king orders otherwise by mandate. The king had learned that Haustede and Galician commited and allocated to various men of Gascony, some baylies, issues, rents and offices without obtaining the king's warrant which customary respond great profits to the king's exchequer of Bordeaux .

Lately, Lalande requested the king has to make payment to her of what he is bound to her, as Jaufré-Rudel V, formerly Bleya lord of Blaye , former husband of Lalande , allocated to her as a dowry 3,000 l.t.parv. to receive from the land of Blaye, and Lalande after the death of Jaufré-Rudel returned what she had in the said land of Blaye because of this dowry to Edward II , and peacefully claimed that a certain sum of money that Edward II had to pay to her at certain terms already past, as more fully appears by letters sealed under the seal of the court of Gascony and by letters patent made by Edward II, which letters Lalande claims to have in her possession, has not yet been paid to her. The king has ordered to the constable that having viewed these letters and having obtained full information, and if it appears it is true, then he should pay to her without delay this sum or make satisfaction to her elsewhere from the issues of the duchy, 1 and it appeared by this information that this sum was due to Lalande, but the constable is postponing the payment as the king learned by her new complaint.

2 June 1333 . Twedemouth' Tweedmouth . Concerning money to be paid to the Pope.

Order to the constable of Bordeaux that having obtained full information on the obligation of Oliver de Ingham, seneschal of the duchy and the writ of the constable of Bordeaux paying to the late Durandi Ramon Durand, former seneschal of the Landes the 3,000 l.bor. , and if he notices that this sum was expended in the business of the duchy and not paid fully or in part to Durand, then he should make payment to the Pope without delay of these 3,000 l.bord. in the next feast of Michaelmas from the issues of the duchy, receiving on that matter letters of acquittance, and he will have due allowance in his account. Lately, Ingham has requested that the king to pay this sum to the Pope as this latter demanded it to Ingham under duress of heavy condemnations. At the time of the trouble that happened in the duchy between the men of Edward II and the men of the king of France , Durand seized a great part of the treasure of Coupenne Gassie-Arnaut de Caupenne, former Aquen' bishop of Dax 1 and lent 3,000 l.bord. from this treasure to Ingham, then seneschal of Edward II for some business of the duchy and to defend Edward II's rights there, and Ingham bound himself and his goods in Edward II's name to pay these 3,000 l.bord. to the Pope 2 in his treasury, as the Pope claimed that Caupenne's goods should belong to him because this bishop died, it is claimed, intestate, but Edward II, at the prosecution of Durand asserting he could not pay again this sum to the Pope, ordered to the then constable of Bordeaux to pay these 3,000 l.bord. to Durand. 3

On 18 February 1331, in compensation of the damages and injuries Aymeric suffered at the occasion of the wars in the duchy, the king granted to him by his letters patent the wages of of one man-at-arms to receive each day from the issues of the duchy by the hands of the constable of Bordeaux until he gets back his houses and possessions lost at this occasion, or until the king orders otherwise concerning his position, and the king ordered to the constable to make payment to Aymeric or his attorney the wages of one man-at-arms from the issues of the duchy according to the tenor of the king's letters. 1 And thereafter on 23 February 1332, at the prosecution of Aymeric who complained that he did not obtain these wages and requested that the king will wish to make payment to him, and the king ordered the constable that having viewed the said king's letters and having noticed the wages due to Aymeric or his attorney from the time of the king's grant, to make payment of them from the issues of the duchy according to the tenor of the king's letters, any ordinance or order of the king's to the contrary notwithstanding. 2 And the king understood from Aymeric's complaint that although his letters of payment of these wages were exhibited by Aymeric's attorney to the constable and this attorney insistently requested the constable to make payment to him or Aymeric of these wages from the time of their grant, Aymeric has not obtained them until now, so he requested the king to make him a suitable payment of them.

16 July 1333 . Twedemouth' Tweedmouth . For the executors of Ramon Durand.

Order to the constable of Bordeaux or his lieutenant to satisfy the heir and executors of Ramon Durand for the sums of money owed to him for his services to the king and his father. Following a petition by Durant Ramon Durand, late Landar' seneschal of the Landes , deceased, that he was owed various sums of money by the king, the king ordered Galiciano, de Pey de Galician, then constable of Bordeaux , to inspect certain letters in Durand’s possession, and to account with him for wages, and horses lost in Edward II ’s service, owed to him and his household, as well as wages paid during his banishment as a result of the peace agreed with the king of France, to be paid from the revenues of the duchy. Pey, as constable, found that 11,718 l. 5 s. 7 d. bon. bord. or guien. were owed to Durand, and he was assigned that sum on the issues of the great custom of the castle of Bordeaux , to be taken at All Saints and Easter in 5 Edward III 1 in equal portions, as set out in letters patent under the seal of the court of Gascony and Galician’s seal, shown by Durand to the king. Further letters ordered the constable to make due payment but Durand’s heir, Galhart Durand , and his executors, then petitioned the king that Durand had not been fully repaid, as the pope had claimed a certain sum of money from the goods of Coupenne Gassie-Arnaut de Caupenne, late Aquen' bishop of Dax , taken by Durand and spent in war service to the king, as the bishop had died intestate. As the pope had not been satisfied for the said sum at the time of Durand’s death, he was excommunicated and hence his body had not received ecclesiastical burial. The king now wishes to reimburse his heir and executors, so that the pope is duly paid the appropriate sum, the sentence of excommunication lifted, and Durand’s body buried in consecrated ground. The king therefore orders the constable that, having inspected and examined the letters of assignment, the king’s orders, and the account, he pay 200 l.st. for absolution from excommunication, and for Durand’s funeral expenses, without delay. He should make an assignment of the remainder on a suitable source of revenue in the duchy, notwithstanding any previous orders or assignments on that source and he is to receive all records of the said debt, together with their quittance, from Durand’s heir and executors. Due allowance is to be made to the constable in his account. The constable is also ordered that the 3,000 l. taken by Durand from the goods of the late bishop of Dax, for which Oliver de Ingham, seneschal of Aquitaine , pledged payment to the pope, shall be paid. If it is found that those 3,000 l. are included in the larger debt of 11,718 l. 5 s. 7 d. , then they are to be deducted from the sum paid to Durand’s heir and executors.

26 July 1333 . Berwicum super Twedam Berwick-upon-Tweed . Concerning the capture of Arnaut, bastard of Caupenne and Arnaut, bastard of Poudenx.

Order to the seneschal of Gascony to capture Campene Arnaut, bastard of Caupenne and Podenys Arnaut, bastard of Poudenx and do full justice or punish them in order to put fear for those doing such crimes and the receivers of the said banished people. Durant Galhart Durand, son and heir of Durant Ramon Durand, kt , late seneschal of the Landes , complained by his petition exhibited to the king and his council, that Ramon because of his office prosecuted Caupenne and Poudenx and some of their accomplices who were notorious malefactors, that they were entrenched themselves in the place of Pount-la-Reyne Pont-la-Reine , 1 and Ramon, together with the seneschal of Gascony besieged Pont-la-Reine and was disgracefully killed by them. Caupenne, Poudenx and their accomplices have been then banished and a certain sum of money has been proclaimed for those who apprehended the said banished people. But these latter, notwithstanding this banishment in the said duchy, came back in it, have been received, maintained, and they have roamed and disturbed committing many harms in contempt and breach of the king’s peace and to the obvious terror of the people, on which the king is amazed and troubled.

3 August 1333 . Novum Castrum super Twedam Newcastle upon Tyne . For Johan Gunter and Guilhem Dubosc.

Order to the same that having viewed the bill of the Edward II 's wardrobe, if he is able to find that 94 l. 16 s.st. are due to Johan Gunter 1 and de Boys Guilhem Dubosc , merchants of Gascony, he should make payment of this sum to them or their attorney or make satisfaction to them elsewhere from the issues of the duchy of Aquitaine, any order or ordinance of the king and his council's to the contrary notwithstanding, receiving from Gunter and Dubosc their letters of acquittance, and he will have due allowance in his account. Lately, Gunter and Dubosc requested the king by their petition exhibited before him and his council to make payment to them of a sum due to them, as Edward II was bound to them in 94 l. 16 s.st. for some wines bought to them for the king's convenience by the then king's butler, as more fully appears in a bill of Edward II's wardrobe made to them. The king has ordered to the treasurers and the barons of the Exchequer and the king's treasury that having viewed the said bill they make payment or satisfaction to Gunter and Dubosc or their attorney, but they have not been satisfied of this sum. 2

By C.

1.
This name of Gunter probably corresponds to the Gascon name Gauter (Gauthier in French) which gave the modern family names Gauté or Gauthé.
2.
For a related petition of these merchants, see TNA, SC 8/289/14412. There these merchants complained that the king was bound to them in 93 l. 16 s.st. for the wine taken to them in London as more fully appeared in a bill of the king's wardrobe dated of the 20 October 1320. And because of this seizure of wines, these merchants said they were in great poverty. Then the king ordered the treasurer and the barons to see the bill and check the accounts. And if they find the king took these wines, they had to pay them and if they did not find it, they should summon the parts and make right. The response of this petition is probably to be found in the Calendar of the Close Rolls (CCR), 1330-1333 , p.89 (20 December 1330). They were named there as merchants of Bernat Barau.

Here John de Stratford, Wynton' bishop of Winchester , chancellor , left just as appears in the memorandum on the dorse of the close rolls. 1

This memorandum is in Calendar of the Close Rolls (CCR), 1333-1337 , pp.129-30. Lately, Guiraudon has requested that the king will wish to make satisfaction to him since he was lately captured and imprisoned by the men of the king of France while he was in the king's service in the war in the duchy, and was detained in prison for a long time, and lost his armoured horses ( equos armaturas ) and other things of no small value, for which he has not received any satisfaction and remuneration, and the king wished to agree favourably to his request. The king previously ordered the same thing to the seneschal and the constable or their lieutenants, 1 and this has still not been done, as the king is given to understand by Guiraudon, whereof he is much amazed.

14 August 1333 . Knaresburgh' Knaresborough . For the citizens of the city of Bayonne.

Order to the seneschal of Gascony that having viewed the sentence of John de Haustede , former seneschal of Gascony and the king's letters of confirmation of this sentence, he should make respect and keep in all its articles, and if it happens that the inhabitants of the places of le Bene Labenne , Capricon Capbreton and Boreto de Bouret or any others are contrary or rebels against it, then he should compel them just as by right and according to the fors and customs of those parts ought to be done. The Baiona mayor, merchants and citizens of the city of Bayonne complained to the king, showing that there was some time ago a cause of complaint before John de Haustede, then seneschal of Gascony, between them and the inhabitants of Labenne, Capbreton and Bouret, of and on the catching of fish by some fishermen who enter in the sea by the canal of del Punt la Pointe 1 or by a small channel to fish and from there return to la Pointe or Bayonne, and also this complaint was heard by the said seneschal and was ended by a definitive sentence, and thereafter the king confirmed and approved this sentence by his letters patent.
