C 61/135 25 & 26 Henry VI (1446-1448)

Introduction.

Several entries on this roll concern Gaston de Foix, count of Longueville and captal de Buch, or else his son Johan de Foix, earl of Kendal and vicomte of Castillon, the most powerful supporters of the Anglo-Gascon government. First of all, there was in 1447 an appeal of Gaston de Foix against the Anglo-Gascon government about the case between himself and the young Galhart IV de Durfort, probably about the possession of the noble house of Jalles (see previous roll), as the initial judgement had not been in his favour. 1 There is an inspeximus of an act of Gaston de Foix of 1439 granting to Bernat de Lamensans, an esquire who was one of his servants, the lordship of Auros (in Bazadais). 2 Johan de Foix agreed to his father’s grant. This roll shows us that Johan was becoming increasingly important and was highly favoured, being given the lordships of Médoc and Bazadais that had previously been granted to the duke of Gloucester (now deceased). This was followed by orders to some Gascon captains to deliver their castle to him (the castle of Cussac: Grimon de Bordeaux; castle of Castillon-de-Médoc: Bidot de Bielle; castle of Lamarque: Johan de Lehet). 3 On 18 November 1446, Johan obtained once again (see previous roll) the castellany of Mauléon in Soule and the baylie of Labourd (both in the Basque Country). 4 However, it was a difficult task to implement these two grants since two men with considerable local influence were in office: Luis de Beaumont as castellan of Mauléon and Augerot de Saint-Pée as bayle of Labourd. 5 Henry VI ordered to his major officers in the duchy to put Johan de Foix in possession of both Soule and Labourd, and also ordered the communities and inhabitants of the place and castellany of Mauléon of Soule as well as the inhabitants of Labourd to acknowledge the authority of Johan de Foix. 6 However the powerful Luis de Beaumont obtained in 1447 a postponement of this decision: he was to keep the castellany of Mauléon until he had been satisfied of 1,000 l.st. of the money of England on the grounds that he and his father had built a great tower and some walls at the castle of Mauléon which had cost as much as 2,000 l.st. . 7 In reality, Johan de Foix never took possession of Mauléon, and Louis de Beaumont was still castellan of Mauléon when the count of Foix Gaston IV besieged the castle and received its surrender (August-September 1449). The Beaumont grip on the 'English' Basque Country was tightened by the grant of the lordship of Garro (Labourd) to Luis de Beaumont’s bastard half-brother Guillermo. 8

As with the private act where Gaston de Foix granted the lordship of Auros to Bernat de Lamensans, we have in this roll the confirmation (1447) of another private act made at Bayonne in 1446 transferring the conkagium granted by the king to Johan de Casenave to another inhabitant of Bayonne called Martin de Lohobiague or the nephew of the latter. 9

As in the previous roll, a member of the Lehet (or Lahet) family, more famous at this period as 'Haitze' (the name of their main possession situated at Ustaritz in Labourd), brought trouble to the streets of Bayonne, and even took prisoner a burgess of Bayonne, despite the fact he was bayle of Capbreton and Labenne for the king. 10

As in previous rolls too, we find some conflicting grants. On 14 June 1447, several king’s officers in Aquitaine were ordered to remove Per-Arnaut de Saint-Cricq from the office of prévôt of Dax in order to give it to Augerot de Saint-Pée, 11 while three days later the king confirmed the same office to Per-Arnaut de Saint-Cricq and his elder son Jacmes. 12

On judicial matters, we see the failed duel between two burgesses of Bordeaux. One of them (Guilhem Bidau) had accused the other (Bernat de Garos) of committing crimes of lese majesty. The latter attacked the former and damaged his legs so that Bidau had to lodge his complaint whilst walking with crutches and therefore asked for a duel on horses because of his disability! 13

An entry deals with an ongoing consequence of the 'Journée de Tartas', the military expedition led by Charles VII of France into Gascony in 1442. This concerned the lord of Saint-Maurice (Landes) who had been forced to take refuge in Bordelais when Charles VII’s army came and destroyed his lordship. He was to be compensated by receiving the half of Saint-Maurice which had been held by the kings of England by pariage since its foundation. 14

As was common in this period, Englishmen also received grants and offices in the duchy. John Blakeney, clerk of the signet, was given the goods of the late Bernat de Garros at Bordeaux, 15 while the esquire Ralph Chernok obtained the lordship of Cadillac-en-Fronsadais. 16 Thomas Routh had the office of door-keeper and keeper of the tower of the castle of Bordeaux which had been seized from the lord of Gramont, who had defected to the French in 1443. 17

Inspeximus and confirmation of the king's letters patent granted to Johan Casenave, citizen of the city of Bayonne and owner of the house called Dargesilhe in the city of Bayonne: 1

Licence to alienate a conkagium of the city of Bayonne granted to Johan de Casenave, citizen of Bayonne , and owner of the house called Dargesilhe in Bayonne , for a payment of 40 s. in the hanaper, without any challenge by judges, sheriffs, escheators and other officials. He holds this conkagium 2 from the king by hereditary right paying each year, for a male goshawk, the sum of 30 s.morl. to the castellan of Bayonne . Casenave wishes to grant the conkagium to le Hubiage Martin Lohobiague 3 alias Martin Herauritz, 4 citizen and burgess of Bayonne and his heirs to hold from the king by service. If Martin dies without heirs, the conkagium is to revert to his nephew Deriu Marticot Durrieu 5 and his heirs and, if Marticot dies without heirs, it is to revert to another nephew of Martin. If this nephew dies without heir then it is to revert to Domenges de Lohobiague , Martin's full brother.

Inspeximus and confirmation of a public instrument by Johan de Cava , papal and imperial notary, with this notary's sign, at the request of Johan de Casenave:

Witnesses: Agulhes, dous Guilhem des Agulhes , Dare Saubat Darré , mariners and citizens of Bayonne , and Master Pey d'Anglade, bachelor of canon law , ordinary clerk of the city of Bayonne . 7

Lohobiaga was a name of house of Urrugne in 1598. A wealthy family of Saint-Jean-de-Luz from 16th to the 19th century was named Lohobiague. In 1643, Jean de Lohobiague (d. 1649) bought a plot at Saint-Jean-de-Luz and built the house of Lohobiague (la 'Maison Lohobiague', in Basque 'Lohobiague Enea'), wrongly known today as 'Maison Louis XIV', one of the two most visited monuments of this town.

Grant for life to John Blakeney, the king's servant , clerk of the signet , at his supplication, of all the places, cellars and gardens with their revenues which were owned in the city of Bordeaux by the late Dagaros Bernat de Garos who paid on them an annual rent to the king, up to the annual sum of 20 s.st. with all the arrears of their profits and rights, any previous grant to Blakeney or any ordinance made against it notwithstanding.

Bernat de Lamensans has swore to Gaston de Foix to help him and his successors against everybody apart from the king as duke of Guyenne each time they will be required to do so. And furthermore Lamensans and his heirs will pay homage to Gaston de Foix and his successors, and in case Foix or one of his successors orders Lamensans and his descendants to deliver the place of Auros to him, they will do it without making impediment. Order to the seneschals of Aquitaine and the Landes , the constable of Bordeaux, the mayors of the cities of Bordeaux , Bayonne and Dax and all the king's officers of the duchy to remove Seint Crik Per-Arnaut de Saint-Cricq from the office of prévôt of Dax and compel him to give up this office, and return this office to Saint-Pierre Augerot de Saint-Pée, esquire , maintaining him in this office, and ordering to those concerned to obey and attend Saint-Pée as prévôt of Dax and respond of all its rights, profits and emoluments to this latter, the other letters obtained by Saint-Cricq, the trial made about it or any other thing made against it notwithstanding. According to the supplication of Augerot de Saint-Pée the king has granted on 23 October 1442 this office of prévôt of Dax to him and his father, 1 the late Johan de Saint-Pée, kt , for their lifetime, and then Johan de Saint-Pée died and this right remained to the sole Augerot. However, around six months later on 30 April 1443, Per-Arnaut de Saint-Cricq surreptitiously obtained from the king this office of prévôt of Dax, 2 and Augerot de Saint-Pée has been then disturbed unjustly and against reason, particularly with trials, in the exercise of this office, and he requests the king to bring him a remedy. This latter wants to decide in Augerot's favour as he has been the first to receive this office.

Previously on 24 October 1431 the king had granted by his letters patent to Aiguille this bordenage until the death of Spenser Hugh Spencer and after at the king's pleasure. 2 Bidon d'Aiguille has returned these letters to chancery in order to obtain the bordenage for life.

Grant for life to Thomas Routh , because of his good service in the king's war in France, Normandy and Aquitaine, of the office of door-keeper and keeper of the tower of the castle of Bordeaux , to be held by him or his deputy, with all the profits pertaining to this office, to be held in the same way as the Muyssidano, de lord of Mussidan and after the Gramonte, de lord of Gramont before his rebellion. Formerly, the king had granted them for life to John Chippenham by his letters patent. And Chippenham has returned these letters to chancery for cancellation in order to give them for life to Thomas Routh.

Order to the communities and inhabitants of the place and castellany of Mauléon of Soule to appear before Johan de Foix, Kendale earl of Kendal , to whom the king has granted by his letters patent the keepership or government of the castle and castellany of Mauléon of Soule, 1 or his deputy on behalf of the king, and acknowledge to him what they hold from the king. And because the king has learned that the castle of Mauléon risks to be greatly ruined by lack of repairs and its walls and buildings risk becoming irreparable, thereafter he orders them to help by any way in order that this castle be repaired and keepered safely, and they must not create difficulties under any circumstances. The king is informed that the revenues due to the king in the place and castellany of Mauléon have greatly diminished because of a lack of recognizance and renewing of the fiefs made by them.

Grant for life to Frensch Stephen French and Seyntlowe Giles Saintlowe, esquire , of a yearly sum of 20 l. to be received from 29 September 1446 on the purparty of the duchy of Cornwall in the toll of Lynne Lynn and on the tronage, mensurage and lovecope there which are parcel of this duchy by the hands of the receiver general or other the bailiffs, farmers, occupiers or officers of this purparty, tronage, mensurage and lovescope , to be received twice a year at Easter and Michaelmas by equal portions, any previous grant to French and Saintlowe and any statute made against it notwithstanding. Previously Henry V had granted these for life by his letters patent to Stephen French and Walsch Thomas Walsh under the same terms, letters confirmed by the current king on 20 December 1422. But French has survived Walsh and has returned these letters in chancery for cancellation in order to obtain new letters for himself and Giles Saintlowe.

Appointment, at the supplication of the burgesses and citizens of the city of Bayonne , of Asteley John Astley, kt , as mayor of the city of Bayonne for a seven years period with the customary prerogatives, wages, rights, profits and emoluments enjoyed by [the previous mayors] Thomas Burton and Chetwyn Philip Chetwynd , knights, without prejudice to the franchises, liberties and privileges of the city and inhabitants of Bayonne. Previously, the mayors appointed by the king ruled the city of Bayonne without partiality, but now this city is suffering discords.

Order to seneschal of Aquitaine and Johan de Foix, Kendale earl of Kendal to seize in the king's hands all the goods, movable and immovable, of Bernat de Garos, merchant of Bordeaux and allow to pay due compensation to Guilhem Bidau, originating from Bordeaux, for the damages he had suffered. As Bideau Guilhem Bidau had accused Bernat de Garos to have committed crimes of lese majesty elsewhere, and as, in order not to be pursued for these crimes, Garos has maimed Bidau's limbs and had broken his legs in order to kill him. Nevertheless, Bidau went on crutches ( cum baculis ) before John [Holland], earl of Huntingdon , now duke of Exeter , then king's lieutenant in Aquitaine , to accuse Garos and have trial by battle with him on horseback as he was not able to fight on foot. The lieutenant had agreed and both parts were under arrest in the castle of Bordeaux, but Garos was released from there by giving pledges, while Bidau was retained in jail for a long time. When Bidau was released, he went in England to seek remedy from the king who entrusted his case to the constable of England, but in the meanwhile Garos had died.

Confirmation and ratification of the king's grant to Bernat Angevin , at this latter's supplication, of the lordships of Roasan Rauzan and Puyols Pujols , 1 to be held by Angevin and his legitimate heirs as they were peacefully held by the late Guilhem-Ramon de Gensac, 2 former lord of Rauzan and Pujols as it appears in some old charters and public instruments, saving the customary homage due to the king. Order to all the seneschals, prévôts, bayles and other officers [of the duchy] maintain and defend Angevin in his right and possession. 3

The king grants again by these presents in perpetuity these castles of Roazan Rauzan and Puyols Pujols and their appurtenances to Bernat Angevin and his heirs, except for the royal rights, and the customary fidelity and homage due to the king, the express mention of their annual true value of these castles and any previous grant to Bernat Angevin notwithstanding.

Grant in perpetuity to Sanctus Mauricius Bernat de Saint-Maurice, esquire , at his supplication, because the place of Saint-Maurice where Bernat lived has been totally destroyed when came in Gascony the adversary of France with his army, 1 Bernat lost everything he owned there and he, his wife and their children took refuge in the in parte Burdeg' Bordelais region , of half of the high and low, full and shared justice with the revenues and other rights pertaining or that could pertain to the king in Saint-Maurice up to the yearly value of 9 l.st. . The king had learned by the supplication of Bernat de Saint-Maurice that the place of Saint-Maurice was built the first time by a person named Generosa on a territory and jurisdiction fully owned by her, but the persons wanting to live there and enjoy the privileges, franchises and liberties granted by Generosa were impeded in doing so by several troubles and violent acts made by certain nobles and commons ( per nobiles et communes ). Thus Generosa , in order to protect the inhabitants of Saint-Maurice and avoid their departure elsewhere, made a pariage with a king of England, a king's ancestor, 2 this king receiving half of the lordship of Saint-Maurice , Generosa and her heirs and successors keeping the other half, and the king had on one half of the high and low, full and shared justice of Saint-Maurice and Generosa and his heirs had the other half until the coming of the king's adversary of France in Gascony.

Grant for life to Brutaik Johan de Brutails, esquire , of the office of Capreton, la Vene bayle of Capbreton and Labenne with all its rights, revenues, profits and emoluments. The king has learned by the supplication of Johan de Brutails that Haytse Pey de Haitze 1 of the de patria nominata Basquos Basque Country who held and occupied this office of bayle of Capbreton and Labenne for some time. As Pey de Haitze, the previous bayle, has entered Bayonne walking in its streets fully armed with his accomplices, destroying mills, beating and injuring several king's liege men, taking some goods outside this city, and after that some of Haitze's accomplices climbed the city wall ( scalarunt ) and kidnapped Jagmot, Lez Bay Jacmot de Lesbay who was under the king's safeguard, in order to murder him, and therefore Haitze is a notorious evildoer and has to be expelled from this office.

Grant to Bellomente, de Luis de Beaumont, count of Lerín , lord of Curton and Guissen Guiche , to hold the place and fortalice of Mauléon of Soule until he is fully paid of the sum of 1,000 l.st. of the money of England. During this latter period, he will have the place and fortalice of Mauléon of Soule with the customary emoluments and profits as Luis and his father 1 held it. He has been shown to the king by Luis de Beaumont that him and his father have faithfully held the place and fortalice of Mauléon for 50 years or more 2 without causing any trouble to the king or his subjects. And as it is well known that Mauléon is situated in the borders of the duchy [of Aquitaine], and it is necessary to be highly vigilant and provide against the adversary threat, Louis de Beaumont's father and Louis have made built at their own costs one great tower and several walls, and various other repairs up to the sum of 2,000 l.st. on which they have not received from the king any payment or reward. However, the king has appointed another person for the keepership of Mauléon in removing Luis de Beaumont from this office without any compensation or bringing a remedy to his great prejudice.

Appointment by these presents of Duddeley John [Sutton], lord Dudley, kt , king's councillor , and Master Thomas Kent, doctor of both laws , as judges and general and special auditors with special power to summon before them personally or by special mandate under their seals any king's vassals and subjects of the duchy of Aquitaine of any status, and bring mutual peace by any possible way. And they have to make sentence of any judicial appeals, particularly the appeal made by the count of Longueville 1 because of a sentence made to his prejudice by the lieutenant of the seneschal of Aquitaine, the constable of Bordeaux, the controller of Bordeaux , the king's councillors of Aquitaine, the mayor and jurats of the city of Bordeaux , the king's conservators of the truces in Aquitaine , and they have to hear the parties by way of summary procedure, they come to final sentence and apply it, putting the lands, lordships, possessions or places, and all the movable and immovable goods into the king's hands if there are any conflicts about them. The king orders all his officers and subjects to obey and attend them, and help them in the execution of the agreements or sentences. It is publicly known that certain great discords have happened between the count of Longueville , 2 the Kendale earl of Kendal , 3 the lord of Duras , 4 the mayor, jurats and inhabitants of the city of Bordeaux and some other great lords and nobles, and the king has to bring remedy about them.

On 19 July 1438, 1 as Botiller Ralph Boteler, kt , the king's main butler, was too occupied in the king's service to go to Bordeaux , the king had appointed by his letters patent Nicholas Bolthorp, with the advice and assent of Boteler, to receive the wine that is due by right at Bordeaux to the king, the constable having to pay him the wages and fees that the late Martyn Robert Martin received. 2

Appointment for life of William Beaufitz as gauger of the wines at Bayonne and all its jurisdiction, to be held by himself or through a deputy or sufficient deputies, receiving in this office the sum of four blancs of the money called ardits on each tun amounting to two pipes, or three thirds by tun, or four quarters by tun, to be held as By Guilhem [de] Vic held it until now with all profits pertaining to this office.
