Physical condition of the roll

The roll consists of ten membranes. There are entries on all of the face sides, but on none of the dorses. The roll is generally in good condition.

C 61/133 23 Henry VI (1444-1445)

Introduction.

In 1444, the grant which had been made on 24 July 1443 to the community of Bordeaux, and copied into the previous roll, about the right of issac on wine sold in taverns of Bordeaux and the right of the market at Bordeaux for a period of 24 years to support to repair the city wall, was cancelled. This was on the grounds that it had been granted shortly before, on 25 February 1443, to the Englishman John Pykborne. 1 This problem of contradictory grants is relatively common in the Gascon Rolls.

We see it again in regard to Gensac. On 16 March 1445, John Strangways, already captain of the castle of Fronsac, received for life the office of captain of Gensac, 2 yet on 5 August 1445 Loys Despoy received the fortalice of Gensac with its appurtenances and issues until the king might be able to grant him something else. 3 At the same time, two other entries concerning Gensac were copied into the roll: letters of protection for the captain and the inhabitants of the town, lordship and jurisdiction of Gensac (4 August 1445). 4 The archpriest of the church of Saint-Pierre de Juliac (in the diocese of Bazas) received a share in the great tithe which the lords of the castle and town of Gensac used to own. 5

The members of the king’s council at Bordeaux were ordered to do full justice concerning the occupation of the noble house of Jalles (situated near Bordeaux) by Médard de Durfort, on behalf of his brother the late Galhart III de Durfort, lord of Duras and Blanquefort. According to Gaston de Foix, count of Longueville and captal de Buch, this occupation was made against the rights of his son Johan de Foix, vicomte of Castillon. 6 This form of conflict between two main supporters of the Anglo-Gascon regime was always a delicate matter as it was essential not to push one of them into the arms of the French. At the same time, Galhart IV de Durfort was granted letters of protection allowing him to go in England if he wanted with the members of his household, his servants, horses, jewels, gold and silver, goods and harnesses, without being disturbed by the English creditors of his late father. 7

Of particular interest is the confirmation of the grant of the lordships of Rauzan, Pujols and Blasimon to the influential Bernat Angevin, with the right to follow the inheritance customs of Bordelais rather than those of Bazadais which would have forced him to divide his possessions among all his sons. Bernat Angevin was also ennobled and received a coat of arms which are magnificently depicted in this roll. This is without contest the most luxurious illustration made on the Gascon Rolls in the whole period. 8

Several entries concern the lordship of Blaignac and Blagnadais in the Entre-deux-Mers area (Bordelais). On 1 June 1443, the seneschal of Aquitaine William Bonville, who had been appointed by the king on 1 December 1442, mustering in January 1443 to cross to the duchy, confirmed the annexation of Blaignac and Blagnadais to the crown of England. Then, later in the year, he made an indenture with the Englishman William Ormsby to give him the office of captain of this town. In 1444, Ormsby had to provide for men and artillery to defend this place. 9 Other Englishmen were appointed in the duchy: Henry Benet, one of the clerks of the privy seal, was appointed as prévôt of Blaye, and John Blakeney, one of the clerks of the signet, was appointed as bayle of Pouillon (Landes) and prévôt of Libourne. 10 John Tiptoft, the young, son of the late John Tiptoft, seneschal from 1415 to 1422, who died in January 1443, was confirmed in his father possessions in the Landes. 11 John Holland, duke of Exeter and earl of Huntingdon, former king’s lieutenant in Aquitaine, obtained the great lordship of Lesparre. 12

The English crown tried to keep on its side the powerful Luis de Beaumont, alférez of the kingdom of Navarre, who was very influential in South Gascony, by elevating in 1444 his lordship of Guiche (Labourd, Basque Country) to the rank of a barony. 13

Grant for life to Greissac Johan de Grissac, burgess and merchant of the city of Bordeaux , at his supplication, of the movable and immovable goods owned by the late Johan Boris , burgess and inhabitant of Bordeaux , up to the yearly sum of 10 m. , with the proviso that these goods have not been given to anyone else, answering for any surplus to the exchequer of Bordeaux. The late Johan Boris , burgess and inhabitant of Bordeaux, had chosen in his last will Amaniu de Mazères , then in the king's obedience, as universal heir of all his movable and immovable goods. But after the death of Boris , Mazères has rallied the king's adversary of France 2 and became a king's rebel, thus these goods have been seized in the king's hands.

Revocation of the grant made to the community of Bordeaux of the right of issac on wine ( lissac vinorum ) sold in taverns of Bordeaux and the right of market of Bordeaux ( begueiriu de foro ), and return them to John Pykborne with their profits from the time when he had been deprived of them while he was peacefully in their possession. On 25 February 1443, 1 these issues had been granted for life by the king to John Pykborne, but thereafter he was deprived of them because the king had granted them for some years 2 to the community of Bordeaux by his letters patent dated 24 July 1443 3 Consequently, Pykborne had supplicated the king to provide him a remedy, revoking the letters granted to the city of Bordeaux, and returning to him these revenues and the king had ordered to the former sheriffs of London to summon, concerning these letters, in chancery the attorney or attorneys of the community of Bordeaux at a date that has already occurred.

Grant to John [Holland], duke of Exeter , and his legitimate male heirs issuing from him, of the lordship of Lesparre together with all its castles, manors, towns, houses, lands, tenements, revenues and rights, without rendering anything to the king and his successors, with the proviso that he permits people to enjoy any fief or part granted [in the lordship of Lesparre] by the king or his predecessors for life or for some years. And the king grants him the right to obtain for him and his heirs these latter fiefs or parts at the end of these persons' lives or at the end of the length of these grants. And if the duke of Exeter dies without male heirs, the lordship of Lesparre will revert to the crown. On 4 February 1440, 1 the king had previously granted for life this lordship to John [Holland], then earl of Huntingdon and king's lieutenant in Aquitaine.

Order to the members of the king's council being at Bordeaux, that having summoned and heard the parties, they do full justice according to the local fors and customs. And the king puts under his safeguard the count of Longueville and his son in order to protect their right. [Gaston de Foix], Longa Villa count of Longueville and Benauges , captal de Buch , has supplicated the king, as curator of his elder son, Johan [de Foix], Castellione, de vicomte of Castillon , as Jales Johan de Jalles, kt , had designated in his will [Johan de Foix] as heir of his Jales house of Jalles 1 with its appurtenances, and [Gaston de Foix] had obtained it peacefuly in his son's name at the death of Johan de Jalles, in full view of the late lord of Duras , 2 father of the current lord of Duras, 3 , but thereafter Medardus Médard de Duras , 4 brother of the late lord of Duras, 5 had taken this house of Jalles by force, expelling the men of [Gaston de Foix], and he had maintained there men-at-arms and fortified this house for war, receiving there the revenues pertaining to this house which are of a great annual value; and the late lord of Duras 6 , his son, the current lord of Duras, 7 and this latter's uncle Médard de Duras have refused to return this house to Gaston de Foix in contempt of the orders of justice that awarded it to [Gaston de Foix] and his son, and the current lord of Duras, his uncle Médard and their accomplices have committed several crimes against Foix's men and servants, detaining them in harsh prison conditions, extorting from them great sums of money by force and leaving them starve to death.

Letters of protection granted, at his supplication, to Dureford Galhart [IV] de Durfort, lord of Duras and Blanquefort , minor son and heir of the late Dureford Galhart [III] de Durfort, kt , lord of Duras and Blanquefort, allowing him, because of the good service made by his father in the duchy of Aquitaine to Henry V and the current king, to come and stay quietly in the kingdom of England and to return to [Aquitaine] with the members of his household, his servants, horses, jewels, gold and silver and all his goods and harnesses. Galhart [III] de Durfort often came to the kingdom of England because of several difficult matters of business concerning the state and safe government of the duchy of Aquitaine, and Galhart III had borrowed several sums of money during his stays in England in order to maintain his status, thus Galhart [IV] de Durfort fears that these sums have not been repaid and that he will be arrested or damaged because of these debts if he comes to England to meet the king. The king orders all his officers to maintain and protect Galhart [IV] de Durfort, his men and servants, as well as their goods and harnesses, allowing them to stay and move in England and return [to Aquitaine]. The king wants Galhart [IV] de Durfort to be quit of all trials and complaints because of the debts made by his father or any of his ancestors, but Galhart [IV] and his creditors have to pay and satisfy for all the victuals and other things they buy in England.

Grant in perpetuity to Bernat Angevin , one of the king's councillors in the duchy of Aquitaine , and his heirs, because of Bernat's good service in the king's wars and elsewhere, of all the castles, lands and lordships of Roasan Rauzan , Puyols Pujols and Blasimont Blasimon in the diocese of Bazas with all their appurtenances, allowing Bernat Angevin to pass them down at his death as he wishes to his male heirs issued from him, or failing that, to his female heirs issued from him, notwithstanding the custom of Bazadais specifying that all the sons and daughters born by a legitimate union have to receive by equal portions the goods of their father and mother at their death, a custom which have destroyed several noble houses of this diocese owing service and homage to the king's predecessors, and particularly allowing him to pass down after his death his lordships without divisions to his first son as do the other nobles of Bordelais in order to keep united these lordships and to preserve due service and homage to the king. As the seneschal has been informed by some texts and also some trustworthy persons that the place and Blanhac lordship of Blaignac and Blanhades Blagnadais is part of the king's domain as duke of Guyenne, by these presents he puts them forever in the king's hands as his own domain. And furthermore the seneschal has sworn in the king's name to the church men, nobles and commons inhabiting the place, land and lordship of Blaignac and Blagnadais, at their request, to keep and maintain them in their privileges, customs, franchises and liberties, not allowing that they can be put outside the king's hands, keeping them forever into the crown [of England] as domain of the king [of England] and duke of Guyenne, and his own possession in the land and lordship of Dentre deux Mars Entre-deux-Mers as it was formerly the case, and as the inhabitants of Blaignac and Blagnadais want always to live and to die in the king's land and not to leave it as they have asserted when the seneschal took possession of their place. The seneschal will request the king on their behalf to grant letters of confirmation of this perpetual annexation to the crown.

Indenture made between William Bonville, kt , Guyayna seneschal of Guyenne , on one hand, and William Ormsby, esquire , on the other, by which Ormsby has promised and agreed with Bonville to take the office of Blanhac captain and governor of the castle, place and jurisdiction of Blaignac and Blagnadais in the king's name and that of the seneschal, at pleasure of both, receiving there all due profits and revenues pertaining to this place and jurisdiction, rendering account to the constable of Bordeaux or his lieutenant or a person deputed by the seneschal. William Ormsby will be mounted and armed with in his company three archers mounted and equipped, for the safeguard of Blagnac and Blagnadais, waging war for the king and the seneschal each time he will be required to do so, and reciving their wages from the rents and revenues of Blaignac and Blagnadais, or from the king and his seneschal if these rents are not sufficient. And furthermore, Ormsby will keep a sufficient deputy to stay within Blagnac and its castle with the portey door-keeper , the botilley butler , the gachaner watchman and the men of this land as they are used to do for the safeguard of the place and castle of Blaignac, to the king's expenses. And the seneschal wants, because of the war and the poor condition ( debat ) of the place, that Ormsby will receive enough money for a reasonable repair of this place and castle. And Ormsby will swear to render the castle and place of Blaignac to the king or the seneschal each time he will be required to do so by the express order of the seneschal under his own seal, and not differently. The seal of the office of seneschal of Guyenne is appended to the part of the indenture kept by William Ormsby. And the seal of William Ormsby bearing his arms is appended to the part of the indenture kept by the seneschal.

Grant to Loys Despoy, kt , and to his heirs issued from his body, of the fortalice of Gensac with its appurtenances and issues, until he will be granted another possession of the same value by the king, and order to the king's councillors [in the duchy of Aquitaine], the judge of Gascony , and all the king's officers of the duchy to let him enjoy such grant and be captain and keeper of this fortalice, as by previous letters patent the king had already granted Gensac in the diocese of Bazas and its appurtenances to Despoy and his heirs. Despoy had taken possession of it but was not able to enjoy it peafully because Vernhe Johan de Lavergne and the inhabitants of Gensac challenged it, as by virtue of an indenture made between them and the late John Radcliffe as seneschal of Aquitaine , Gensac had to remain in the king’s hands, and during the lawsuit Johan de Lavergne and thereafter his son Isarn [de Lavergne] had occupied this fortalice by force, and as the king wants to reward Despoy’s good services to Henry V and hopes to retain Gensac in his hands.

Letters of protection and safeguard granted to the king's captain and all the inhabitants of the town, lordship and jurisdiction of Gensac , and all their children, servants, familiars and subjects of both sexes ( una cum suis liberis, servitoribus, famulis, aff[i]vatis utriusque sexus ) 1 of both sexes, houses, lands, agrières ( agrerie ) 2 tithes, vineyards, meadows, pastures, waters, rivers, heath with gorse ( jaugarie ) 3 , willow plantations ( albarete ), 4 mills, cattle and all their goods and possessions. The king orders all the king's justices and officers of the duchy of Aquitaine to maintain and protect them from any undue injury, violence, damage, oppressions and novelties made on their hereditary possessions, and kept them in the king's safeguard each time they are required to do so. They must proclaim this publicly with the customary bans and put the king's pennons ( penuncelli ) 5 on the their houses and goods.

Letters of protection and safeguard granted to John de Tiptoft, lord Tiptoft , who is a minor and is under the king's custody, and his castles, places, lands, houses, mottes, parishes, prévôts, baylies, lordships, jurisdictions, with the members of his household, servants, captains, lieutenants, officers, vineyards, meadows, pastures, waters, rivers, moors, willow plantations, heath with gorse ( juugarie ), 1 gardens, woods, mills, serfs, tithes, rents, fiefs, profits and emoluments, and all his movable and immovable goods. Order to the seneschal of Aquitaine, the constable of Bordeaux, the mayor and échevins of Bordeaux , and the other king's officers of the duchy of Aquitaine, that if John Tiptoft, lord Tiptoft , son of the late John Tiptoft , who is a minor and under the king's custody, has been removed without right, as he complained to the king, from his lordships of Goose Gosse , Seynax Seignanx , Maresyne Marensin and Born , to return him these lordships with compensation on damages and expenses, and to permit him to enjoy them with their revenues, prohibiting him anyone to challenge him their possession. Philippa [Talbot] , widow of Matthew Gournay and wife of John Tiptoft [the elder] granted to this latter these lordships in perpetuity, a grant confirmed by Henry IV and later by the current king on 11 July 1437. 2
