C 61/134, 24 Henry VI (1445-1446) .

Introduction.

The roll of the 24th year of the reign of Henry VI (1445-1446) mainly consists of entries concerning appointments in the duchy of Aquitaine.

First of all, there are appointments to some of the high offices of the duchy. These include two appointments of councillors to the king’s council at Bordeaux: the Englishman John Aloff, lord of Conac (Saintonge) following a royal grant in 1432, and Tétbaut (or Tibaut) d'Agès, dean of the cathedral Saint-André of Bordeaux. 1 The influential king’s councillor Bernat Angevin obtained confirmation of the king’s grant to him and his heirs of the office of clerk of the court of the seneschal of Aquitaine. 2 Hélias de Cazaubieilh was granted the office of provost of the Ombrière of Bordeaux previously held by Bérart de Montferrand, one of the main Gascon leaders of the ‘English party’ who was then too old to have children, 3 after serving 20 years in this latter’s company. 4 There is also the appointment of Ayquem du Vignau, prior of Saint-Jacques of Bordeaux, as one of the of the judges of the superior court of Aquitaine. 5

Several places and baylies were entrusted to Englishmen and Gascons in order to reward them as well as to defend or to recover these places against the ‘French’, as since 1442 the duchy was on the defensive against Charles VII, and its borders were shrinking. The king needed to rely on faithful supporters. Hence the mayor of Bordeaux Gadifer Shortose received the custody of the castles and castellanies of Bergerac and Sainte-Foy-la-Grande, the two main towns then in the English hands on the upstream part of the river Dordogne. 6 The Englishman Thomas Elgin received all the baylies and pasturages of the Agenais with the keepership of the forests and rivers of the duchy, which were for the most part in French hands. 7 The Englishman John Hill was granted the lordship of Came in Labourd because of the lord of Gramont’s defection to the king of France. To reward his supporters or compensate their losses, the king could no longer afford to grant them rents, but only to give them lands seized from rebels or to grant them part of his own demesne. 8 In compensation for the burning of his house of Lucpeyrous by the ‘French’, the Landais Gascon Bertran de Lucpeyrous was granted the bastide of Geaune. Half of this was owned by the king and the other half had been seized from the lord of Castelnau-Tursan who had rallied the king of France Charles VII in 1442, as had many other lords of the Landais. 9 Some other locals were rewarded for their adherence to the English party. For instance Ramon de Piis, an exile from La Réole (taken by the French in 1442), was appointed captain and bayle of the nearby town of Sauveterre-de-Guyenne, and the Basque lord Pey de Lehet and his son Johan obtained the Landais baylies of Capbreton and Labenne situated near Bayonne. 10 The king also allowed exceptionally the transfer of local revenues which he had previously granted to another person. 11

Two entries deal with Johan de Foix, earl of Kendal and vicomte of Castillon, the son of the captal de Buch, in an attempt to treat with care such important Gascon lords. Johan had seized the town of Blaye from Francès, lord of Gramont, who had rallied the French in 1443. A trial had opposed him and his father to the king’s procurator fiscal about this seizure of Blaye. The king granted in vain to Johan de Foix the castle of Mauléon, the castellany of Soule and the baylie of Labourd, which were some important sources of revenues. 12

Three entries concern Guilhotin Andron, lord of Lansac, and his brother Mondot, two active Gascon men-at-arms of the English party. One entry granted them the Médocain lordships of Breuil and Taste, another the Périgourdin lordships of La Force and Maduran, then occupied by Johan d’Abzac, another ‘English’ partisan, which Guilhotin claimed as the nephew of its late lord. Guilhotin also claimed the inheritance of the late Amaniu Béguey. The Andron de Lansac had not been previously a very prominent family, but in the last ten of twelve years of the duchy they became crucial supporters of the Anglo-Gascon cause, like Bernat Angevin. 13

The castle of Génissac and the parishes of Génissac, Moulon and Nérigean as well as the lordship of Blaignac and Blagnadais were seized for the king. This was on account of the inalienability of the sub-province of Entre-deux-Mers which had been annexed to the crown of England. 14

A very unusual entry concerns part of the tithes of the church of Saint-Pierre de Juliac which were to be given to its archpriest by its owners of Gensac. 15

Particularly worthy of note is the ennoblement of the burgess of Bordeaux Bernat de Garos with the grant of a specific coat of arms which is painted in this roll. 16

Appointment of Alloff John Aloff, Connok lord of Conac , 1 as one of the councillors in the duchy of Aquitaine under the same pay and conditions as the other councillors. There is no record that he had received payments for anything else up to this date.

On 26 November 1432 John Aloff was granted by the king at his pleasure the lordship of Conac, an ancient possession situated in Saintonge of the 'French' Jean de Harpedanne, lord of Belleville . See entry in C 61/125 . He had served the king in Aquitaine ever since the departure of Thomas, duke of Clarence from the duchy (in 1413) without receiving wages for himself and his men, or so he claimed. He had already been in command of the garrison of Conac castle from 1424, and had rebuilt and fortified it at his own expense. He had there a garrison of 140 men which included 90 men-at-arms. This grant was confirmed to him on 13 November 1438. See the Calendar of the Patent Rolls (CPR), 1436-1441 , p.224.

Grant to Chartoyse Gadifer Shorthose, kt , and his heirs, because of his resistance to the king's adversary of France 2 of the custody of the town, castle and Braeyrac castellany of Bergerac in Perregort Périgord , which he has maintained and defended at his own expense for the past 20 years; and also of the town , castle and Sancta Fides castellany of Sainte-Foy[-la-Grande] in Dagenoiz Agenais , which is ruined and uninhabited, together worth a yearly sum of 50 l.st. until he is granted a suitable place of the same value. The grants are made in response to a petition from Shortose, that he should be compensated for the loss of the castle of Génissac and the parishes of Gensac Génissac with high and low justice, the parishes of Molon Moulon and Nerian Nérigean , which were granted to him by the duke of Exeter , 3 former lieutenant-general in Aquitaine, a grant confirmed by the king on 18 May 1441, and revoked by the king on 25 July 1445 at the request of the churchmen, nobles and people of the prévôté of Entre-deux-Mers as these parishes were parts of the king's domain. 4

Letters of protection granted for three years to Robert Rokley, esquire , whom the king sends into the duchy of Aquitaine, along with his servants, lands, rents, goods and chattels. The king does not wish him to be prosecuted for offences committed before this time. The king orders all judges sheriffs, mayors, lieutenants, bailiffs, seneschals, castellans, officials, ministers and other subjects of the realms of England and France, the duchy of Aquitaine and other lordships not to cause damage and impediment to Rokley and his goods and chattels. 1

Appointment of Theobaldus, Dages Tétbaut d'Agès, doctor of canon law and dean of the cathedral Saint-André of Bordeaux , as one of the king’s councillors in the duchy of Aquitaine . 1 He is to receive the customary revenues associated with the position from the constable of Bordeaux. 2

Grant to Pis Ramon de Piis, baronet , 2 for life, of the captaincy and baylie of the town of Sauveterre in Bassedoiz Bazadais , in recompense for losses incurred through royal service in peace and war. 3

This Ramon de Piis had lent money to some inhabitants who had been taken prisoner by the French soldiers of Charles VII when the town of La Réole was assaulted on 8 October 1442. Some inhabitants tried to take refuge in the castle of La Réole which was still held by the Anglo-Gascons until 7 December, but they were not admitted into the castle and stood in the castle ditch where they were made prisoners by the French. Then Ramon de Piis, who went into exile from La Réole, returned to his town to ask for a repayment of his loan in early 1446. As the men of La Réole have submitted to the French and remained in their obedience, Ramon had lost his temper and insulted them calling them 'cuckold French traitors' and their wives as 'deceitful whores'. Consequently, some inhabitants of La Réole killed him, and they have requested letters of remission (i.e. pardon) from King Charles VII of France. In May 1446, the latter granted him these letters of remission. Appointment of Delhet Pey de Lehet, esquire , and his son and heir Johan to the baylies of Capberton Capbreton and la Bene Labenne for the term of their lives or whoever lives longest. This replaces a previous grant appointing Pey de Lehet alone as bayle of the aforesaid places for life. 2

Vignau is also appointed keeper of the seal of the court in place of Durrieu. 3

The yearly total value of these grants is 15 l.st. , with the proviso that he pays the surplus to the castle of Bordeaux . The grant is made in recompense of injury and financial loss suffered through capture. 2

Grant to Robert Roos, kt , carver ( dapicida ) of the king’s household , of the lands and rents formerly owned by Amaneu, Bygney Amaniu Béguey , which have been in the possession of Mounferrant Bérart [de] Montferrand, kt , and his male heirs procreated by him, by royal grant since 30 December 1442. But Montferrand is now impaired by old age ( senio confractus ) and cannot procreate any heirs. Statement that the place, land and lordship of Blenhac Blaignac and Blenhades Blagnadais have been seized by the seneschal as they are part of the king's domain as duke of Guyenne , and that all the Churchmen, nobles and commons residing there were to be maintained in their privileges, customs, franchises and liberties. Bonneville promises to request the king to give letters patent of confirmation of the annexation to the crown [of England] of Blaignac and Blagnadais.

Order to the men of the superior court held at Bordeaux , the seneschal of Aquitaine, the constable of Bordeaux, the judge of Gascony and all the other justices and officers to let Gaston de Foix 1 , Longuevilla count of Longueville and Benauges and captal de Buch , his son Johan [de Foix], Castellon vicomte of Castillon and men in their company enjoy the cancellation of prosecution granted by the king to make full justice about this matter with a summary procedure according to the laws and customs of Aquitaine. As the town Blaye had surrendered to the vicomte of Castillon on the king's behalf, there was a dispute between comte de Longueville , and his son the vicomte of Castillon on the one part and the procurator fiscal and the other duchy officers on the other, about some articles against the Longueville and his son, sent to the great council of the kingdom of England by Chortose Gadifer Shorthose, kt , in his name and on behalf of Bernat Angevin , commissaries appointed by the seneschal of Aquitaine, and as the captal and his son have given satisfying answers to the king and as the king's great council in England ( magnum consilium noster cismarinum ) has received sufficient information through an inquiry in Aquitaine 2 that the captal and his son have done their duty, the king has ordered the cancellation of any prosecution against Longueville, his son and men in their company.

Grant to Bernardus Bernat Angevin, king’s councillor , 1 and his sons Jacobus Jacmes 2 and Henricus Henric , of the office of clerk of the court of the seneschal of Aquitaine, to be occupied by them or through deputies, for the lifetime of whoever lives the longest. This replaces a former similar grant formerly given by letters patent to Bernat Angevin and his elder son Johan , now deceased. These latter letters patent have been returned to chancery in order to be cancelled. 3

13 May 1446 . Westminster . Licence of alienation .

Licence to alienate a conkagium of the city of Bayonne granted to Johan de Casenave, citizen of Bayonne , and owner of the house called Dargesilhs in Bayonne, for a payment of 40 s. in the hanaper, without any challenge by judges, sheriffs, escheators and other officials. He holds this conkagium 1 from the king by hereditary right paying each year, for a male goshawk, the sum of 30 s.morl. to the castellan of Bayonne. Casenave wishes to grant the conkagium to le Hubiage Martin Lohobiague 2 alias Martin Herauritz, 3 citizen and burgess of Bayonne and his heirs to hold from the king by service. If Martin dies without heirs, the conkagium is to revert to his nephew Deriu Marticot Durrieu 4 and his heirs and, if Marticot dies without heirs, it is to revert to another nephew of Martin. If this nephew dies without heir then it is to revert to Domenges de Lohobiague , Martin's full brother.

Lohobiaga was a name of house of Urrugne in 1598. A wealthy family of Saint-Jean-de-Luz from 16th to the 19th century was named Lohobiague. In 1643, Jean de Lohobiague (d. 1649) bought a plot at Saint-Jean-de-Luz and built the house of Lohobiague (la 'Maison Lohobiague', in Basque 'Lohobiague Enea'), wrongly known today as 'Maison Louis XIV', one of the two most visited monuments of this town.

Herauritz was the name of a medieval house of Ustaritz and is still a local placename of the commune of Ustaritz . A 'Peys' de Herauritz, inhabitant of Biarritz, is mentioned in 1335 and 1342 in the Livre des Établissements , Archives municipales de Bayonne, ed. E. Dulaurens (Bayonne, 1892), pp.250 and 325.

Licence granted to Forster Stephen Forester , with the merchants of London he would delegate as deputies, to export 200 pieces of tin, weighing 50,000 pounds, on various boats, barges and other vessels lying in the ports of London , Plymmouth Plymouth and Fowy Fowey , to Bordeaux or Bayonne , paying due customs. Order to all admirals ect. to permit him to do so without impediment.

Grant to Guilhotin Andron, Lanssac lord of Lansac , kt , and his brother Mandot Mondot Andron de Lansac, esquire , and their heirs, because of their good service in the king's war in the kingdom of France, the duchy of Aquitaine and elsewhere, to their great costs, of the house, lands and lordships of Breuel Breuil and Tastes Taste with their dependencies, until such time as equivalent holdings may be found in Médoc or Bordeaux . This replaces a grant of the same made six years earlier to Guilhotin and Mondot for life. 2

Appointment, for life, of Casali Veteri, de Hélias de Cazaubieilh , as he has served for 20 years in the company of Bérart de Montferrand the kings Henry IV and Henry V in France and in Aquitaine, as provost of the Ombrière of the castle of Bordeaux. The office was previously held by Monte Ferrando, de Bérart de Montferrand, kt , who obtained it from Henry IV by his letters, 1 who desired that his commission to be cancelled and granted to Hélias, has returned this letters to the chancery to be cancelled. 2

Order to the seneschal of Aquitaine and the king's council [in Bordeaux] , the captain and Gensacum bayle of the town of Gensac , and the king's officers that they should induct Arnaldini Johan Arnaudin, Julhaco, de archpriest of the church of Saint-Pierre de Juliac 1 in the diocese of Bazas, into corporal possession of a fifth part with half of the great tithe which the lords of the castle and town of Gensac used to own and which is said to amount to no more than the yearly sum of 20 s.st. . The initial grant of this office of archpriest to Arnaudin was effected on 12 May 1445. 2

Grant to Guilhotin Andron, kt , and Mandot Mondot Andron, esquire of Lansac and their heirs, of the places of la Fforsa La Force and Manduran Maduran , in Périgord ( Peregort ) as the next heirs of the late Hélias Prévost , Guilhotin's uncle, under the terms of his last will, Johan Prévost his son having died without children and Mariota his daughter being in rebellion as she has married Beaupot [Johan de] Beaupoil , 2 of the party of the king's adversary. 3 After Hélias's death, Guilhotin had taken possession possession of this inheritance with the assent of the king's council in Bordeaux, but thereafter Dabazac Johan d'Abzac has ousted Guilhotin and Mondot from La Force and now occupies it illegally. 4

Commission of oyer et terminer , with a summary procedure, to the judges of the superior appelate court of Aquitaine and the seneschal of Aquitaine to examine letters of grant to Bernardus Bérart[de] Montferrand, Dagassas lord of Agassac 1 of the inheritance of the late of Bygney Amaniu Béguey, kt and the relevant wills, to call all relevant witnesses and to come to a definitive decision. As Guilhotin Andron de Dalansac Lansac, kt , elder son and heir of Guilhem Andron de Dalansac Lansac , kt , had claimed to be Beguey's heir but had been opposed by the king's procurator fiscal in the seneschal’s court and audience for 15 years, during which time it was granted to Montferrand, and as Guilhotin Andron has appealed to the king.

Grant for life to Miquel Miqueu Dusolier , because of the good service he has done to the king in the duchy of Guyenne and in the wars, of the Dentredos mars writing office of the prévôté of Entre-deux-Mers . Order to the seneschal of Guyenne, the constable of Bordeaux, the judge of Gascony to deliver this office to Dusolier or his proctor and permit him to take all the revenues of this office without impediment.
